BREAKING NEWS: Charges dropped against teen accused of raping Rockville girl

ROCKVILLE, Md. —Prosecutors dropped rape and offense charges against one of the teens accused of attacking a 14-year-old girl at Rockville High School in a case that garnered international attention due to the suspects immigration status.

The charges were dropped against Jose Montano, 17, who now faces two counts of possession of child pornography and two counts of distribution of child pornography. Henry Sanchez, 18, was the other student charged in the case.

Attorney Maria Mena said she is happy the state "did the right thing" and dropped the charges, but she is angry over the new ones.

  6. charges dropped for lack of evidence of force. do you people really want an innocent man charged with rape?

  7. The element of force is not required for second-degree sexual offense only that it was non-consensual

She was 14, below the age of consent. Offenders are two-three years older. Statutory rape. Period.

  9. Proof MD is a sanctuary State. Very sickening. Still need to be deported. Miller got his way to get reelected.

  10. The 14 year old girl sent naked pictures to the 17 year old? She willingly went along with this. The boys played with fire and now they will pay.

I was thinking the same thing. I still don't understand how children can roam the halls of schools or hide in bathrooms. If we were in the halls during class we had to have a reason and a hall pass and they checked the bathrooms. Of course that was years ago, but it worked!

The "man" is not innocent. She is a child.

  13. Sure looks like another case of dropping charges to save an illegal from being deported. Dropping charges in some attempt to hurt Trump.

Obviously these men have no sympathy for a rape victim. I so doubt the 17 year old is really only 17 btw. Most of these illegals lie about their age.

  14. Somehow I knew this would happen. The liberals in Maryland are pathetic! Shame on them for not protecting our children. The born and unborn!

  15. Has nothing to do with being liberals or not. They didn't have a case, period! Just because you want to see a latino in jail, doesn't make this a case of rape. For one, in Maryland, at 14 years of age, a person can legally have sex with someone less than 4 years older without the act being statutory. Now, if he would have been 18 there might be an issue. It was the text messages collected in the investigation that ended the rape case. The 14-year-old had texted one of the boy's, in reference to different sex acts that she liked, and brought to light she previously had consensual sex with at least one of the boys. This girl was NOT innocent in this. So this case is being dropped because there was no rape, that's not the DA's fault, not liberals fault, not Obama's fault.
