(CNN) —A Colorado man who was sent back to prison after being mistakenly released was told by a judge Tuesday that he is a free man.
Rene Lima-Marin was serving a 98-year prison term for robbing two video stores in 1998. He was released, improperly, in 2008, but was re-arrested in 2014, when authorities realized the mistake. In a 165-page decision, Arapahoe County District Court Judge Carlos Samour Jr. said "it would be utterly unjust to compel Lima-Marin, at this juncture, to serve the rest of his extremely long sentence"
In the six years that Lima-Miran was free, he found a job, got married, started raising a family, and purchased a home, said his attorney Kimberly Diego. "His case was unique in that sense," she said. "Not all people who are rehabilitated behave that way."
Lima-Marin was called an "asset to society" and an "outstanding citizen" who worked with young people encouraging them to make good decisions, per the judge's ruling.

ReplyDeleteLima-Marin’s prison sentence came from convictions in the video store robberies when he was 19 years old. No one was hurt during the robberies, and Lima-Marin claimed the gun used was unloaded.
The prosecutor had dissected the robberies into a litany of discrete actions — including kidnapping, because they moved employees from one room to another. That approach produced a sentencing structure boosted by the crime-of-violence enhancer toward a total of 98 years.
He changed his life. Isn't that the point of rehabilitation? His sentence was BS. What purpose does it serve to make him stay in jail?

100 page criminal history starting as a juvenile. At of 30 he used a pistol and robbed two stores in one night and people in the stores. Fled the scene was on the run for months. Jury finds him guilty. He gets out at 38. Lawyer through parol find him work once a week and gets married per advice or lawyer.... and you think he is a hero and fixed? Btw this is 17th time he has been to jail since he was 15. Career criminal.

ReplyDeleteFree speech doesn't mean you need to be an idiot! Mistake was made by the prison system. The man used an opportunity wisely. If he was going back to a life of crime it would have most likely been done by now. Now if he does something stupid again throw it all at him. We have other things to worry about now.
