NAACP Seeks Abolishment of Fifth Amendment, Requests New Ferguson Grand Jury

The NAACP is asking a Missouri judge to convene a new grand jury to consider charges against the Ferguson officer who fatally shot 18-year-old Michael Brown.

The NAACP’s Legal Defense and Educational Fund on Monday submitted a letter to St. Louis County Circuit Judge Maura McShane. The letter also requests an investigation of the grand jury proceedings that led to the decision not to indict officer Darren Wilson. The white officer fatally shot Brown, who was black and unarmed, on Aug. 9, leading to significant unrest.

  2. "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

    Abolish this? Really? Really??

  3. Why Prosecutors Choose Grand Juries Instead of Preliminary Hearings:

The grand jury process is prosecutor-friendly in that grand jurors see and hear only what prosecutors put before them.

So, is the NAACP saying that the prosecutor(s) in Ferguson were corrupt or lacking in some way?

It's a damned good thing that the law isn't carried out in the court of public opinion.

  7. Just imagine if Maryland got with the 21st. century and did away with the antiquated "Commissioner" system and used "Grad Juries". the courts would be a freed up a lot for real crimes, as it is right now, the commissioners will grant an indictment for a turnip!
