Experts: Argue All You Want, Mosque Project On Firm Legal Ground

For all the anger [1], political strategizing [2] and stabs in the heart [3] that the plans to build a Muslim community center near ground zero may have brought about, land-use and zoning experts say opponents of the project have very little legal basis [4] on which to rest their argument.

The discussion draws in First Amendment arguments about the constitutional right to freely practice religion. But on a more basic level, the community center must adhere to zoning laws, as none other than Rush Limbaugh [5] has noted.

  3. Why is there nothing about the Christian based Church that was destroyed during 9/11 not being allowed to be rebuilt? Religous discrimination at it's best. Progressives / Liberals do not want to talk about this. It will show they are not willing to give equal / Constitutional rights to ones they want to eliminate. This also shows they are very hypocritical.

  4. No-one that I have heard has ever said they don't have a legal right to put it there. Of course they do.

    And the KKK can erect a community center near the site of the MLK assassination, the Neo-Nazis can put one near the B'nai Sholom Temple.

    Just because you can, doesn't mean you should.

  5. It is LEGAL- it's just not tasteful. The argument against the building that one particular mosque on that piece of ground isn't a constitutional or legal one. It's a matter of doing the right thing. Being graceful and dare I tell the liberals... being TOLERANT to the society at large. Mayor Blumberg should have negotiated with the owners of the property and saved all of us (including them) the headache.

  6. There was no Christian based church that was not allowed to be rebuilt unless it violated zoning rules.
    There is already a mosque 4 blocks from ground zero. The proposed "mosque" is in fact a muslim community center, like the YMCA is a Christian comunity center. The site is 2 blocks from ground zero.
    What is the tasteful distance?

    Ron, you guys try to change the argument when it's a fact that legal action to stop this building was the first option. Just like an idealogue, change the story when someone points out the mistake.

  9. Bill said: There was a Christian based Church, ST Nichols Greek Orthodox Church, destroyed in this massacre. NYC has just responded to them about rebuilding or rebuilding with conditions. The Government or NYC wants to put an underground secure parking lot on the site of the original Church that was destroyed on 9/11, next to the Twin Towers. This was never reported. I will say research these facts and tell me the documentation to prove me wrong and then I will respect that and concede.

  12. The Koran says that all non-believers should be destroyed. Why are we obligated to show religious tolerance to those who espouse intolerance? This makes no sense and I doubt that the founding fathers intended to protect a religion that preaches hate for their fellow man.

  15. This is simply a 'conquest mosque'. Research Cordoba, Spain where a mosque was build on the site of a vanquished church.

  17. The Church owns the property from my understanding. The Port Authority of New York and New Jersey wants to construct a bomb proof platform under the Church. That is if NYC and the Port Authority should reverse their decision and allow the Church to rebuild on the property they own. Instead it appears NYC will take it eventually by emminent domain and use it for their own purpose.
