Yeah, but the police need a warrant to look at what's on your phone. So unless someone SAYS they saw you on the phone prior to an accident, there is not reasonable cause to get a search warrant for the phone.
I really think that's what the woman who rear-ended us was doing (texting), but when the responding Wicomico deputy is drunk...!

@12:47, All you have to do is say you passed them before the accident and you saw them on their phone. Who's to say any different?
