Cuomo: GOP Tax Law Potentially ‘Unconstitutional,’ ‘Double Taxation’

Thursday on CNN’s “New Day,” Gov. Andrew Cuomo (D-NY) said the Republican tax law could be unconstitutional “double taxation.”

Cuomo said, “One of the devilish things in the bill, they eliminate the deductibility of state taxes, and it is a mouthful but what it says is up until now, over 100 years, you pay the local tax and state tax and deducted that from your federal tax, and they are eliminating that. You are now paying two taxes. You pay a tax to the [state] or local government, and then the federal government taxes that tax. It happens to occur coincidentally only in blue states only Democratic states.”

  2. So Cuomo, when I earn money and pay taxes on it and then invest my money I get to pay taxes again. Is that "Double" taxation you stupid crook?

  6. IIRC, the new law caps the deduction for state and/or local taxes at 10K (unsure if that is per tax or combined). So if you have a regular house you're probably still going to be able to deduct. If you have chosen a McMansion, you'll still get up to 10K to deduct.

    Similar to provisions on the amount of mortgage interest that can be deducted which have been around for a few years.

    NY, CA and others like states have been able to jack taxes knowing their citizens could write off the state taxes on their federal return. In other words, the feds (i.e. the rest of the nation) were subsidizing their out of control socialist state choices.

    Maybe Cuomo and Jerry Brown will consider Rain Taxes?

  13. Obamacare is illegal but everybody looked the other way..It was ruled by the Supreme court to be a tax but all tax legislation must start in the House of representatives and Obamacare didn't.
