A team of outstanding students from James M. Bennett High School defeated teams from Institute of Notre Dame of Baltimore and Liberty High School of Eldersburg, on IT'S ACADEMIC, the nation's foremost high school quiz program. The match will be aired Saturday, March 6, at 10 a.m. on WJZ, Channel 13.

In honor of the team and the school, through Sunday It's Academic sponsor Giant Food will be featuring a special "James M. Bennett High School Garden Tuna Salad."

The James M. Bennett team consists of Samim Manizade, Carter Tilghman, and Ethan Kahn. Their faculty coach is Phil Bock. The team will return later this season for a playoff match with two other first-round winners.

Special features of the conference include: ‘Raising Successful Learners in Elementary School’ workshop led by Wicomico Teachers of the Year Debbie Wilkins and Susan Cullen; One Stop Job Market Mobile Van; and Paying for College seminar.

State To Seek Death Sentence And No Possibility For Parole Against Thomas Leggs Jr.


Thomas James Leggs Jr. is served the State’s Notice of Intent to Seek Sentence of Death and the State’s Notice of Intent to Seek Life Without the Possibility of Parole.

This afternoon, Leggs was served in the Wicomico County Detention Center. Notices have been filed in the Circuit Court for Wicomico County.

This morning, Leggs was re-indicted for Murder in the First Degree, Burglary in the First Degree, Burglary in the Third Degree, Kidnapping, Kidnapping of a Child Under 16, Sex Offense in the First Degree, and Sex Offense in the Second Degree.

State’s Attorney Davis R. Ruark says the 30-year-old Salisbury man is alleged to have killed, kidnapped, and sexually assaulted 11-year-old Sarah Foxwell. The young girl’s body was found in a wooded area on Christmas Day in Delmar, Maryland. Leggs is a registered sex offender in Maryland and Delaware.

A trial date has not been set as of today’s date.

Resume: Early this morning the Delaware State Police Sussex County Drug Unit conducted a search warrant on the 10000 Block of Maury Avenue, Seaford, DE, in reference to an ongoing drug investigation. Upon executing the search warrant Troopers took the above suspects into custody without incident. Also in the home during the time of the search warrant were two small children, one of which was only 2 months old, and the other is a 1 year old.

The search warrant yielded, approximately 85.5 grams of crack cocaine, 2.4 grams of marijuana, an undisclosed amount of US currency, and various drug paraphernalia.

Antonio R. Bailey was formally charged with, Trafficking Cocaine (Felony), Possession with Intent to Deliver Narcotics (Felony), Possession with Intent to Deliver a Non-Narcotic (Felony), Maintaining a Dwelling for Keeping a Controlled Substance (Felony), Conspiracy 2nd (Felony), 2 Counts of Possession of Drug Paraphernalia (Misdemeanor), 2 Counts of Endangering the Welfare of a Child (Misdemeanor), and Criminal Nuisance (Misdemeanor). Antonio R. Bailey was arraigned and committed to Sussex Correction Institute in lieu of $98,000 cash bail.

Sheena Ayers was also formally charged with, , Trafficking Cocaine (Felony), Possession with Intent to Deliver Narcotics (Felony), Possession with Intent to Deliver a Non-Narcotic (Felony), Maintaining a Dwelling for Keeping a Controlled Substance (Felony), Conspiracy 2nd (Felony), 2 Counts of Possession of Drug Paraphernalia (Misdemeanor), 2 Counts of Endangering the Welfare of a Child (Misdemeanor), and Criminal Nuisance (Misdemeanor). Sheena Ayers was arraigned and committed to Sussex Correction Institute in lieu of $40,000 secured bail.

Patricia Uhey was formally charged with, 2 Counts of Possession of Drug Paraphernalia (Misdemeanor), and Criminal Nuisance (Misdemeanor). Patricia L. Hoyle was then released pending trial. Patricia L. Hoyle’s photo is not available.

Wednesday afternoon we inquired if you would please post a “lost dog” on your blog.

It was a Pug – Fawn in color with a black mask. He has been our family pet for approximately 12 years. To you, we would like to thank you ever so much for posting this notice on your blog for us. To the gentleman who found our pet, we can’t thank you enough. He not only kept the dog, he bought food for it and kept him out of the cold. We do not know his name but he has made my children very happy.

Your blog is the most well read, newsworthy publication in our area. It really puts the DT to shame. Again, thank you for posting and the gentleman who found our pet.

Sorry To Disappoint Our Viewers

I'm sure all of you are extremely disappointed in our lack of coverage of Mayor Ireton's umpteenth photo opportunity with the Press. I had to tie my shoes. I had to watch the paint dry on one wall. I could almost swear I saw a blade of grass growing in my front yard, so I had camera in hand to get "the shot."

That being said, my schedule just wouldn't allow me to be present for this event of shaking hands and I already have photos of Mr. Ireton smiling and waving to people. Maybe I'll just dig up one of those and fake it.

So please forgive us for not blowing the gas money to driving all the way into Salisbury at the risk of being killed. Maybe there's a shot of it on Google Earth?

Narrative:
On January 9, 2010 the Worcester County Sheriff’s Office responded to a complaint of a Burglary at Abaco Lane in West Ocean City. The investigation was turned over to the Worcester County Bureau of Investigations (W.C.B.I.). It was discovered that some of the items stolen were pawned at a local Pawn shop in Salisbury, Maryland for cash. Charges were filed and three suspects have since been charged with Burglary and Theft under $1,000.00. The three suspects that have been charged are Shawn Barry White Jr. W/M, 23 years old of Berlin, Ryan Kramer Talbot W/M, 22 years old of Newark, and Justin Matthew Caple, W/M, 21 years old of Ocean City.

The last suspect was arrested on March 3, 2010 and all 3 suspects are currently being held in the Worcester County Detention Center on Various Bonds.

Mayor Ireton, Wicomico River, Creekwatchers & SU

Hi Joe:

I'm sure you saw the Daily Times article today regarding The Wicomico Creekwatchers.I just don't get it. Mayor Jim Ireton states "But the thing that is important and the reason I want to keep Creekwatchers in the fold is they have done all this research over the past eight years and nobody has done anything with it."

Then a comment by Judith Stribling a biology professor at Salisbury University--But continuing to perform the tests at all depends on funding. Stribling who serves as liaison to the testing program performed by students as SU, said it's not clear.

Here is my question--Why pay for testing that is not being used by anyone? Sounds like SU is making money! Also SU is building enormous buildings that don't require storm water retention ponds like all the commercial building around it. I guess these rules don't apply to them!

Seems like Dr. Stribling is somewhat of a hypocrite since the SU storm water goes directly into the streams that flow into the Wicomico River. Maybe its just job security for her.

Quality Care At PRMC?

I wanted to see if any of your readers had experienced what I had to endure today at PRMC. I was in the process of getting paperwork completed to have my father admitted per his doctor's orders. The woman I had to deal with had a name I cannot pronounce, I believe La'Reishqua or something along those lines. She was extremely short with me and rolled her eyes everytime I had a question or something clarified. You can never be too careful, especially if you don't want the bills to come directly to you!

To top this off, she was listening to some of the most vile rap music I have heard. I'm not proclaiming to be a hard core Christian, but in a public place and dealing with those who need medical attention, offensive music really should not be allowed. I have called the hospital administration without any success. Since you seem to have some pull within this community, maybe we can show PRMC that they need to take better care of their customers and provide a more pleasant customer service experience- especially when you are caring for sick family members.

SALISBURY IMPACT FEE DEBATE – IF YOU MISSED IT

Although the discussion drags along for the most part, mainly because of the lengthy statements by the participants that should have been cut short by the moderator in many places, it is interesting to see that Councilwoman Cohen has no concern about adding to the already high cost of development – especially "affordable housing" – in Salisbury.


But Ms. Cohen said nothing about the recent "Privileged and Confidential" legal opinion by Paul Wilber (see the post below) that the City should pay into the impact fee fund more than 1.2 Million Dollars in fees that it has waived for affordable housing projects over the years. OUCH!

The growing impact fee mess in Salisbury will be discussed on tonight’s SBYNews Show at 6 PM.

Salisbury Police Department Press Releases

On March 4, 2010 at approximately 9:52 pm, Officers of the Salisbury Police received a call to respond to a residence on the six hundred (600) block of Smith Street for the report of a shooting. Upon arrival the officers located two (2) victims suffering from gunshot wounds, one (1) inside of the residence and one (1) in the front yard area. Located in the residence was 43 year old Linwood White of Salisbury who had sustained a gunshot wound to the foot. White was transported to the Peninsula Regional Medical Center where he was treated and released.

Located in the front yard of the residence was 19 year old Anthony Austin of Salisbury, who had sustained two (2) gunshot wounds to his side. Austin was transported to the Peninsula Regional Medical Center then transferred to the Maryland Shock Trauma Center and listed in stable condition. Witnesses to the incident advised officers that the shooting was the result of an altercation that occurred at the residence. Approximately seven (7) shots were fired at the residence by the suspect who was described as:

On March 4, 2010 at approximately 11:24 pm, Officers of the Salisbury Police received a call to respond to the Subrunners restaurant for the report of an attempted armed robbery. Upon arrival the officers met with Subrunner employees who advised that one (1) employee was approached while outside of the restaurant by two (2) suspects who produced a handgun then made the employee return to the interior. Once inside, the employee alerted the other employees and fled into an office. As the employee fled, the suspect with the handgun fired three (3) shots, none of which struck any of the employees. Both suspects then fled from the restaurant on foot without taking any property. There were no injuries and the suspects have been described as:

black male, 5’11", medium build, dark complexion, wearing a black ball cap, a black "puffy" vest, a black long sleeve shirt, dark jeans and black tennis shoes.

During a routine records check it was found that the suspect had a suspended drivers license. The suspect was taken into custody and a check of the vehicle revealed a handgun and a quantity of handgun ammunition. A search of the suspect’s person, incident to arrest, revealed a quantity of suspected marijuana and a quantity of suspected MDMA.

Nurses Aren't Supposed To Laugh

'Of course I won't laugh, said the nurse... I'm a professional. In over twenty years I've never laughed at a patient.'

'Okay then, he said, and proceeded to drop his trousers, revealing the tiniest 'man thingy' the nurse had ever seen.

Length and width, it couldn't have been bigger than a AAA battery.

Unable to control herself, the nurse started giggling, and then fell to the floor laughing.

Ten minutes later she was able to struggle to her feet and regain her composure. 'I am so sorry,' she said. 'I don't know what came over me. On my honor as a nurse and a lady, I promise it won't happen again. Now, tell me, what seems to be the problem?'

...'It's swollen,' he replied.

Impact Fees

I'm not sure if you're listening to the Radio Show we mentioned earlier this morning, I am. I'm sitting back laughing once again because we chose to live in Sussex County, just over the MD/DE line. Wicomico County and Salisbury are so afraid of the competition from Sussex County, (8 miles from Downtown Salisbury) not being subjected to City/County taxes and or fees in Wicomico County.

I have been telling you for years, Sussex County is by far the very best place to live than anywhere else. Now, that being said, I have also stated, IF Delmar chooses to build a Mall just over the Delaware line, say goodbye to Salisbury. No sales tax, nowhere near the impact fees, lower property taxes, you can't compete with that and trust me, sooner than later some smart developer will take advantage of that.

The new Center of Salisbury will look like it's 50 years old. A Home Depot or Lowe's would destroy any competition. Mind you, if a competitor aside from Home Depot or Lowe's would locate in Delmar, DE. they would destroy those businesses in Salisbury.

In Reversal, Obama Advisers To Recommend Military Tribunals For 9/11 Plotters

Top advisers to President Obama are close to a decision recommending that the self-proclaimed mastermind of the Sept. 11, 2001, terror attacks be prosecuted in a military tribunal, The Washington Post reported Friday, citing unnamed administration officials.

According to the report, the president's advisors have grown increasingly wary of bipartisan opposition to the planned civilian federal trial in New York City, mere blocks from where nearly 3,000 Americans were killed in the spectacular attack on the World Trade Center.

New York Mayor Michael Bloomberg and prominent state Democrats, who initially embraced Attorney General Eric Holder's decision to try Khalid Sheikh Mohammed and four other conspirators in Manhattan, have since reversed their support for the trial.

The paper said administration officials are privately bracing for backlash from disappointed liberals and some government lawyers should Obama reverse his decision to try the detainees in civilian courts.

Officials told the Post an announcement could come soon and that they hoped to finalize their plans by March 18, when Obama leaves for a trip to Indonesia.

It would be interesting to create a poll with these two photos and have people guess what's happening. Most would never assume anything close to the real story. It appears to be a joyous homecoming, a reuniting of mother and son. The truth is not so heart warming.

The lady in the picture is the mother of an American that was ambushed in Fallujah , Iraq . Her son was murdered. His body was dragged around in the streets of the city, then burned and hung from the upper trusses of a bridge. The murderers gathered to celebrate and have their photos taken with the trophy.

The young sailor in the picture is one of the Navy SEALs that later captured the leader of the band of terrorist butchers and brought him to justice.

If the story ended there, it would still be an acceptable feel-good, good-guys-win story. Unfortunately, that's not the case - this Navy SEAL is facing criminal charges.

Because, somewhere along the timeline of his capture, the terrorist murderer suffered a school-yard fat lip, his captors are now being charged with nothing short of war crimes and facing discharge and imprisonment.

So, instead of celebration of justice served and heroes honored, these photos record betrayal, compounded mourning and the effects of a corrupting sickness.

The mother of slain Blackwater guard Jerry Zovko drove from Ohio to give each of the accused SEALs a blessed rosary and lend them her support. "These young SEALs are in this situation because they caught the mastermind behind the death of my son, and not only my son and his co-workers but also the marines who went into Fallujah after their death," said Donna Zovko. "I am very proud of these young SEALs and thankful to them. They did not do anything wrong."

May I ramble a bit? Think out loud, so to speak? I'm trying to make some sense of this. What title can I give to the mentality of a people that send their best to defend the whole and then betray them? To what shall I attribute the attitude of a people that habitually prosecute their heroes while defending their enemies? What creates a culture that allows people to vilify and isolate their most noble and deify their most corrupt?

I perceive more symptoms of a sickness, a corruption of the nation's heart and soul. I am tempted to label it 'liberalism' or 'progressivism', but those too are just symptoms of the infection. But this is nothing new, I recognized these symptoms four decades ago in the shameful treatment of our warriors returning from Vietnam, in the acceptance of Marines bombed in Beirut, in the ho-hum yawn of media coverage of Mogadishu (Black Hawk Down), in the return to mental numbness after 9/11, prosecution of the Marines of Haditha, assault of recruiters across the country, anti-war protesters at the gates of Walter Reed Army Hospital...

This sickness, this infection has gone untreated for far too long. Americans are a tolerant bunch. We've patiently waited for the ingrates among us to grow up and develop a sense of pride and awe in the greatness of America . It's not happening.

I'm tired of waiting. I'm fresh out of tolerance. There comes a time when the treatment for an infection cannot be postponed any longer, lest the patient die. Through history how many nations have habitually betrayed their defenders and survived?

States Under Fire As Budget Cuts Free Prisoners

‘They’re letting out people they shouldn’t let out,’ Mich. prosecutor says

In the rush to save money in grim budgetary times, states nationwide have trimmed their prison populations by expanding parole programs and early releases. But the result — more convicted felons on the streets, not behind bars — has unleashed a backlash, and state officials now find themselves trying to maneuver between saving money and maintaining the public’s sense of safety.

In February, lawmakers in Oregon temporarily suspended a program they had expanded last year to let prisoners, for good behavior, shorten their sentences (and to save $6 million) after an anticrime group aired radio advertisements portraying the outcomes in alarming tones. “A woman’s asleep in her own apartment,” a narrator said. “Suddenly, she’s attacked by a registered sex offender and convicted burglar.”

In Illinois, Gov. Patrick J. Quinn, a Democrat, described as “a big mistake” an early release program that sent some convicts who had committed violent crimes home from prison in a matter of weeks. Of more than 1,700 prisoners released over three months, more than 50 were soon accused of new violations.

Dems Rebuff Brown, Vote Down Amendment Despite Bipartisan Plea

Democrats voted Thursday to defeat the first piece of legislation offered by Sen. Scott Brown, despite a plea from the newly elected lawmaker for bipartisanship.

The Senate voted 56 to 44 to derail an amendment sponsored by Brown (R-Mass.) that would have allocated $80 billion in unobligated stimulus funds to pay for a tax cut for 130 million people in the workforce.

The amendment failed when senators voted to enforce a procedural objection Senate Finance Committee Chairman Max Baucus (D-Mont.) raised against the measure. A majority voted to sustain the motion.

In his first Senate floor speech, Brown asked Democrats to support his proposal, reminding them he was the first Republican to vote for a $15 billion jobs package offered by Sen. Majority Leader Harry Reid (D-Nev.).

Brown and four other Republicans voted for the Reid jobs bill, giving Senate Democrats their biggest bipartisan legislative victory of the year.

Brown asked his colleagues to return the favor.

“Let me remind colleagues in this chamber that bipartisanship is a two-way street,” Brown said.

"He was a Marxist-socialist in college," said John C. Drew, who knew Mr. Obama as a university student, in an interview. "He kept talking about the need to overthrow capitalism in favor of a working-class revolution."

One of Mr. Obama's favorite philosophers was Frantz Fanon, a post-colonial Marxist who championed Third World liberation movements. Fanon argued that the West - led by America - was based on racism, imperialism and the economic exploitation of the world's poor. The only remedy was authoritarian socialism and a massive redistribution of wealth from Western nations to developing countries.

Rather than being a pragmatic centrist - as the mainstream media insists on portraying him - Mr. Obama is the very opposite: an ideologue who is pursuing his political project even at the risk of badly damaging the Democratic Party.

This explains his bizarre, almost reckless desire to ram Obamacare through Congress. The president has said he wants an "up-or-down vote" on his health care overhaul - preferably by the end of this month, before the Easter recess. In other words, he has given the green light to House Speaker Nancy Pelosi, California Democrat, and Senate Majority Leader Harry Reid, Nevada Democrat, to use reconciliation, a parliamentary process designed to fast-track budgetary measures. Under these arcane rules, a simple majority in the Senate of 50 Democratic votes plus a tie-breaker from Vice President Joseph R. Biden Jr. will be enough to pass health care reform. The filibuster will be rendered impotent.

This is unprecedented. Never in our history has reconciliation been used to pass a major piece of social legislation on a narrow partisan majority. Obamacare will overhaul nearly one-sixth of the U.S. economy. By contrast, Social Security, Medicare and Medicaid passed with overwhelming bipartisan consensus. Contrary to popular myth, numerous Republicans endorsed the New Deal-Great Society welfare state. This is why repealing it has been so difficult (if not impossible).

The White House and its media allies claim that the 1996 welfare reform bill, the 1997 children's health insurance program and the 2001 Bush tax cuts were passed using reconciliation. This is misleading. Every one of these measures had strong Democratic support - especially in the Senate.

Justice Dept. Probes Voting Machine Merger

The largest voting machine company in the country bought its biggest competitor six months ago without advance fanfare. Now the Justice Department is investigating whether to unwind the merger that put a privately held Nebraska company in control of the voting machines in nearly 70 percent of the nation's precincts.

With midterm elections looming and a battle for control of Congress under way, a coalition of election officials from several states and voter advocate groups is pressing the Justice Department to unscramble the combination of two companies. Critics say the merger could cause foul-ups at the polls on Election Day, and some even characterize it as a national security risk.

The emergence of one megaplayer in the electronic voting machine industry may be an unintended consequence of reforms enacted after the presidential election debacle in Florida a decade ago. Few companies can afford to get into the business due to the expense of developing the electronic voting safeguards that reformers insisted on.

Senate Rules Committee Chairman Chuck Schumer, D-N.Y., has raised concerns about the purchase, in which Election Systems & Software Inc. of Omaha, Neb., bought the voting machine subsidiary of Diebold Inc. of North Canton, Ohio.

In an industry plagued by equipment malfunctions, wrongly recorded votes and a lack of transparency, the need for increased quality competition — not less competition — is essential, John Bonifaz, legal director of the voter advocacy group Voter Action, wrote Schumer.

Election failure on a large scale has the potential to destabilize the nation, so ES&S must divest some of its assets, reduce the scope of election jurisdictions subject to its software and take other steps to offset the increased threat to national security, a coalition of 19 election experts and groups including Common Cause said in a Feb. 12 letter to Justice's antitrust division.

OTTAWA -- The Bank of Canada took its first steps Tuesday toward returning the country to more normal interest rate levels by signalling a more hawkish tone on inflation and acknowledging the economy is performing better than expected on "vigorous" consumer demand.

The messages were conveyed in the Bank of Canada's latest interest-rate statement, which kept its record-low benchmark rate of 0.25% as is and pledged to keep it there until July. But most bank watchers took note of subtle changes in the statement, compared with previous rate announcements, and there was enough there for them to begin the countdown to rate hikes.

"I suspect [governor] Mark Carney and company are starting to feel the urge to tighten -- not a strong urge now, but an urge nevertheless," said Michael Gregory, senior economist at BMO Capital Markets.

Among the key changes was a declaration from the bank that the risks to its inflation outlook are "roughly balanced," and no longer "tilted slightly to the downside" -- language that suggests deflation is no longer a concern and that price increases are creeping up to a level that may prompt a response. (The central bank sets its interest rates to ensure inflation remains at 2%.)

The wording change may appear trivial, "but it is nonetheless significant as it reflects an economic backdrop that continues to improve at a much faster pace than what the bank had envisaged," said Paul-André Pinsonnault, senior fixed-income economist at National Bank Financial.

The rate statement emerged a day after economic data indicated the Canadian economy grew at a robust 5% annualized pace in the final three months of 2009, blowing past market expectations for a 4% gain and the central bank's original 3.3% forecast. Economists say the fourth-quarter performance has set the stage for another robust gain, of perhaps 4% or more, for the first three months of 2010.

Meanwhile, recent data indicate that both the headline and core inflation rates have moved much closer to the 2% level than the central bank had expected. Under the bank's forecast, the 2% level would not be reached until the third-quarter of next year.

In the statement, the central bank acknowledged economic activity has been "slightly higher" than its own projections, with the 5% gain in the fourth quarter powered by "vigorous domestic demand" and a recovery in exports.

Using the adjective "vigorous" caught the eye of some analysts, such as Mr. Gregory. "That implies a strong unleashing of demand pent-up during the recession, with the credit creation process critical to this unleashing.

"In other words," he added, "low interest rates are doing their job in stimulating demand -- perhaps, increasingly, too well."

Mr. Pinsonnault noted the bank also dropped any reference to "considerable" excess supply, an indication, he said, that the slack in the economy is being absorbed at a faster pace than the central bank anticipated.

The consensus remains that the central bank will wait until July to begin raising rates, but the bank used Tuesday's statement to begin building its case. There are two more scheduled rate decisions between now and then, with one April 20 and then June 1.

"What we saw [Tuesday] was one of many steps aiming at moving away from dovish statements to relatively more hawkish ones. This gradual movement comes naturally well before an actual tightening in monetary policy," said SĂ©bastien Lavoie, economist with Laurentian Bank Securities.

His firm believes rate increases will begin in the third quarter, but he said the odds have increased that the first hike will be in July as opposed to September.

How much, and how rapidly, the central bank raises rates beginning in July is up for debate, with economists estimating increases of 100 to 150 basis points in the second half of 2010.

Environmentalists Want An Apology For Sen. Colburn's 'Watermelon' Comment

Environmental advocates insist that they are not comparable to watermelons, contrary to an Eastern Shore senator's assertion at a recent legislative hearing.

At a delegation meeting on Feb. 15, Sen. Richard Colburn, R-Cambridge, criticized the "river keepers" who push water quality in Maryland's tributaries and streams. He called them "green on the outside and red or socialist on the inside,” according to a story reported here.

Environmentalist and veterans groups are now demanding an apology.

Colburn voiced his opinion during a discussion about how environmental regulations have slowed a number of projects along the Eastern Shore. This week Colburn said he had not been contacted by representatives from either camp.

“I’ll certainly address any correspondence that they may have, addressing their concerns if and when I receive it,” Colburn said Wednesday. “If I were to ask you for an apology or you were to ask me, I think that in a civil matter, you would do it formally. I guess they put out a press release. But I’ve received nothing from them.”

Gansler’s Office: Gansler Can’t Be Impeached

Maryland Attorney General Douglas F. Gansler’s office came to the conclusion this week that the state’s General Assembly does not have the power to remove Gansler from office.

“The Maryland Constitution explicitly states that a ‘court of law’ is the forum for proceedings to remove an Attorney General,” wrote Gansler’s counsel Dan Friedman in a letter to House Speaker Michael E. Busch.

Friedman then quoted his 2006 book “The Maryland State Constitution: A Reference Guide” ($136.95 on Amazon). “The Attorney General may only be removed by a court proceeding for the specified grounds, not by impeachment by the legislature,” wrote Friedman. As an aside, Friedman wrote the book before he was hired into the AG's office.

Virginia Seatbelt Violators Beware!

The commonweath is not messing around when it comes to forcing people to wear their seatbelts.

Today, the Virginia Senate agreed to the House's version of a bill to require anyone under 18 to wear a seat belt in a vehicle. Anyone riding in the front seat already must wear a seat belt. Now, if you're under 18, even if you're in the back seat, you must buckle up.

There is one exemption, if you are riding in the back seat of taxicab, you don't have to wear one.

Location: 400 block of Keene Avenue, Salisbury, MD
Suspect: William L. Fitchett Jr., 19, Salisbury, MD

Narrative: On 3 March 2010 at 10:57 PM, a taxi driver was in the process of dropping off a fare in the 400 block of Keene Avenue in Salisbury when he was approached by a young male suspect brandishing a handgun and demanding the driver’s money. The driver, who realized that he was about to be the victim of a robbery, instead sped off not allowing the would be robber to get his money. Upon reaching a safe area, the driver contacted the Sheriff’s Office.


Responding deputies left their patrol cars in a nearby park to allow a stealthy response to the neighborhood. Upon checking the location, the deputies observed a subject standing on a front porch of a house on Patrick Avenue who matched the description given by the taxi driver. Upon the deputies announcing their presence, this individual exclaimed "Oh- (expletive)" and attempted to run away with the deputies in pursuit. The suspect did not get far, as he was apprehended on Keene Avenue which runs adjacent to Patrick Avenue. Upon apprehension, this subject, William L. Fitchett Jr., was discovered to possess a mask identical to what the taxi driver stated the robber wore. That, coupled with a positive identification by the victim and statements made by Fitchett made it clear the deputies had their man.


The gun used by Fitchett was apparently discarded just prior to apprehension. A call at 7:30 AM the following day led deputies to the location where Fitchett dropped it. A deputy responded to the scene and recovered a .357 magnum revolver fully loaded with hollow point ammunition. The weapon matched the description provided by the taxi driver perfectly.


Fitchett is currently held in the Wicomico County Detention Center on $250,000.00 bond.

Date of Incident: 3 March 2010
Location: West Zion Rd at Leonard Lane, Salisbury, MD
Suspect: Justin M. Perry, 20, Delmar, MD

Narrative: On 3 March 2010 at 3:59 PM. Deputies from the Wicomico County Sheriff’s Office responded to a report of a vehicle stuck in the mud off the side of West Zion Road in the vicinity of Leonard Lane in Salisbury, MD. Upon arrival they located a 2000 Lincoln sedan and observed that two men were attempting to push it out of the mud. Upon identifying the operator as Justin Perry, one of the deputies observed that Perry leaned back into his vehicle in appeared to be an attempt to hide something from the deputy. The deputy checked the area where Perry was in the vehicle and located a wooden marijuana smoking device that still contained obvious remnants of marijuana in it.


Perry admitted ownership of the device and was transported to the Central Booking Unit where he was processed and taken in front of the District Court Commissioner. After an initial appearance, the Commissioner released Perry on Personal Recognizance.

Riding Public Transit Saves Individuals $9,215 Annually

Washington, DC -- RIDING PUBLIC TRANSIT SAVES INDIVIDUALS $9,215 ANNUALLY

Transit riders now save $715 more per year compared to last year at this time
as the cost of gas has increased $0.77 per gallon

Washington, DC: Individuals who ride public transportation can save on average $9,215 annually based on the March 3, 2010 national average gas price and the national unreserved monthly parking rate. Compared to last year at this time, the average cost per gallon of gas was $1.933 which is $0.77 less than the current price of gas at $2.703 per gallon. The total savings as compared to last year at this time equates to an increase of an additional $715 in savings per year for transit commuters.

The Transit Savings Report released monthly by the American Public Transportation Association (APTA) calculates the average annual and monthly savings for public transit users. The report examines how an individual in a two-person household can save money by taking public transportation and living with one less car.

Transit riders can save on average $768 per month. The savings amount is based on the cost of the national averages for parking and driving, as well as the March 3 national average gas price of $2.703 per gallon for self-serve regular gasoline as reported by AAA.

Taking public transportation provides a safe and affordable way for individuals and families to cut costs, according to APTA. In addition, local public transit offers a travel option that has an immediate positive impact in reducing an individual overall carbon footprint while helping reduce our dependence on foreign oil.

Hi Joe,

I’m sure you don’t want to become a restaurant review site… but I just wanted to let you know you should warn your readers about how truly awful Lucky Star is. I’ve eaten plenty of places in my 33 years, and must say it is the worst Asian restaurant I’ve ever been too. The office got carryout and it was a HUGE JOKE. The portions are beyond ridiculously tiny. It would be pushing it to charge $1.99 for the lunch specials and they were $6.25! The “entrĂ©e” came in the smallest rice takeout container you’ve ever seen, along with the same size container of rice and an eggroll. Sure if it were quality maybe you could charge, but the food just was not good and all ended up in the trash. The pepper steak was fine, that was it. We also got a “dinner sized” chicken and broccoli and it smelled and tasted horribly of fish and was inedible. We got a “dinner sized” lemon chicken, and it’s supposed to be a large piece of breaded chicken and it was like it was made in advance (at least a week ago) and then MICROWAVED, which obviously you can microwave a tempura battered piece of chicken, it was too tough to even chew! (It didn’t taste like fish, it just tasted like ROTTEN chicken.) This place is a total rip-off, normally I would just chalk it up to experience and not go back, but I felt compelled to warn your readers about our miserable lunch. We’re having to send someone out again to go buy lunch from somewhere else. Anyone in Fruitland do yourself a favor and go to Hunan Palace instead, where the food is truly fresh and delicious. (they aren’t exactly the cheapest place, but I’ve never ever had a bad meal there).

GOVERNOR MARTIN O’MALLEY RELEASES RESULTS OF FIRST-EVER STATEWIDE TEACHER SURVEY

Survey indicates direct link between working conditions and student achievement

ANNAPOLIS, MD
– Governor Martin O’Malley, joined by state and local education officials, principals and teachers, today unveiled the results of the first ever statewide survey of Maryland educators, an initiative titled “TELL Maryland.” The survey, championed by Governor O’Malley, serves as a unique opportunity to gather information about school conditions, teacher satisfaction, and opportunities for improvement in the teaching and learning environments throughout the State. More than 43,000 educators took advantage of the survey, providing school-level data on more than 1,000 schools throughout Maryland.

“We know the recruitment and retention of quality, dedicated teachers has a direct impact on student achievement,” said Governor O’Malley. “This data has the potential for both dramatic and subtle improvements in teaching and learning environments throughout Maryland, each with its own unique impact on student achievement. We honor our educators by listening to them, by including them in the process, and by engaging them so that we may continue to build upon our progress as the number one public school system in America.”

The “TELL Maryland” survey stands for Teaching, Empowering, Leading and Learning. The survey was a month-long initiative in March 2009, available to all licensed educators in Maryland public schools, including pre-K–12 classroom teachers, vocational-technical educators, and special area teachers. All certified personnel were included in the confidential survey, including guidance counselors, speech and language therapists, occupational therapists, physical therapists, and special education team leaders. School-based administrators including principals and assistant principals were also included in the surveyed audience, with questions relating specifically to qualities such as working conditions, teacher and principal support, school leadership, community support, and professional development.

Data from the survey, including school-level results, are available at tellmaryland.org.

Preliminary results were shared with schools in May of last year, and teachers and principals have already begun implementing many of the actions indicated as needed by the survey results.

“While test scores and other achievement data, state and national awards, etc. help to paint one picture of your school, the perception data helps to provide another perspective,” said Tom Evans, Principal of Eastern School of Technology in Baltimore County. “I would encourage principals to use the TELL Maryland data to begin conversations and to dig a little deeper into how to make your school even better.”

Highlights from the survey results include:

Educators are generally positive about teaching in Maryland. Three-quarters of survey respondents agree that their school is a good place to work and learn, and four-fifths of teachers indicate they want to remain teaching in their current position. Nine out of 10 educators believe the faculty is committed to helping every student learn. Educators were positive about community engagement, facilities and resources and many aspects of professional development.

Teacher engagement in decision making was consistently a significant influence on school level student performance. Teacher engagement in decision making exerted roughly the same influence on performance on secondary mathematics as the percentage of teachers working within their licensure area. About six out of 10 Maryland educators agree that teachers are integrally involved in decision making and that effective processes exist for making group decisions. However, many educators do not feel empowered in certain areas. For example, educators report that teachers play a small role, or no role at all, in selecting his or her school’s new teachers (79 percent), or in deciding how the school budget will be spent (71 percent). Levels of community engagement and perceptions of Student Conduct/Safety were also significant in explaining performance at the elementary school level.

School leadership was the most important condition affecting teachers’ willingness to remain teaching at their school. Teachers who indicated that they plan to remain teaching in their school were twice as likely to agree they work in trusting and supportive environments. Leadership, decision making, professional development and student conduct were significant in explaining teachers’ future employment plans at the elementary level. At the middle school level, student conduct and community engagement were the most significant factors contributing to employment plans. While no single teaching condition was significant at the high school level, teaching condition variables in total explained 20 percent of differences in expected teacher retention rates across Maryland high schools.

Principals are positive about most aspects of the support they receive from districts. Most principals in the state are positive about the resources they have available, their engagement in district-level decision making and their professional development. Principals who report more positive leadership conditions are better able to provide teaching and leading conditions for their faculty in key areas. One area where concerns were noted by Maryland principals was in the area of time. Only half of principals agree that they have sufficient time to provide instructional leadership to their faculty.

The purpose of the survey is to support sound educational policies and practices based on the views of teachers, principals, and other certified educators in Maryland’s public schools. The TELL Maryland survey is supported by a coalition of education organizations, and was administered by the New Teacher Center at the University of California at Santa Cruz, a national organization dedicated to supporting the development of a high-quality teaching force.

Over the past 3 years, Governor O'Malley has provided $21.7 billion for K-12 education, including a record $5.7 billion proposed investment for FY11. This is an increase of $6.3 billion, or 41% more than was provided over the previous four years. And for the first time ever, Maryland will have invested more than $1.2 billion in school construction funding over four years, including $250 million proposed for FY 2011. In early January, Education Week Magazine reaffirmed its ranking of Maryland’s public schools number one in the nation. And the College Board ranked Maryland’s high schools number one in the national for Advanced Placement participation and achievement for the second year in a row.

TROOPERS ARREST 3 ON CDS CHARGES

On March 4, 2010 at 5:24 pm, A Trooper from the Salisbury Barrack of the Maryland State Police stopped a vehicle for a traffic violation on Mt. Herman Road near Powellville Road. After contacting the occupants of the vehicle, a K-9 scan was conducted on the vehicle showing a positive alert to CDS. While searching the vehicle, the Trooper noticed a fast food bag in the passenger compartment of the vehicle with food inside of it. A search of the bag revealed an amount of crack cocaine hidden inside of a double cheeseburger. All three occupants of the vehicle were arrested and charged with possession of cocaine and drug paraphernalia. Troopers arrested Teresa Charlene Donaway, 47, of Pittsville, Robert James Eubanks, 39, of Berlin, and Davis Ray Manuel, 41, of Pittsville. All three subjects were transported to WCDC where they are awaiting a hearing with a commissioner.

The chef at a family-run restaurant had broken her leg and came into our insurance office to file a disability claim. As I scanned the claim form, I did a double take. Under "Reason unable to work," she wrote: "Can't stand to cook."

I saw some strange goings on in the city today. A group of sterile monks in white robes were circling a large urn containing flowers, chanting, raising their hands, bowing to the urn, and performing some kind of ritual on one young member of the group. It appeared to be a vase sect to me.

Two daughters had been given parts in a Christmas pageant at their Church. At dinner that night, they got into an argument as to who had the most important role.
