Teen arrested after allegedly dropping F-bomb in public
An F-bomb landed an 18-year-old in jail and now he could spend more than a month behind bars.
Deputies in Louisiana arrested Jared Dylan Smith after they say he yelled the profanity next to a 75-year-old woman and quote, "clearly disturbed her peace."
No one else heard it, and Smith denies it happened, but he was arrested and spent a night in jail.
There is a limit for example you can't tell fire in a crowded theater and claim freedom of speech! You don't have the right to infringe upon someone else's peace.
Teens in the sixties didn't use language in front of girls. I remember a f was thrown out on time and a female was close by. It was four or five guys standing around and the one that said it was on the floor so fast, the others didn't even know which one struck him. He got up not saying a word, knowing he was the one in our eyes that was wrong.
I actually turned to some kids who were dropping all kinds of nasty words while standing in line near me one day and asked them to tone it down as there were small children around and i also did not like it and one of them looked straight at me and told me he could talk any f'in way he wanted it was a free America. Glad my husband and sons were not there, the little poop would have known it. But, then they would have been the ones in trouble for expressing their "free speech" options.
Is it illegal to curse in public? Obviously it is frowned upon, but I am pretty sure it isn't illegal which is why he was arrested for "disturbing the peace." This will be tossed out in a heartbeat. Do I agree with cursing in public? No. Is it an offense someone should be locked up for? Not a chance. This is absolutely ridiculous and if I were his parent he would face discipline from me sure. But you better believe I would be considering a lawsuit as well. The only reason this happened was because he is a younger kid/adult. If he were in his 30s they wouldn't even consider arresting him. Point blank, free speech says I can say what I want when I want. As long as it isn't threatening anyone. He is within his rights.

Yes but the example you provided is a much more logical example than this situation. Someone could be injured if you yell fire in a theater and people panic to escape. Saying the "F" word in public may be trashy, but it doesn't cause anyone harm. I don't like Hillary Clinton and the mere mention of her name disturbs my peace, but is that quantifiable, can I have someone arrested over saying it? How can you determine that one word is more offensive than the next to the insensitive word to the extent of prosecution? This is an overreach.
Also, it says no one else heard him "yell it." So this would easily be dismissed in court. If there were more complaints, I wouldn't agree with an arrest but I could understand a citation or something. But the fact one person "heard it" is odd in itself if he "yelled" it.
Maybe if the local John Q laws started enforcing profanity laws, it wouldn't be like going to a red light district in some seedy section of town every time we go to either of the local Walmarts and Dollar stores. Profanity has run rampant because parents don't parent anymore.
I guess some of you fools have no problem with someone talking like that around your wife and or kids??? People with morals and upbringing do not speak in public like that. I guess talking trash like that makes you feel all grown up, huh? Sad, just sad.
I don't condone him saying it. That does not equate to having to agree with him being arrested. Would I like him to say or yell this around my family members? Of course not. Would I say something to him if he were to do so, yes I would. But let's not act like it is an offense that constitutes being arrested. Those die hard Republicans on here who will stand on their head for guns rights ought to take a look in the mirror. This is an infringement on his rights. I am conservative as well, but you can not pick and chose to use the Constitution how you see fit. He was not threatening anyone, this is how he chose to present himself. It is a very trashy and disgusting way to act around anyone, let alone an elderly woman. But none the less it is not against the law. It is an indictment on his character and his upbringing but surely it is not a criminal offense.
Here is the actual law the police quoted when he was arrested: “addressing any offensive, derisive, or annoying words to any other person who is lawfully in any street, or other public place; or call him by any offensive or derisive name, or make any noise or exclamation in his presence and hearing with the intent to deride, offend, or annoy him, or to prevent him from pursuing his lawful business, occupation, or duty.”
You have to prove that he intended to disturb her peace, how do you prove his intent when the article says it was not directed at her?
Good language has been deteriorating in public over the years.
