Oh, you're NOT going to believe this one. You will read later this hour of how the City is divorcing the County in which Jake Day is about to skyrocket your taxes by creating new departments.
One of the new resolutions you'll see tonight at the Council Meeting is his new reorganization plan.
So in a nut shell, if you are using City water and sewer, the City will inspect your RESIDENTIAL property "from time to time" "checking the the amount and nature of the effluent being discharged into the sanitary sewer system".
It goes on to say "Any person who shall refuse to permit and, upon conviction thereof by the Circuit Court for the county, shall be punished by a fine of not less than twenty-five dollars ($25.00 nor more than one hundred dollars ($100.00) or by imprisonment for not less than 10 days nor more than (30) days".
They go on to say they can disconnect you immediately as well. Didn't this happen at one time in Germany? Oh, that's right, millennials don't know what HISTORY is and they're taking down and removing anything to do with history. Keep in mind, you can be picked at random and you either let them in or you could go to jail on criminal charges. Like we learned and published a few months ago, be assured the people entering your home, (just like they have trained Firefighters) these people will see possible violations and immediately report you to Code & Compliance with demands to bring your property up to code. They can and will use this to enter your property any time they like.
This Mayor needs to be removed along with the entire City Council. Is this was City taxpayers really want?

ReplyDeleteAlthough concerning this is typical for many municipalities, and does not need a warrant. One scenario where an inspection could be initiated would be if the city has reason to believe you have performed unpermited plumbing work and are therefore discharging more wastewater than they are accounting for.

ReplyDeleteBefore the city attempts to gain access to "the property", there must be evidence that what's flushed or drained into the sewer is somehow dangerous or abuses the sewer system. That such unwanted is actually flowing from a source, that source has to be proven. Sewer main pipes have entry points from each property, whether business or residential, single family or apartment building. Businesses (some) and single family residences (all) have a single line to the main. Apartments share the line that goes from the building to the street. If something is going into the sewer that's a danger or that shouldn't be there at all, the only way to find out where it comes from with a shared system is to inspect the source point.

What are you waiting for? The last homeowner to leave? The last person without a lengthy rap sheet to leave? The last business to close? Or do you figure everybody else has been shot, stabbed, raped, mugged, robbed, or beaten but it will never happen to you?

I only know of one thing dropped in my stool (no pun intended).
Actually, this ordinance violates the US Constitution and upon challenge in any court, the City will be forced to pay restitution along with sanctioned by the Federal government which means trouble with the DOJ. The City Attorney apparently isn't doing his job because he should already know this will cause a world of hurt for the Day Administration. This could even get the ACLU suing them in another lawsuit beside the one suing them all for FOIA violations.

They already try this crap with rental inspections. They give the impression that it is mandatory but it isn't. We have refused their request. Thanks to one smart sbynews commentor who clued us in to the fact that this was a voluntary program on the tenants.

Since it would be illegal for them to demand an inspection of an occupied dwelling, they are pushing the envelope in another direction.
They are too stupid to realize they could get better results if they required a certificate of occupancy and did the inspection while the dwelling was empty in between tenants.
But that would mean you would have to venture out of the city to see what other municipalities successfully do.

ReplyDeleteWell 9:36am, there are already plenty laws that allow entry with a court order, if its a business, there are plenty laws that allow for inspection, even at random. Hardly any serious businesses that you havent taxed or regulated to run them away, so odds are low here too. I find it extremely unlikely any residence would or could discharge anything chemical wise for any length of time. Sounds like a far fetched excuse from the failed treatment plant as to why the bazillion dollar plant isnt working. None of this is even close as an excuse to ask/force people to forfeit their constitutional rights. Get your evidence and a court order. I yearn to see the day when leo's will charge those attempting to destroy the Constitution and Bill of Rights...your nazis, criminals and traitors.

Both political parties have been legislating behavior for decades - at the federal, state and local levels - and it has never been strictly Constitutional. "Public Safety" is the most common excuse and often accepted by many, but it is NOT Constitutional.

More and more businesses will either move to the County or just leave the area altogehter. He is ruining Salisbury by trying to dismantle it piece by piece to make it some Section 8 haven. Has anyone sent this package to the Governor? Maybe someone should because the faster Hogan defunds any grants to Day, the faster this cancer will shrivel up and disappear. Starving Democrats of cash is the quickest way to them moving on.

ReplyDeleteThis is ludicrous! Thank God I live in the County. Although I am most definitely not a Democrat, I really hoped that Day would do a decent job, but he has done the stupidest things EVER! Can the Mayor be impeached? It's incredible to me that he is so dumb! He is destroying what was left of this city. No area is "bettered" by Section 8 housing, bar crawl entertainment lanes, tearing down historical monuments, raising the already outrageous city taxes, dictating what kind of fences can be erected on private property, covering up crimes and shady deals, robbing one department to fund another (or an event), and cultivating votes from the non-working, non-contributing citizens. I think even Ireton would disagree with at least some of Day's ridiculousness. He truly needs to take his cocky self and find a job he can handle. I'm sure Daddy will find him something with a big title and few responsibilities. If not, Daddy-poo and Day's baby mama can pay the bills.

There are things that is against the city charter that the city is not permitted to do and they do it anyway. They call it "politics". Ok for them and not the residents of Salisbury?????? Doing work on PRIVATE property is one of them. My brother, bless his soul, worked for the city and told me several things they have done that was illegal. When he questioned it, he was told its politics and to keep his mouth shut.
