When Montgomery County Councilman George L. Leventhal sent a letter
to school leaders in late May asking for schools to be closed on two
Muslim holidays, he cited the county’s significant Muslim population and
religious fairness.
But school systems in the state cannot
declare days off — in this case Eid il-Adha and Eid ul-Fitr — solely
because they are religious holidays, no matter population demographics,
said attorney Rochelle Eisenberg, of Towson-based Pessin Katz Law PA,
who specializes in education and employment law.
School systems must base the decision on attendance rates, to avoid
violating the Establishment Clause, which prohibits lawmakers from
exerting religious preference, Eisenberg said, citing a 1999 Maryland
court ruling.
"What you have to do is determine that there are so
many absences in the school system, between students and staff, that the
school system cannot be properly run,” Eisenberg said.

ReplyDeleteI guess the whole world has gone nuts. The Delmar VFW 8276 is giving out golf shirts to people who are not members And have never served in the military. Perhaps some of these people are not even citizens of the USA. Those of us that served our country and have worked as to support the Post and the community and the Veterans of our Country no longer have respect.

ReplyDeleteAs for the holidays, I don't see the need to close the schools, but don't think any children who miss school in order to observe them with their families should be penalized as long as the work is made up.

Obama will be defeated in November, and Romney will dismantle the kooky anti-business regulations which have hampered business for three years. In about a year, banks will start lending again, and things will be back on the upswing economically.

ReplyDeleteI don't agree with public schools having off for any religious holidays. It is not the government's place to decided which religion is worthy of a day off and which isn't. That being said, if you do not agree with the way in which a public school honors religion, mind you a school paid for by people of all religions, send your child to a private school that honors your religion. Public school should not be influenced by any type of religion what so ever.
