LAS VEGAS — Civil rights leader Jesse Jackson kept true to the name of the spin room in which he held court following Tuesday night’s debate, shooting down the notion that his party’s all-white presidential field was cause for concern and accusing the Republicans of being the true minorities because of their policy positions.
With five white candidates, Democrats are fielding their least racially diverse line-up since 1992. Republicans, on the other hand, have four minority candidates. Retired neurosurgeon Ben Carson is black. Florida Sen. Marco Rubio and Texas Sen. Ted Cruz are of Cuban descent. And Louisiana Gov. Bobby Jindal is Indian-American.
But that racial imbalance doesn’t bother the 74-year-old Jackson, who ran for president on the Democratic ticket in 1984 and 1988.
Asked by The Daily Caller if his party’s all-white field was of concern, Jackson said that it is not.

“Do you think if you ran again, could run again, and did run again, you would be elected?” asked Steve Kroft on “60 Minutes” Sunday night.
“Yes,” replied Obama.”You do?” said Kroft.”I do,” replied the president.
The questions followed on an exchange where Kroft asked Obama if he agreed with First Lady Michelle Obama, who said a few months ago at a fundraiser that she is very pleased he cannot run again.

Wisconsin gun shop ordered to pay nearly $6 million to injured police officers
MILWAUKEE – Jurors ordered a Wisconsin gun store to pay nearly $6 million on Tuesday to two Milwaukee police officers who were shot and seriously wounded by a gun purchased at the store.
The ruling came in a negligence lawsuit filed by the officers against Badger Guns, a shop in suburban Milwaukee that authorities have linked to hundreds of firearms found at crime scenes. The lawsuit alleges the shop ignored several warning signs that the gun used to shoot the officers was being sold to a "straw buyer," or someone who was buying the gun for someone who couldn't legally do so.
Jurors sided with the officers, ruling that the store was negligent in selling the gun.

The United States shouldn’t raise interest rates to avoid hurting developing nations dependent on the U.S. dollar, China’s finance minister said. Lou Jiwei said the dollar remained critical to the global economy.
“The United States isn’t at the point of raising interest rates yet, and under its global responsibilities, it can’t raise rates,” Lou said in an interview published in the China Business News Monday. He spoke during the annual meeting of the World Bank and International Monetary Fund in Lima, Peru.
Lou was optimistic about Beijing’s economic future, but warned officials need to manage China’s slowdown carefully. “The slowing of China’s economic growth is a healthy process, but it is a sensitive period. The Chinese government must make accurate adjustments, keeping the economy within a predictable space while continuing to promote internal structural reforms,” he said.
Asian markets rallied after the U.S. Federal Reserve moved to keep rates steady in September. “Any sign of stimulus is being seized by the markets as a sign of stabilization and there is some bargain hunting, especially in the beaten down sectors, related to commodities,” said Nicholas Yeo, head of equities (China/Hong Kong) at Aberdeen Asset Management.

Police: Daycare owner was attacked while protecting kids
HELENA, Mont. – A Montana daycare owner was punched and hit in the face with a shovel after refusing to hand three young siblings to their father, who was drunk and lacks legal custody, authorities said.
Martha McClure had surgery for her injuries Monday and is still struggling with double vision, according to her sister-in-law, Marlene Heath.
Lake County officials say McClure was caring for Francis Joseph Jackson's three children, all under the age of 4, when he showed up at her Ronan daycare center with an unidentified woman last week.
McClure knew Salish and Kootenai Tribal Child Protective Services had suspended Jackson's parental rights and he was not allowed to have contact with them.

Shortly after the lethal car attack which took place in central Jerusalem even as a bus was attacked in the capital's southeast, Arutz Sheva arrived on scene to hear eyewitness testimony from the terrorist attack.
One eyewitness, Meir, said, "I got on my bike with a friend a moment before it happened. I just told him about the terror attacks that happened yesterday and how frightening it is. We went up there, I told him it's scary to ride a bike, I'm afraid an Arab will come and run us over. I just happened to say that to him."
His comment came just a moment before Bezeq telephone company employee Alaa Abu Jamal rammed his company car into pedestrians before exiting with a knife drawn, murdering one victim identified as Rabbi Yeshiyahu Krishevsky and lightly wounding another.
"A minute later I hear a huge boom, we turned around and I told him let's get off (the bikes). We went back and right away I saw...wounded Jews covered in blood, and the terrorist was there, someone had a handgun and he fired off a shot (at the terrorist). He was still moving and there was a knife on the ground," said Meir, noting the terrorist had gotten out of his car.
"He got out of the car to stab, I don't know if he managed to stab or not. The army came right away, they gave him another ten bullets or so. A second earlier I had been there and I was saved by a miracle. It was scary."

Towson University investigates anti-Semitic postings
TOWSON, Md. —Towson University officials are trying to determine who wrote anti-Semitic slurs Sunday on a chalkboard in the middle of campus.
The board at Freedom Square included such phrases as "Hitler was right," "With Jews you lose" and "Fascism just do it." Photos of the slurs were also circulated on social media.
In a letter to a concerned parent, Towson Vice President of Student Affairs Deb Moriarty wrote that the university acted swiftly when it was made aware of the slurs.
Moriarty wrote that the Student Government Association immediately removed the messages and requested that university police investigate the matter and have a presence in that area.

Local Cops Want Ability to Draw Citizens’ Blood Year-round
Police in Central Texas are proposing a year-round “no refusal” policy, which would allow officers to draw blood from people merely suspected of driving under the influence.
The Austin Texas Police Department is in the process of seeking funding for the unconstitutional scheme, an initiative Chief Art Acevedo claims will reduce traffic fatalities and collisions.
During a “no refusal” traffic stop, police can forcibly extract blood or breath samples against a person’s will after that person refuses sobriety tests.

Pennsylvania Man Facing $770 in Fines after Burnout, Hit-and-Run Collision
OCEAN CITY, MD – (October 13, 2015): Ocean City police have charged a Pennsylvania man involved in an attempted burnout on Philadelphia Avenue that led to a hit-and-run collision.
On October 9, 2015, at approximately 6:23 p.m. Ocean City police responded to a hit-and-run vehicle collision that occurred in the area of 7th Street and Philadelphia Avenue. It was reported that a vehicle had attempted to do a burnout on Philadelphia Avenue but lost control of the vehicle and struck the railing in front of Pickles Pub at 704 Philadelphia Avenue at a low speed. On October 10, officers discovered a video of the incident on social media. Through investigation, officers were able to identify and make contact with the driver of the vehicle who received multiple traffic citations for the October 9 incident.
The driver of the vehicle, Greg S. Peters, 44, of Lebanon, PA, was charged with the following traffic offenses:
- Negligent driving
- Spinning wheels
- Driving vehicle on a sidewalk
- Failure of vehicle driver to stop after unattended property damage accident
- Failure of motor vehicle driver to furnish written identification information
- Failure of vehicle driver to stop after unattended property damage accident

The Ocean City Police Department is reminding residents and visitors of Ocean City that negligent and reckless driving behavior is extremely dangerous and could quickly result in tragedy. Much of this ammunition will end up in the hands of those that the Russians are attempting to bomb into oblivion, and so to Russia it appears that we are attempting to make their job much harder. And of course the truth is that there aren’t really any “moderate rebels” in Syria at all. Nearly all of the groups that are fighting are made up primarily of radical jihadists and/or hired mercenaries. Personally, I don’t see anyone over there that you could call “the good guys”. At the end of the day, the U.S. supports just about anyone that wants to get rid of the Assad regime, and the Russians are working very hard to keep Assad in power. Just like the civil war in Ukraine, the conflict in Syria is in great danger of being transformed into a proxy war between the United States and Russia, and many fear that these conflicts could eventually be setting the stage for World War III.
The ferocity of Russian airstrikes in Syria has surprised observers all over the planet, and over the past couple of days these airstrikes have been extended to include some new areas…

Marijuana, guns seized in Eastern Shore drug bust
STEVENSVILLE, Md. —Authorities on the Eastern Shore seized drugs and 17 guns, including an AK-47.
The Queen Anne's County Drug Task Force announced Tuesday that Vincent Michael Arcand, 33, and Samantha Carol Sittle, 32, both of Stevensville, were arrested on Oct. 6 on various drug charges.
Authorities executed a search-and-seizure warrant at a house in the 600 block of Old Love Point Road in Stevensville near Kent Island High School, where they said they found 22 suspected marijuana plants, 1,893 grams of processed marijuana, 11.3 grams of hashish and $3,591 in cash.

BALTIMORE (WJZ) — Baltimore’s Sports Legends Museum draws tens of thousands of visitors a year, but, no more. The museum is leaving its home at Camden Yards because of a lease dispute with the Maryland Stadium Authority.

The museum has been in lease negotiations since April, but all of that fell through last week.
It’s been in the shadow of Oriole Park for a decade, drawing tens of thousands of visitors a year. Now, the Sports Legends Museum at Camden Yards is closing its doors.
“Why? People pay millions of dollars to locate things like that close to major attractions like this park,” said Manuel Valles, sports fan.
A lease dispute with the Maryland Stadium Authority has the museum packing its things.
“At the 11th hour, they came back and offered us a one-year lease that really was a deal breaker because we wanted to be in the building longer than that,” said Mike Gibbons, Sports Legends Museum.
The 22,000 square foot museum houses one of the largest collections of state sports memorabilia in the country.

Operation Cross Country, a nationwide law enforcement action that took place last week and focused on underage victims of prostitution, has concluded with the recovery of 149 sexually exploited children and the arrests of more than 150 pimps and other individuals.
The FBI, in partnership with local, state, and federal law enforcement agencies and the National Center for Missing & Exploited Children (NCMEC), conducted the annual action—the ninth and largest such enforcement to date—as part of the Bureau’s Innocence Lost National Initiative.
“Our mission is to protect the American people—especially our children—from harm,” said FBI Director James Comey.” When kids are treated as a commodity in seedy hotels and on dark roadsides, we must rescue them from their nightmare and severely punish those responsible for that horror. We simply must continue to work with our partners to end the scourge of sex trafficking in our country.”
“Human trafficking is a monstrous and devastating crime that steals lives and degrades our nation,” said Attorney General Loretta Lynch. “As a result of the FBI’s outstanding coordination and exemplary efforts alongside state and local partners during Operation Cross Country, more children will sleep safely tonight, and more wrongdoers will face the judgment of our criminal justice system.”

Narrative: On 13 October 2015 at 5:45 PM a deputy arrested Aaron Allen in connection with a theft he reportedly perpetrated back in August. In this incident Allen stands accused of stealing a Snap-On Diagnostic Scanner and selling it at a local pawn shop.
Post arrest Allen was transported to the central Booking unit where he was processed and taken in front of the District Court Commissioner. Following an initial appearance, the Commissioner released Allen on Personal Recognizance.

Narrative: On 13 October 2015 at 6:40 PM Amy Beth Kellam surrendered at the Wicomico County Sheriff’s Office. Kellam was being sought on a Circuit Court Bench Warrant that was issued back in January 2015 after she failed to appear for a jury trial in the Circuit Court for driving while both suspended and uninsured.
Kellam had been featured as one of Wicomico County’s “Most Wanted” recently on local media outlets.
Kellam was detained without bond pending an appearance in front of a Circuit Court Judge.

Two 13-Year-Old Boys Involved in Knife Attack in Jerusalem
JERUSALEM—A 13-year-old Israeli boy in Jerusalem, emerging Monday from a candy store and climbing on the bicycle he had parked outside, was set upon by two Palestinian youths and repeatedly stabbed.
One of the Palestinian assailants was also 13.
The other, reportedly his cousin, was 17. Both were from a nearby Arab neighborhood in northern Jerusalem.
An Israeli driving near the scene rammed his car into the younger assailant, who was taken to hospital in serious condition. The older youth stabbed a man nearby, seriously wounding him, before being shot to death by police.
The Israeli boy was rushed to hospital where his loss of blood appeared to make his situation hopeless. By evening, though, doctors said his situation had stabilized although his condition remained life threatening.
Although Israelis have become accustomed to daily knife attacks over the past two weeks the involvement of two 13-year-olds—one as assailant, the other as victim—was a shock.
Israel Television showed a school bag confiscated by police, which contained notebooks, textbooks and a knife. It was not clear to whom the bag belonged. Until now, almost all assailants in the current round of violence have ranged in age from 17-20.

The other, reportedly his cousin, was 17. Both were from a nearby Arab neighborhood in northern Jerusalem.
An Israeli driving near the scene rammed his car into the younger assailant, who was taken to hospital in serious condition. The older youth stabbed a man nearby, seriously wounding him, before being shot to death by police.
The Israeli boy was rushed to hospital where his loss of blood appeared to make his situation hopeless. By evening, though, doctors said his situation had stabilized although his condition remained life threatening.
Although Israelis have become accustomed to daily knife attacks over the past two weeks the involvement of two 13-year-olds—one as assailant, the other as victim—was a shock.
Israel Television showed a school bag confiscated by police, which contained notebooks, textbooks and a knife. It was not clear to whom the bag belonged. Until now, almost all assailants in the current round of violence have ranged in age from 17-20.

Boardwalk Hotel’s Expansion Design Clears OC Planning Commission
OCEAN CITY — The downtown Ocean City skyline could be getting a not-so-subtle change after town planners last week approved a site plan for a three-story elevation of the Park Place Hotel on the Boardwalk between 2nd and 3rd Streets.
The Ocean City Planning and Zoning Commission last Tuesday approved a site plan for a significant expansion of the Park Place Hotel on the Boardwalk including the addition of three more floors on the existing elevation. The expansion would net an additional 99 rooms and suites and include some commercial elements such as pool and pool bar among others.
The plan calls for modifying some existing units on the lower floors in order to meet the parking standards and bring the project into compliance with the addition of the new units on the top three floors. Planning and Community Development Assistant Director Blaine Smith laid out the site plan review for the commission on Tuesday. He said the project as proposed met the town’s standards for parking, trash, stormwater management and landscaping and the staff review did not turn up any significant issues with the hotel expansion.

The ‘Gun Control’ Farce
President Obama’s intrusion into the mourning community of Roseburg, Oregon, in order to promote his political crusade for stronger gun control laws, is part of a pattern of his using various other sites of shooting rampages in the past to promote this long-standing crusade of the political left.
The zealotry of gun control advocates might make some sense if they had any serious evidence that more restrictive gun control laws actually reduce gun crimes. But they seldom even discuss the issue in terms of empirical evidence.
Saving lives is serious business. But claiming to be saving lives and refusing to deal with evidence is a farce. Nor is the Second Amendment or the National Rifle Association the real issue, despite how much the media and the intelligentsia focus on them.
If there is hard evidence that stronger gun control laws actually reduce gun crimes in general or reduce murders in particular, the Second Amendment can be repealed, as other Amendments have been repealed. Constitutional Amendments exist to serve the people. People do not exist to be sacrificed to Constitutional Amendments.

Air crash investigators concluded Tuesday that Malaysia Airlines flight MH17 was shot down by a missile fired from rebel-held eastern Ukraine last year, killing all 298 people on board.
Even before the highly-anticipated release of the official report on the disaster by a Dutch-led investigation, Russian officials were disputing the findings which are sure to further degrade strained ties between Moscow and the West.
"Flight MH17 crashed as a result of the detonation of a warhead outside the airplane against the left-hand side of the cockpit," the chairman of the Dutch Safety Board, Tjibbe Joustra, told a press conference.

King Of Beers: SABMiller Agrees In Principle To Merger With Budweiser Brewer
After rejecting a number of earlier offers, British-based beer company SABMiller accepted in principle a 69 billion British pound ($106 billion) offer from Budweiser brewer Anheuser Busch InBev.
If Tuesday's agreement is finalized, the new beer company will be the largest in the world and control two top U.S. brands in Budweiser and Miller Genuine Draft,according to the Associated Press.

North Korea Can Hit U.S. With Long-Range Nuclear Missile
North Korea is capable of hitting the United States with a long-range nuclear missile, the commander of the U.S. Northern Command said last week.
“I agree with the intel community that we assess that they have the ability, they have the weapons, and they have the ability to miniaturize those weapons, and they have the ability to put them on a rocket that can range the homelands,” said Adm. William Gortney, the Northcom commander who is also in charge of defending the United States from long-range missile attack.
“And as the defender of North America, the United States officially, in the ballistic missile defense, I think the American people expect me to take the threat seriously,” he said Wednesday at the Atlantic Council.
The comments by Gortney were made days before North Korea held a military parade in Pyongyang marking the anniversary of the founding of the ruling communist Worker’s Party of Korea. Military analysts say the parade showcased a new variant of a long-range road-mobile missile built with Chinese assistance.

Report: Islamic State Seizes U.S. Missiles in Iraq
The Pentagon acknowledged on Monday that Iraqi forces could have discovered a cache of U.S. weapons and missiles seized by Islamic State (IS) militants operating in the country, according to U.S. officials and regional media reports.
Iraqi forces combatting IS (also known as ISIS or ISIL) are said to have found a stockpile of U.S. weapons, including ammunition and anti-armor missiles, hidden at sites controlled by terrorist forces, according to foreign military sources who spoke to Iran’s state-controlled Fars News Agency. This is said to include a “huge volume” of advanced TOW II anti-tank missiles.
When asked to address the reports on Monday, a Pentagon official acknowledged that U.S. weapons had gone missing last year, but denied that the United States was intentionally arming IS or its affiliates in the region.
“As you may recall, when ISIL overran Iraqi positions last year, we were aware of ISIL capturing some Iraqi weapons and equipment that had been supplied by the U.S. to Iraqi forces,” the official said. “However, the claims that U.S. and Coalition forces are directly supplying ISIL with any weapons, equipment, or ammunition are completely false.”
Fars claimed the U.S. weapons and ammunition were discovered over the weekend near the Iraqi city of Fallujah and that they had been “airdropped” into the area by American forces.

Gag Order Imposed On Lawyers At Gray Trial
Baltimore City Circuit Court Judge Barry Williams is imposing a gag order on prosecutors and defense attorneys in the Freddie Gray case.
"I do not want you discussing my orders with anyone...except your clients and your experts," Williams told lawyers at the end of today's proceedings.
A formal order will be filed tonight.
It is not clear which attorneys the judge may have been targeting in issuing the order, but it came after attorneys for Officer William Porter asked the judge to force the state to turn over further evidence the case.
The judge did that. Porter himself did grant an interview to the Washington Post last month, and is set to go on trial at the end of next month.

Veteran Officer Suspended After Video Shows Him Reportedly Spitting On Handcuffed Man
The investigation continues into the incident that occurred last night (October 12, 2015) in the area of Old York Road. The incident led to an arrest of a man for disorderly conduct. During the arrest, the officer appears to have spit on the suspect while he was in handcuffs.
This is now a criminal and internal investigation. Based on additional video and witness interviews, the decision has been made to suspend the officer’s police powers.
"Our internal investigation progressed rapidly today with the review of available video and interaction with witnesses. The video appears to depict the police sergeant spitting on the arrestee. That is outrageously unacceptable and it directly contradicts the necessary community relationships we are striving to rehabilitate. The police powers of Sergeant Robert Mesner are now suspended, and a criminal investigation is underway. Our entire community deserves to be treated with dignity and respect." Said Interim Police Commissioner Kevin Davis.
Sergeant Mesner is a 34-year- veteran of the Baltimore Police Department.

In a stunning benchmark of heroin’s and other drugs’ increased use in Virginia, a pattern across much of the country, deaths from drug overdoses in 2014 cost 728 Virginians their lives.
That is compared with 700 highway fatalities that year, the most recent annual time frame available. Highway deaths have been dropping as drug deaths increase: The highway death toll in 2013 was 741 compared with 661 from drugs. In 2009, there were 750 traffic fatalities compared with 504 deaths from heroin and opioids.

Applications Being Accepted for Position of Cadet Trooper
Dover – The Delaware State Police are now accepting applications for the position of Cadet Trooper.
The Cadet Trooper's primary duties include the enforcement of handicap parking and fire lane violations, however they are also used in various administrative duties such as traffic control at large events and foot patrol at the State Fair. The Cadets will complete 40 hours of mandatory classroom instruction and will be assigned to various troops throughout the state. Since the program began in 1998, the Delaware State Police have hired 69 Cadet Troopers. 21 of those cadets have been hired as Delaware State Troopers.
Minimum Qualifications to become a cadet includes:
- Education- Candidates must be a Delaware resident and currently enrolled in an undergraduate program at an accredited college in the state of Delaware (full-time or part-time)

'Dead' Indian man wakes up minutes before post-mortem
A homeless Indian man who had been pronounced dead woke up on an autopsy table, shocking hospital staff who were about to begin a post-mortem, authorities said Tuesday.
Police in Mumbai said they found the man, who has not been named, unconscious and suffering from multiple infections on Sunday morning and took him to the local hospital.
A doctor at the Lokmanya Tilak Municipal General Hospital certified the man as dead and sent the body for autopsy, Ashok Dudhe, Mumbai Police deputy commissioner told AFP.
"As the autopsy was about to begin, the man awoke triggering chaos after which the doctors rushed to the room. Then they snatched the death certificate from my staff and tore it up," Dudhe said.

“We have received reports that parents are being refused access to material used in 7th grade social studies regarding the teaching of Islam,” Sens. Mae Beavers and Kerry Roberts said in a joint press release cited by The Tennessean Thursday.
“We want to remind all Tennessee school districts that the law is very clear and that any teaching materials of any grade level shall be made readily available to parents or legal guardians at their request.”
The reminder follows public information requests sent by the American Center for Law and Justice to all Tennessee school districts requesting tests, quizzes, assignments and other instructional materials involving world religion, The Tennessean reports.
An attorney representing the majority of Tennessee school districts denied that request because the ACLJ is not a state resident, a technical requirement for disclosure, despite the fact that a local attorney signed the requests.
Parents across Tennessee and other states have objected to lessons on Islam taught in public schools that require students to write or recite the Islamic call to prayer: “Allah is the only God, Mohammad is his prophet.”

School Fights Atheist Efforts to Cut Nativity Scene from Christmas Concert
DUNLAP, Ind. – An Indiana school district is resisting calls from atheist groups to cut a Nativity scene from its Christmas Spectacular celebration, prompting a federal lawsuit.
The Freedom From Religion Foundation and the American Civil Liberties Union filed a lawsuit against Concord Community Schools in U.S. District Court on behalf of a student in the music program and his father, though neither are named in the litigation, The Elkhart Truth reports.

The Freedom From Religion Foundation and the American Civil Liberties Union filed a lawsuit against Concord Community Schools in U.S. District Court on behalf of a student in the music program and his father, though neither are named in the litigation, The Elkhart Truth reports.

The Environmental Protection Agency (EPA) spent over $15 million on outside public relations consultants despite employing nearly 200 full-time in house PR workers.
A new report on EPA spending released by Open the Books, a nonprofit organization dedicated to transparency, found numerous examples of questionable expenditures within the agency.
Among them, the EPA spent over $15.1 million on outside public relations consultants between 2000 and 2014. The funding was on top of the $141.496 million in salaries and $1.5 million in bonuses on full-time public affairs officers the EPA has spent since 2007. As of 2012, the EPA employed 198 public affairs employees. The average EPA employee salary is $111,165.
“Everyone is under the impression that the EPA is spending money to ‘clean the environment.’ But, it turns out EPA is running a $160 million PR Machine, $715 million police agency, a near $1 billion employment agency for seniors, and a $1.2 billion in-house law firm,” said Adam Andrzejewski, the founder of Open the Books.

There’s no single, effective approach that makes pain go away for everyone, and for some patients, none of the existing drugs seem to work completely. But even doctors with limited options for treating pain aren’t happy with the decision.

Iranian Ballistic Missile Tests Could Violate Nuke Deal
Iran’s recent test firing of a ballistic missile does not violate the recent nuclear deal, Obama administration officials said on Monday. However, nuclear experts disagree and are calling on the administration to hold Iran accountable for violating international agreements barring such action.
Iran announced over the weekend that it had successfully test-fired a domestically produced long-range surface-to-surface ballistic missile.
Iran maintained that the test does not violate the nuclear deal, though U.S. experts quibbled with this analysis.
Asked to address the reports on Monday, John Kirby, a spokesman for the State Department, said that the administration is “aware of reports that Iran is conducting a new round of missile tests.”
“We will take appropriate actions at the United Nations if these tests violate any existing UN Security Council resolutions,” Kirby said in the statement. “Separately, we remain confident in our ability to defend ourselves and our allies in the region. And we will continue to work closely with our regional partners to boost their capabilities to defend themselves against any threats by Iran.”
However, Secretary of State John Kerry has stated in the past that such tests would not violate the accord. The State Department maintains that this is still its position.
Kerry informed Sen. Marco Rubio (R., Fla.) in recent correspondence obtained by the Free Beacon that a ballistic missile test would not violate the accord.

BELMAR, N.J. — A woman who pounded double-vodka cocktails at 7 a.m. then repeatedly fell off a chair at police headquarters can proceed with a lawsuit against officers who arrested her for drunken driving, an appellate panel has ruled.
The woman, Linda Leone, claims that Patrolman Michael R. Allen and Sgt. Sean R. Pringle failed to exercise reasonable care over her while she was in their custody, and as a result, she suffered a broken hip after repeatedly falling off a chair while waiting to take a breath test.
Leone admitted she had four drinks of vodka and orange juice, each with double shots of liquor, at a nearby bar between 7 and 7:50 a.m. ET April 22, 2010, before getting in her car and ultimately being arrested on suspicion of drunken driving. Leone claimed she was “highly intoxicated" while in police custody, according to court records.

Her answers were polished, even when they were contradictory or evasive, and she smiled plenty, engaged her colleagues in a friendly manner, embraced President Obama’s racial policy legacy and didn’t lose her cool. Those things played to the Democratic base, which is how you win primaries. She won by avoiding a big loss that was quite possible given the landscape.
