Scalia: Maybe black students belong at 'less-advanced' schools

Justice Antonin Scalia surprised the Supreme Court and the public during Wednesday’s oral arguments in a case challenging affirmative action when he suggested that black students do better in “less-advanced schools” that are on “slower tracks.”

“There are those who contend that it does not benefit African­ Americans to get them into the University of Texas where they do not do well, as opposed to having them go to a less­-advanced school, a slower-­track school where they do well,” he said. “One of the briefs pointed out that most of the black scientists in this country don't come from schools like the University of Texas.”

The comments came during arguments in Fisher v. the University of Texas at Austin, which stems from the lawsuit Abigail Fisher brought against the school after she was denied admission in 2008. Fisher, a white woman, argues that UT’s consideration of race in its admissions process violated the Equal Protection Clause under the 14th Amendment, particularly because a state law guaranteeing admission to students who graduate in the top 10 percent of their high school class was created specifically to address diversity.

  1. I think some people are confused. There are some issues with affirmative action where incapable people are "pushed" to the front of the line in institutions they can't handle.

    A fail is a fail. Not smart enough is a not smart enough.

    Don't blame this on racism. After all, Jackson and the other race chaser aren't smart enough to even understand what's going on much less lay blame.

  2. Why test them by skin color when yearly aptitude or performance testing of their minds could determine their next year's classes?

    You know, crazy things like the "Content of their character"?

  3. That's what HBCU's were created for.

    "College Lite." Or perhaps it should be "College Dark".

    Maybe be blacks do much better at "Historically Black Colleges and Universities" because they aren't so traumatized by sitting in classes with people who don't look like them. Because college is supposed to prepare them for the real
    world.

    Yeah...ok.

  4. They can't even understand how to follow directions let alone college. Look anywhere that affirmative action has been instituted and you'll see an unqualified person in the position. Just like the firewoman who was pushed through recently. Couldn't pass a PFT but because of her race they pushed her through. Then she hurts herself and long and behold disability for the rest of her life for 6 months of employment.

  5. Dumbing everything down to include blacks is just about the stupidest thing this country has done. If you are to stupid to pass the test, then your too stupid for the class, or job, or whatever the test was for.

  6. One of the few smart and accurate things to come out of this guys mouth!

    I see the results of that type of affirmative action on a daily basis (contract in the DC area). We have people here that didn't go to college in charge and doing a good job - while we have folks that you can tell were pushed through college to satisfy a number...with barely the capability to show up for work in the morning.
