Court Upholds Federal Ban On Gun Sales To Medical Marijuana Cardholders

A large number of states have legalized marijuana use for medicinal purposes, even as the federal government continues to maintain that pot is as dangerous and addictive as heroin. However, even though you can’t currently be prosecuted by the feds for properly obtaining medical marijuana in a state like Nevada, your status as a confirmed marijuana user could be used to prevent you from buying a gun.

Federal laws regarding firearms sales include a prohibition against selling guns to fugitives, convicts, “mental defectives,” and anyone who is an “unlawful user of or addicted to any controlled substance” as defined by the Controlled Substances Act.

As mentioned above, not only does the DEA consider marijuana a controlled substance, but lists it as a Schedule I controlled substance, meaning the agency considers it to be highly addictive, dangerous, and having no legitimate medical application.

  1. Just because a law is wrong shouldn't take away an inalienable right of self protection.

    Simply rewrite the law correctly, or get rid of it altogether.

  4. The NRA needs to get on this one!
    Taking away someone's right to own a firearm without prosecution and conviction is plain WRONG!
    Now if they want to arrest and convict, they'll have to do it to about a third of the country - the courts and prisons can't handle that volume - and the voters have already started to get their wishes know at the local level!

  5. Highly addictive? Dangerous? No legitimate medical application? Science says no to all of these assertions.

    Cannabis is kept on the Schedule I list only as a law enforcement tool to harass, fine and imprison people, just as it was in the 1930's when the cannabis prohibition laws were created with the aim of "controlling" Blacks and Latinos.

    1. Your quoting opinion of someone not the actual testimony in the court hearings. So throwing race into it is stupid... however I do think this is wrong and pot is YUMMY.

  6. Isnt it odd that the states break federal laws...and the feds break state laws...but no one is ever charged and prosecuted for all this law breaking?
