RACE-BASED CLAIMS THAT LED TO DESTRUCTION OF PAULA DEEN’S REPUTATION, CAREER THROWN OUT BY JUDGE

A federal judge Monday threw out race discrimination claims by a former Savannah restaurant manager whose lawsuit against Paula Deen has already cost the celebrity cook a valuable chunk of her culinary empire.

Lisa Jackson sued Deen and her brother, Bubba Hiers, last year saying she suffered from sexual harassment and racially offensive talk and employment practices that were unfair to black workers during her five years as a manager of Uncle Bubba’s Seafood and Oyster House. Deen is co-owner of the restaurant, which is primarily run by her brother.

But claims of race discrimination by Jackson, who is white, were gutted in the 20-page opinion by U.S. District Court Judge William T. Moore Jr. The judge agreed with lawyers for Deen and Hiers that Jackson has no standing to sue her former employers for what she claims was poor treatment of black workers, regardless of her claims that she was offended and placed under additional stress.

JUDGE RULES BLOOMBERG'S STOP & FRISK UNCONSTITUTIONAL

Associated Press: The New York Police Department deliberately violated the civil rights of tens of thousands of New Yorkers with its contentious stop-and-frisk policy, and an independent monitor is needed to oversee major changes, a federal judge ruled Monday in a stinging rebuke for what the mayor and police commissioner have defended as a life-saving, crime-fighting tool.

U.S. District Court Judge Shira Scheindlin said she was not putting an end to the policy, but rather was reforming it. She did not give many specifics on how that would work but instead named an independent monitor who would develop reforms to policies, training, supervision, monitoring and discipline. She also ordered that officers test out body-worn cameras in the police precinct where most stops occurred.

"The city's highest officials have turned a blind eye to the evidence that officers are conducting stops in a racially discriminatory manner," she wrote. "In their zeal to defend a policy that they believe to be effective, they have willfully ignored overwhelming proof that the policy of targeting `the right people' is racially discriminatory."

MULTICULTURALISM JAMMED DOWN OUR THROATS

Americans have prided themselves on America´s being a melting for so long that few notice that it isn´t. Cultures that could melt did, and those that couldn´t haven´t.

We tend to regard categories such as African-American, European-American, and Mexican-American as political, when in fact they designate unassimilated and perhaps unassimilable cultural entities. The differences are stark. The United States indeed is multicultural.

Go to a purely European-American community in, say, Idaho or Iowa. You will find clearly defined attitudes toward obedience to the law, the raising of children, toward schooling and acceptable behavior in school, toward democracy, self-reliance, constitutionality, civility, toward law and its enforcement. These qualities are not associated by accident. They closely resemble those found in Denmark and Finland. This is hardly surprising, since European-Americans came from Europe.

Mark Levin: Amend Constitution to Put Tax Day and Election Day Back to Back

In his new book—The Liberty Amendments: Restoring the American Republic—nationally syndicated radio host Mark Levin, who served as chief of staff in the Reagan Justice Department, argues that the Constitution should be amended to put tax day and election day back to back.

“I would move tax day to the day before election day,” Levin said in an interview on CNSNews.com’s Online With Terry Jeffrey.

“I think this is very important, because if you’ll notice, election day and tax day are about as far apart as they can get, like seven months apart,” said Levin. “So we’re voting on the promises of politicians rather than the reality of what these politicians have done.”

Issa Expands IRS Investigation

Washington (CNN) -- House Oversight Committee Chairman Darrell Issa demanded Wednesday that the Federal Election Commission turn over records of more than five years of communications with the Internal Revenue Service -- a move that significantly expands the California Republican's ongoing probe of alleged federal targeting of conservative groups.

In a letter to FEC Chairman Ellen Weintraub -- a Democrat -- Issa cited CNN reporting on Monday that raises "the prospect of inappropriate coordination between the IRS and the FEC about tax-exempt entities."

Among other things, Issa asked for records of all communications between the IRS and the FEC dating back to the start of 2008. He also requested records of any FEC discussions relating to tax-exempt applications or organizations since 2008.

The letter was co-signed by Ohio GOP Rep. Jim Jordan, a prominent member of Issa's panel.

Obama Appoints Fox To Investigate Spying In The Henhouse

When Obama announced last Friday that he’d reform NSA spying, we showed that it wasn’t wise to trust him.

Friday, Obama promised an independent group or experts would investigate spying:
We’re forming a high-level group of outside experts to review our entire intelligence and communications technologies. We need new thinking for a new era. We now have to unravel terrorist plots by finding a needle in the haystack of global telecommunications. And meanwhile, technology has given governments — including our own — unprecedented capability to monitor communications.

So I am tasking this independent group to step back and review our capabilities — particularly our surveillance technologies. And they’ll consider how we can maintain the trust of the people, how we can make sure that there absolutely is no abuse in terms of how these surveillance technologies are used, ask how surveillance impacts our foreign policy — particularly in an age when more and more information is becoming public. And they will provide an interim report in 60 days and a final report by the end of this year, so that we can move forward with a better understanding of how these programs impact our security, our privacy, and our foreign policy.

Attorney General Eric Holder’s announcement of significant changes in the Justice Department’s pursuit of mandatory minimum sentences highlights a new willingness on the part of the Obama administration to engage on issue of race.

It’s the second public policy area touching on race where Holder — the nation’s first African American attorney general — has flexed his muscles in recent weeks.

Just last month, he said Justice would challenge voter ID laws adopted in the aftermath of the Supreme Court's decision to gut a key provision of the Voting Rights Act.

Ron Paul: "Why Are We At War With Yemen?"

Most Americans are probably unaware that over the past two weeks the United States has launched at least eight drone attacks in Yemen, in which dozens have been killed. It is the largest U.S. escalation of attacks on Yemen in more than a decade. The U.S. claims that everyone killed was a “suspected militant,” but Yemeni citizens have for a long time been outraged over the number of civilians killed in such strikes. The media has reported that of all those killed in these recent U.S. strikes, only one of the dead was on the terrorist “most wanted” list.

This significant escalation of U.S. attacks on Yemen coincides with Yemeni President Hadi’s meeting with President Obama in Washington earlier this month. Hadi was installed into power with the help of the US government after a 2011 coup against its long-time ruler, President Saleh. It is in his interest to have the U.S. behind him, as his popularity is very low in Yemen and he faces the constant threat of another coup.

Gansler Said Rival Brown Relying On Race In Maryland Governor’s Contest

Maryland Attorney General Douglas F. Gansler told a group of campaign volunteers last month that Lt. Gov. Anthony G. Brown, his chief Democratic rival for governor, has a thin record of accomplishment and is trying to rely on his race to get elected next year.

“I mean, right now his campaign slogan is, ‘Vote for me, I want to be the first African American governor of Maryland,’ ” Gansler (D) told the group. “That’s a laudable goal, but you need a second sentence: ‘Because here’s what I’ve done, and here’s why I’ve done it.’ ”

An audio recording of the July 15 meeting — in which Gansler also spoke candidly about his campaign strategy — was provided to The Washington Post by someone not employed by either campaign. Gansler’s campaign did not dispute its authenticity but accused the Brown campaign of illegally recording Gansler’s remarks — which Brown’s aides denied.

Dangerous Conditions Spawned 41-Vehicle Wreck On I-81, Police Say

LEXINGTON A two-car accident on Interstate 81 combined with blinding rain and speed as factors in a pileup of 41 cars, trucks and other vehicles that injured 10 people Sunday, police said.

Some tractor-trailer trucks from the pileup in Rockbridge County near Lexington remained overturned by the roadside Monday along with a crumpled camper, said Virginia State Police Sgt. A.D. Nicely.
Nicely said witnesses and victims indicated a two-car accident preceded the pileup. One car came to rest in the median, partially blocking one lane while the other vehicle partly blocked another lane, both in the same direction, police said.

House At Risk In 2014 Unless GOP Offers Agenda

When asked about their prospects for 2014, most Republicans will say that whatever happens with the Senate, the GOP is a virtual lock to keep control of the House. The House majority is the GOP's single hold on power in Washington, and the only way the party has been able to shape national policy during Barack Obama's presidency.

Republicans haven't worried about losing the House because, first, having won by a landslide in 2010, they got to control the redistricting process, and they have used that power to draw districts that give them an advantage. Second, Barack Obama, having won re-election, is not particularly popular, and his ratings could slip further by November 2014. And third, history teaches that the presidential party just doesn't gain seats in the mid-terms of a president's second term. So, the thinking goes, Obama's Democrats can't win. The House will stay Republican.

Forget Apology: Eric Holder Owes The American People A Resignation

Bloomberg's Jon Weil, who has compiled the following stunning array of lies regarding the DOJ's enforcement activity disclosed by none other than its head, Eric Holder, is far too kind when he says that the "fast and furious" Holder owes the American people an apology. What we really owes is at least a resignation (and frankly much more, but it is too early on Monday to become too politically incorrect). And considering that the DOJ in its nowformer employee Lanny Brauer's words refused to prosecute those banks which were deemed "too big to prosecute", the lying here has now became a meta phenomenon, as the DOJ is effectively caught lying about lying. How many more meta levels of higher up fraud "inception" can Holder take this, before the American people finally demand his head, metaphorically-speaking of course? Sadly, judging by the response to unprecedented scandals coming out of this administration so far, the answer is... more.

Sandy-Damaged Cars Could Flood Region

WASHINGTON - It's been nine months since Superstorm Sandy raised havoc along the East Coast, and now a new threat has been born -- cars damaged by the storm are showing up for sale without proper warning.

The National Insurance Crime Bureau says an estimated 250,000 cars were damaged by the storm. In many cases, they may have been damaged in dealership parking lots, have low mileage and look good.

There some things you can do to protect yourself from getting ripped off by buying one of these cars.

Poll: Most Americans Think Implementation Of Obamacare A 'Joke'

A majority of Americans not only think the implementation of Obamcare is a "joke," but believe Obamacare will lead to socialized medicine and lower the quality of their healthcare while increasing costs, taxes, and adding to the federal deficit.

According to a new Fox News poll, 57% of Americans feel Obamacare's implementation is "a joke" compared to 31% who think "it's going fine." The poll also found that 63% of voters "think the 2010 health care law needs to be changed and Congress should keep at it," which is up "from 58 percent who felt that way in July 2012. " Only 31% say the law should stay as it is and Congress should "move on" to other issues.

In addition, "65 percent of independents think Congress should keep working on the law, up from 53 percent last year." The poll found even "41 percent of Democrats now feel the law needs more work, up from 35 percent."

Schumer: Nations Should Wave Rainbow Flags For Gay Rights At Russia Olympics

Sen. Charles Schumer (D-N.Y.) on Monday said he opposed boycotting the Sochi Olympic Games despite new Russian anti-gay laws, instead urging nations to wave rainbow flags during the opening ceremonies to show support for gay rights.

“That'd be pretty embarrassing for [Russian President Vladimir] Putin,” Schumer said on MSNBC's “Morning Joe.” “Let our athletes participate but still make a stand.”

In June, Putin signed a law banning gay “propaganda” and imposing fines on those holding gay pride rallies. The law has generated an international backlash ahead of the 2014 Winter Games in Sochi, Russia.

Obama’s Lexicological War

Jen Psaki, blameless State Department spokeswoman, explained that the hasty evacuation of our embassy in Yemen was not an evacuation but “a reduction in staff.” This proved a problem because the Yemeni government had already announced (and denounced) the “evacuation” — the word normal folks use for the panicky ordering of people onto planes headed out of country.

Thus continues the administration’s penchant for wordplay, the bending of language to fit a political need. In Janet Napolitano’s famous formulation, terror attacks are now “man-caused disasters.” And the “Global War on Terror” is no more. It’s now an “overseas contingency operation.”

Nidal Hasan proudly tells a military court that he, a soldier of Allah, killed 13 American soldiers in the name of jihad. But the massacre remains officially classified as an act not of terrorism but of “workplace violence.”

The Inappropriate ‘Inappropriate’

Some conservatives believe that it was reverence for the Constitution that constrained the growth of government in the early days of the republic, while the economist Arnold Kling has argued that the frontier — an escape hatch for the energetic and imaginative — kept the state from getting out of hand. My own theory is that political ambition was leashed because Americans in the late 18th century lacked the word “inappropriate,” the earliest usage of which is attested, as the etymologists say, in 1804. How politics was practiced at all without the word “inappropriate” is difficult to imagine from the vantage point of anno Domini 2013. It is the irreplaceable word, five mustelid syllables without which the conduct of modern government would be all but impossible.

Bill Clinton was of course the master of the inappropriate. During the lead-up to his confessing to crossing the line with a strapping young fellatrix from the intern pool, President Clinton threw the word “inappropriate” around a good deal. Asked by National Public Radio whether he had talked to Monica Lewinsky about her testimony, Clinton did not deny that he had — instead, he said only that it would be “inappropriate” for him to revisit his earlier statements about the case.

Researchers believe that raw garlic's benefits are connected to a chemical called allicin, which is released once raw garlic is smashed or diced. This chemical is believed to not only reduce inflammation, but also reduce damage from free radicals to the body's cells.

The Government Is About To Put JP Morgan Through The Ringer Like You've Never Seen Before

Around May, reports surfaced that Washington was growing tired of JP Morgan.

CNN's Dr. Sanjay Gupta: I Was Wrong About Marijuana

NEW YORK (AP) — CNN's Dr. Sanjay Gupta says he spoke too soon in opposing the medical use of marijuana in the past and that he now believes the drug can have very real benefits for people with specific health problems.

Gupta, the network's chief medical correspondent and a brain surgeon, detailed his change of heart in an interview Friday and in an article for CNN's website titled, "Why I changed my mind on weed." He will narrate a documentary on the topic that will air on the network Sunday.

He wrote in Time magazine in 2009 about his opposition to laws that would make the drug available for medical purposes. "Smoking the stuff is not going to do your health any good," he wrote then. But Gupta said Friday he too easily associated marijuana with "malingerers that just wanted to get high."

Now he wants to say he's sorry.

Ben Carson: Congress Must "Surgically Excise" Obamacare

Renowned neurosurgeon Dr. Ben Carson says Congress must "use the purse strings" it controls to kill Obamacare, surgically excising it from the rest of the federal budget.

"Congress has a lot of power. They have powers to propose laws, to make laws. They have the ability to decouple the healthcare bill from the rest of the budget. They can do that," Carson told "The Steve Malzberg Show" Friday on Newsmax TV.

Poll: 1/3 Of Iraq And Afghanistan Veterans Have Contemplated Suicide

A new survey shows that even as America looks to transition to peacetime, the veterans of the last 12 years of war are hardly out of the woods.

The 2013 annual survey by Iraq and Afghanistan Veterans of America revealed that nearly 1/3 of those who have served in Iraq and Afghanistan have contemplated taking their own lives.

While mental health and post traumatic stress disorder remain a huge issue for American veterans, the government agency charged with their care, the U.S. Department of Veterans Affairs, has faced incredible criticism for a perceived inability to respond to disability claims in a timely or efficient manner.

DISABLED VET SAYS MOCKING COP KICKED HIM OFF A NEW JERSEY BOARDWALK BECAUSE OF HIS SERVICE DOG

Jared Goering, a veteran who served in the U.S. Army for nearly two decades, says he was mocked and asked to get off a New Jersey boardwalk by a police officer — all because he had a service dog.

Goering, according to WMGM-TV, suffers from post-traumatic stress disorder and has some physical hardships after serving two tours in Afghanistan and one in Iraq. He is aided by a trained, certified dog.

Cruz Again Raps Obama's Health Care Law

Sen. Ted Cruz on Saturday continued his call for cutting off funding for President Barack Obama's health care law and told conservative Christians that congressional lawmakers can't be counted on to do it.

The Texas Republican, a tea-party favorite and a possible presidential candidate in 2016, drew a standing ovation at the Family Leadership Summit with his denouncement of the health care initiative labeled "Obamacare" by its critics.

"That reaction right there shows how we win this fight," Cruz said. "If I was sitting in the Senate cloakroom, the reaction would be fundamentally different. If we have to depend on Washington, it will never be done."

As he has in remarks to other conservatives, Cruz asserted that a grassroots effort would be needed. "The only way we win this fight is if the American people rise up and hold our elected officials accountable," he said.

Plea Deal Reached in Multistate Hepatitis C Outbreak

A traveling hospital technician accused of infecting dozens of patients with hepatitis C through tainted needles told investigators he had been stealing drugs for more than a decade and was "killing a lot of people," according to a plea agreement filed Monday that would send him to prison for 30 to 40 years.

David Kwiatkowski, who has been jailed since his arrest in July 2012, is accused of stealing painkiller syringes from Exeter Hospital's cardiac catheterization lab and replacing them with saline tainted with his blood. He has agreed to plead guilty to the 14 federal drug theft and tampering charges he faced in exchange for a lighter sentence. Had he been convicted at trial, he could have been sentenced to up to 98 years behind bars.

Thirty-two patients in New Hampshire have been diagnosed with the strain of hepatitis C carried by Kwiatkowski, who worked at 18 hospitals in seven states before being hired in New Hampshire in 2011. There have been seven cases in Maryland, six in Kansas and one in Pennsylvania. One of the Kansas patients has died, and hepatitis C, a blood-borne viral infection that can cause liver disease and chronic health issues, played a "contributing role," the plea agreement said.

GlaxoSmithKline Admits Execs Breached Chinese Law

British drug giant, GlaxoSmithKline admitted that some of its executives in China appear to have violated Chinese law in a bribery and corruption scandal which has hit the firm.
GSK is being investigated by Chinese police for alleged corruption, price fixing.

"Certain senior executives of GSK China who know our systems well, appear to have acted outside of our processes and controls which breaches Chinese law," Abbas Hussain, GSK's international president said in a statement.

Woman Cut By Knife, Robbed At Oceanfront, Police Say

A man on a bicycle robbed a woman at knife point and cut her face at the Oceanfront on Sunday night, police said.

The woman was walking to her car near 24th Street and Pacific Avenue after work around 8:45 p.m. when a man pedaled up behind her. He put a knife to her neck and demanded money from her, said Grazia Moyers, police spokeswoman.

Resume:
Smyrna - Troopers are investigating a crash that claimed the life of a 7-year-old on Route 1 last night, approximately one mile north of Smyrna.

The incident occurred at 10:00 p.m. as several northbound vehicles slowed while approaching traffic south of a lane closure due to construction. A 2004 International truck traveling north in the right lane failed to properly slow, and struck the rear of a 2013 Mazda 3, sending that vehicle off of the east side of the roadway, where it came to rest in the grass.

After striking the Mazda, the truck continued north and immediately struck four other vehicles before stopping.

The driver of the Mazda, Eileen Kosc, 42, of Wilmington, was transported to Christiana Hospital with non-life-threatening injuries. A passenger, Bryan Kosc, 7, was transported to Christiana Hospital where he was pronounced dead. A second passenger, Brandon Kosc, 12, was transported to Alfred I. duPont Hospital with non-life-threatening injuries.

The driver of the International truck, Bryan Hughes, 28, of Greenwood, was not injured. All of the drivers of the four other vehicles he struck were transported to Christiana Hospital with non-life-threatening injuries. They were Anthony Tuskweth, 32, of Wilmington, who was driving a 2006 Dodge Sprinter; Syreeta Brock, 34, of Wilmington, who was driving a 2006 Infiniti G35; Susan Gervais, 45, of Chesapeake City, MD, who was driving a 2005 Volkswagen Jetta; and Monet Dowers, 24, of Trenton, NJ, who was driving a 2003 Saturn Ion.

All drivers and passengers were properly restrained during the crash.

The Collision Reconstruction Unit is continuing its investigation into this crash. Alcohol does not appear to be a contributing factor. No charges have been filed.

For those of us with pets, often they are members of the family. Their care and health are important to us and when something goes wrong it can be devastating. If you care about your canine pet, this is a must read.

Quite recently, my dog became very ill on more than one occasion. After the second time, I began researching the food because that was the only thing he had eaten.

Beneful dog food is a popular brand. Unfortunately over the last two to three months, pet owners have seen their dogs become ill after eating this food, based on reports on the Consumer Affairs website. Some pets are more sensitive than others, and their symptoms can include any of the following, sometimes more than one:

Dover- Delaware State Police Homicide Detectives have charged Matthew N. Burton-29 of Dagsboro, Delaware in connection with the murder of Nicole Bennett who was found dead in Worcester County, Maryland in June 2012.
Burton was previously charged by the Maryland State Police in July 2012 with first and second degree murder charges in connection with the Nicole Bennett homicide and has been held on those charges while the investigation by the Maryland State Police and Delaware State Police continued.
During the thorough and comprehensive investigation, evidence was discovered indicating that the crimes were committed in Delaware. Burton is currently incarcerated in Maryland on a Fugitive Warrant from Delaware, pending extradition. He will be formally charged with the above crimes upon his return. Maryland has since dropped their charges.
The following outlines the preliminary investigation conducted by the Maryland State Police and the Delaware State Police and sequence of events.
Nicole Bennett-35 of Millsboro, Delaware, was found deceased on the morning of June 15, 2012, in an embankment off of Swamp Road in Worcester County.  An autopsy conducted at the Office of the Chief Medical Examiner in Baltimore determined Bennett was murdered and had been asphyxiated.  Autopsy evidence also indicated she was already dead when her body was left in the embankment off of the dirt road.   
Shortly before 9:00 a.m. on June 15, 2012, Worcester Central received a 9-1-1 call reporting the body of the deceased victim in an embankment off of Swamp Road, a dirt road east of Nelson Road. The caller told police he was in the area walking when he noticed the woman’s body.
During the course of the initial investigation, Maryland State Police learned Bennett was the subject of a missing person’s case being investigated by the Delaware State Police.  One hour before she was found, Bennett’s husband had called 9-1-1 reporting her missing.  She had not returned home from the Bay Shore Community Church in Gumboro, Delaware, where she was reportedly working late on the evening of June 14, 2012.
Delaware State Police responded to the church and found Bennett’s vehicle parked in the lot. It was locked with her personal belongings inside.  Troopers learned Bennett had been alone inside the church with a custodian, identified as Burton.  Burton was subsequently located and interviewed by investigators. 
Delaware State Police Homicide Detectives executed search warrants and processed the homes and vehicles of both Bennett and Burton.  Several interviews were conducted with numerous family members, friends, co-workers and acquaintances.  Investigators sought video surveillance footage from area businesses and from the church which is located approximately six miles from where Bennett was found.
Investigators with the Worcester County Bureau of Investigation, deputies from the Worcester County Sheriff’s Office, Delaware State Police and the Maryland State Police Homicide Unit responded to the scene.  Crime scene technicians from the Maryland State Police Forensic Sciences Division and crime scene technicians from the Delaware State Police responded to gather and analyze evidence.  The Worcester County State’s Attorney’s Office, the Wicomico County Bureau of Investigation, and the Worcester County Bureau of Investigation also assisted with the investigation.   
DNA evidence gathered by crime scene technicians from the Maryland State Police Forensic Sciences Division connected Burton to the crime.  After consultation with the WorcesterCounty State’s Attorney, an arrest warrant was obtained.
On July 6, 2012 at approximately 7:15 p.m. the U.S. Marshal’s Task Force, a warrant apprehension team, located Burton driving on SR 1 near Rehoboth Beach, Delaware.Burton was apprehended on a subsequent traffic stop and taken into police custody.
