The incident occurred on January 12, 2020 at approximately 7:31 p.m., when Troopers were dispatched to the area of Northbound Sussex Highway and Bethel Concord Road, Seaford, for a report of a white Ford vehicle swerving all over the roadway. Upon arrival to the area, the Trooper observed a white Ford Fusion in the left lane of Northbound Sussex Highway, approaching the red traffic light of Middleford Road. The vehicle came to a stop several feet past the white stop line and when the traffic light turned green the vehicle remained stopped. The Trooper activated their emergency equipment when the driver, James Comegys, proceeded into the parking lot of Popeye’s and drove around the entire building before coming to a stop.
Contact was subsequently made with Comegys when the Trooper observed signs that he was driving under the influence and a DUI investigation ensued. Troopers located drug paraphernalia along with approximately .021 grams of heroin inside the vehicle. A computer check revealed that Comegys’s had five previous DUI convictions, making this his 6th arrest.
Comegys was taken into custody without incident and transported back to Troop 5 where he was charged with the following:
- 6th Offense after 5 prior offenses – Driving a Vehicle under the Influence of any Drug
- Unlawful to Tamper, or circumvent the operation of, any Ignition Interlock Device
- Possession of a Controlled or Counterfeit Substance
- Possession of Drug Paraphernalia (2 counts)
