Joseph Schwab was driving home from work in Solano County when he allegedly cut off an agent from the California Department of Alcoholic Beverage Control. Claiming Schwab was driving erratically, the officer pulled him over and gave him a breathalyzer test. The result turned up as 0.00%.
Regardless, she arrested him and took him to jail where they decided to do a blood test to see if he was on anything else. Everything in the illegal column came back negative, but it did show that Schwab had some caffeine in him. With that, California police charged Schwab with a DUI.

It's funny how story's take off. The defense attorney has not gotten a copy of the evidence yet. The defense attorney said all my client has taken was caffeine. Next thing you know it's front page in California.

That's because there is NO evidence, other than caffeine. This happened in Aug 2015. Ten months later they charge him, prob hoping he can't afford a lawyer and takes a plea. They tested his blood sample twice, once in Cali. and once in Pa. Over zealous cop who was pissed because she got cut off by him.
It's a story alright, about a NON-CRIME.
DUI under drugs is a crime. Caffeine is a drug.

it is legal and unregulated in nearly all parts of the world.
I just read the charge was dropped.
