UPDATE: A MAN accused of FARTING and fanning it towards a police officer has escaped being charged.
The Kanawha County prosecutor’s office, in West Virginia, US, requested that the charge of battery be dropped against 34-year-old Jose Cruz.
According to a criminal complaint, Cruz let rip and made a fanning motion toward patrolman T.E. Parsons after being taken to the police station for a breathalyser test.
Cruz denies fanning the fart and says his request to use a toilet when first arriving at the station was denied.
However he still faces several other charges including one of driving under the influence.
