2017 MD HB 600, SB 175 Propose to Regulate Private Property

2017 MD HB 600/SB 175, proposed by Delegate Kramer and Senator Manno, respectively, propose restrictions on private property where medical oxygen is in use.

Among the proposed nanny state provisions:

(A) AN INDIVIDUAL MAY NOT LIGHT OR SMOKE A CIGARETTE, CIGAR, PIPE, OR ANY OTHER MATTER OR SUBSTANCE THAT CONTAINS TOBACCO:

(1) IN A ROOM OF A RESIDENTIAL DWELLING IN WHICH MEDICAL OXYGEN IS BEING USED; OR

(2) WITHIN 20 FEET OF A ROOM OF A RESIDENTIAL DWELLING IN WHICH MEDICAL OXYGEN IS BEING USED.

  2. OCPD is most often the result of tobacco use. I had a neighbor when I was growing up that was on oxygen and dying. When he died, he had a lit cigarette in his hand, according to the coroner that came and picked up his body. No law is going to stop smokers. PERIOD! Have these morons of state legislators considered how they are going to "catch" the vile and dangerous law-breakers? The ones that are lighting up, are often the same ones that are using the oxygen. If not, its the family members. Smoking tends to run in families. Like Mom / Dad, sons & daughters follow.

  3. Whats next? All homes are non smoking, no lit candles, and no drinking of alcoholic beverages! Hell with them! I guess cameras will be next in all homes and apartments so they can make sure you do what they say!

  7. You'd have to outlaw all electrical home appliances, which would include your oxygen generator.
    This bit of foolishness is just a way to get these legislators' names on the books. If this is the best that they can do, then they need to be replaced ASAP.
    I even wonder if they were either stoned or drunk when they thought of this dopey legislation. Of course, if it's a rider, its purpose is to derail anything that is in attachment.

  8. While seemingly stupid and ridicules law, they have no interest in whether they can enforce it. After this passes {and it will, same as all the infringement on the 2A} they then will make laws feeding off of this one that will regulate your private property in any way shape or form they wish....baby steps.

  13. Laws are enacted to protect stupid people from themselves and the people around them.

    I worked at shock-trauma years ago and we actually had patients lighting up. I kid you not. One guy smoked through his stoma-trach tube.
    No, tobacco isn't addictive.
