In a case regarding a specific gun control law which bans “unauthorized aliens” (illegal immigrants) from possessing firearms in the United States, the U.S. Court of Appeals for the Seventh Circuit did the work of a contortionist by upholding the law while also pointing out that they “see no principled way to carve out the Second Amendment and say that the unauthorized (or maybe all noncitizens) are excluded.”
In a word—illegal immigrants have Second Amendment rights too.
The case was titled United States v. Meza-Rodriguez, and the decision was handed down on August 20.
The Milwaukee-Wisconsin Journal Sentinel reports that the decision was written by Judge Diane Wood “for a panel that included Judges Frank Easterbrook and Joel Flaum.”

This court is one of the most liberal in the country. How in the hell does an illegal have ANY RIGHTS? ? This court and judge doesn't seem how to follow the Constitution. This decision in its self is illegal.

DeleteIf we are allowed to have guns and England says no to their citizens. Do our rules apply to their citizens? No. If their citizens visit us, does our 2nd amendment now apply? No, we are merely "babysitting".

DeleteCriminals should not have any rights! They forfeited their rights upon committing a criminal act! Entering this country illegally - or overstaying your permit is a criminal offense. The fact that they are here is proof of their criminality - they are in the act of committing a crime - add a gun and it becomes aggravated!

How do you legally buy a handgun in a state you aren't a legal resident of, without having to go through a third-party FFA licensed dealer?
