The law in Maryland example : if you cut your neighbors grass and they have knowledge of this or are they are watching you cut , if they make no attempt to stop you , then you can charge them for the cut. I'm sure this would also apply to the driveway.
to 6:32 and 7:22 - You are talking about Adverse Possession. What you suggest is possible but not probable. There are several factors that must exist for Adverse Possession to take place and must be decided by a court of law. There is not enough evidence prevented here to even guess.
My neighbor put up a fence right up against the property line and then started an auto restoration business. I responded in kind, buy planting leyland cypress trees down the property line so I wouldn't have to look at it or them! Turn around is fair play!

ReplyDeleteThe right of way easement would be documented in the land records and is not automatic. Good fences make good neighbors.
