SALT LAKE CITY (AP) — A Utah police officer’s body camera video shows a hospital nurse being handcuffed after refusing to draw blood on an unconscious patient.
The video taken at University Hospital in Salt Lake City shows nurse Alex Wubbels calmly explaining to Salt Lake detective Jeff Payne that she couldn’t draw blood on a patient who had been injured in a car accident. She told the officer a patient was required to give consent for a blood sample or be under arrest. Otherwise, she said police needed a warrant.
The dispute ended with Payne telling the nurse she was under arrest and physically moving her out of the hospital while she screamed.

DeleteShe would have violated the unconscious mans rights. The cop clearly wasn't going anywhere and neither was the unconscious man. He should have waited and then taken the blood. The cop clearly wanted to show he was in charge and in this case he clearly wasn't and just overstepped his authority. He works for the people not the other way around and they should start realizing it!!

This nurse deserves an apology from the detective. Who does he think he is? He is the kind of person that give police a bad name. You can even see the other two police officers are uncomfortable with what is going on as they offer no assistance to his tantrum. She was following the rules and he was asking her to break them.

ReplyDeleteSupreme court in 2016 says differently as he was not under arrest, was unconscious and cop had no warrant. He actualy was the VICTIM of a head on collision with a drunk driver (who died in the accident) hence the lack of warrant and arrest.. This copmwas just angry they were notndoing what he wanted them to do even though it was unconstitutional and illegal.

DeleteThe hospital wasn't ordering the blood test. They do that for medical reasons for treatment. NOT for handing over to the police. The police had no warrant, and from the video knew they would not get one as they did not have probably cause to get a warrant. The person who was unconscious was the victim. He was driving for his job when he was struck by a (alleged) criminal who was being chased by the police in a high-speed pursuit.

The cop should loose his job and pay dearly for that.

Citizens are to obey a "lawful order" of a police officer not all orders given by a police officer are lawful or fall under the authority of the law. I am a 26-year police veteran, and what that officer did was wrong on so many levels. I hope she owns that department and his pension.

ReplyDeleteSo the hospital doesn't take blood from a person who unconscious from severe head trauma? DA orders a subpoena for medical records that is signed by a Judge. Has NOTHING to do with a search warrant. In the video or article does it mention the victim or his connection with the case? Do you know why the criminal was fleeing in total disregard for public safety? Do you have a copy of the internal investigation or all facts involving a major case? So maybe just maybe just maybe their is more to it. I think you should be fired from your job for passing judgment out of hate. You obviously bully your coworkers.

The Salt Lake Tribune reports Wubbels was not charged. Police have started an internal investigation, but Payne remains on duty.
I would suggest you read the article(s).
The Salt Lake Tribune reports that the patient was a reserve police officer from Idaho who was working his other job as a semi-truck driver when a car fleeing the Utah Highway Patrol crashed into him. The newspaper cites police reports saying Payne was trying to take the blood to clear him of any wrongdoing in the wreck.

A 2016 U.S. Supreme Court ruling affirmed that a blood sample cannot be taken without patient consent or a warrant.
Wubbels told Payne that a patient was required to give consent for a blood sample to determine intoxication or be under arrest.
Otherwise, she said police needed a warrant. Payne insisted
Police spokeswoman Christina Judd said the agency started an internal investigation within hours of the encounter on July 26 and that the assistant chief has apologized to University Hospital.
"We're alarmed by what we saw in the video and take it very, very seriously," Judd said.
She should sue the idiot cop that ruffed her up. He should know the law (I think he does) and know that he isn't allowed to do what he was attempting to do and assaulted her in the processed.
ReplyDeleteHe did a good job the nurse refused to except the paperwork provided and she Is related to the victim. She also has pending court dates but some how is still employed. Also the nurse doesn't do blood work dr orders it. She had her attorney on the phone not her boss or a doctor. How many nurses have attorneys on speed dial. I hope the cop sues her and the hospital for defamation

ReplyDeleteEven if she did draw blood she would have been fired from her job. Even if the tests proved what ever the police were looking for a good lawyer would have had the test thrown out. The cop did nothing but try to boost he own ego. In turn I hope they fire him without any pension and he is made to pay all court costs when she sues his butt.
I did notice he really didn't like it when who ever was on the phone told him NO and he was making a huge mistake.
