Attorney: DC Sniper Life Sentence Unconstitutional

ROCKVILLE, Md. (AP) — An attorney for a man convicted of taking part in sniper shootings that left 10 people dead in the Washington area is asking a judge to toss his life sentence because he was convicted as a juvenile.

In a motion filed Friday in a Maryland county court, public defender James Johnston argues that Lee Boyd Malvo’s mandatory life sentence is illegal because the U.S. Supreme Court determined such sentences are unconstitutional for juveniles.

Malvo was convicted in Maryland and Virginia when he was 17 for his role in the 2002 sniper shootings that killed 10 people and wounded three in Virginia, Maryland and the District of Columbia. He also later admitted to shootings in other states. He’s serving a life term at the Red Onion State Prison in southwest Virginia.

  7. He was a terrorist that was involved in killing at least 10 people. Why hasn't he been executed???? I would love to be allowed to take care of this piece of crap. The next person would think twice before terrorizing DC and surrounding areas.

  9. malvo was to be 18 in a very short time. He was the trigger man. He's the one who pulled the trigger while john allen williams drove the vehicle from which he shot. I say he knew what he was doing & in fact expressed pleasure at doing so. This so-called lawyer can go pound sand. He must be really desperate for attention.

    His case should be tried as a War Criminal , as ALL
    terrorist should be ....Not a civilian matter

    Firing Squad to be the Method to Eliminate him !!!

    Need a strong Deterence from now on .......
