Sweet Cakes by Melissa Files Appeal In Oregon Gay Wedding Cake Case

A bakery that was ordered to pay a $135,000 fine after refusing to bake a wedding cake for a same-sex marriage ceremony filed a brief on Monday with the Oregon Court of Appeals challenging the decision.

Attorneys for the Melissa and Aaron Klein, who own Sweet Cakes by Melissa, argued in the brief that the family’s 1st and 14th Amendment rights were violated.

“The Constitution guarantees the rights of free exercise of religion, free speech and due process for every America,” said attorney Boyden Gray, former White House counsel for President George H.W. Bush. “We hope the Oregon Court of Appeals will defend the Kleins’ rights in accordance with state and federal law.”

Kelly Shackelford, president and CEO of First Liberty Institute, which represents the Kleins, said Oregon Bureau of Labor and Industries Commissioner Brad Avakian “decided the Kleins were guilty before he even heard the case.”

The attorneys note that Mr. Avakian made a series of social media posts and public statements about the Kleins before hearing the case.

  1. I think these people should be allowed to refuse service based on their religious beliefs. We allow the performers such as Bruce Springstein, Demi Lovato, etc..., etc... to refuse to perform in NC based on their beliefs. I don't see anybody issuing fines to them for REFUSING service. It is the same premise. Why are we discriminating against Christians? It doesn't seem a Christian is allowed to live according to their beliefs. Muslims are allowed to REFUSE to sell alcohol if they work in at a place that sells alcohol. Heck, they can refuse to be around pork. WHY is everyone else ALLOWED their beliefs but not Christians?

I don't knwo who you dumb fucks can't see it... Don't be so islamaphobic all the while they are cutting peoples heads off, Christians heads, and not a peep... If your muslim you can have a mosk, if your christian you cannot have a church... If your muslim you can wear shit on your head that covers your face, if your christian you cannot get an ID or drivers licence with something covering your face... If your LBGT you can sue people even if you can go else were an buy a damn cake, yet if your christian you can't sue anyone for your beliefs...

  4. So where does it end? A cop arrests someone based on their religion? A firefighter refusing to fight a fire? How about a surgeon refusing to operate on a dying patient?

  6. 5:48, it is called exercising your rights. And there already is a firefighter that refuses to fight fires. A black man in New York complained he could not pass the test to be a firefighter and took it to court and the court forced the fire department to hire him. Now they say every time they respond to a fire, he is on the truck but after they arrive at the fire, he disappears. And the court will not allow them to fire him. How can a court do that? His cowardice will cause someone to be killed one day when he is needed and is not around. In response to this story, These gay people have no right to force their life style on others. The government has no right to force us to accept them. That bakery had every right to refuse. We need to keep the government OUT of our lives and force them to abide by our constitution. Which they swore to uphold. We need Trump.
