Supreme Court Justices Conflicted On Same-Sex Marriage Case

A cautious and conflicted Supreme Court on Tuesday seemed wary of a broad constitutional finding on whether same-sex couples have the right to marry, and some justices indicated that it may be premature for them to intervene in a fast-moving, unsettled political environment.

Justice Anthony M. Kennedy, considered to be the pivotal vote on the issue, said the court was in “uncharted waters.” He questioned whether it should have even accepted the case, in which lower courts struck down California’s voter-approved Proposition 8, which restricted marriage to heterosexual couples.

The court’s historic review of same-sex marriage continues Wednesday with a more limited question: May Congress withhold federal benefits from same-sex couples married in those states where it is legal? Lower courts have said that the Defense of Marriage Act of 1996 is unconstitutional because it treats legally married homosexual couples differently from heterosexual ones.

  2. If gay marriage is approved, what is next? Do we allow 4,5,6 year old girls to marry men in their 30's and 40's like Islamic countries? Do we allow Grown men to marry young boys? Do we allow humans to marry goats, sheep or cows? This isn't about gay rights, it is about destroying any morality or decency in our society. next Pedophilia will be normalised-just wait and see.

  3. So if I'm a gay male does that mean I can use the public ladies bathroom. And, if my birth certificate says I'm a female and I get a sex change, then, can I use either bathroom? So I was born a male and had my testicles shot off in Vet Nam while serving my Country, can I use either bathroom? Get real people!

  5. The fast moving political environment has nothing to do with it. The Supreme Court is about upholding laws. It should have nothing to do with the political climate. Since Obama, we can't even expect the Supreme Court to stand up for American values.
