  1. Did anyone under the age of 21 years take possession of alcohol during the attempts to entrap the employees?

  2. Actually its not Entrapment unless they try to coerce someone into selling the alcohol. I learned this because an elderly friend get caught selling to a minor a couple years ago and she thought she was entrapped.

Here is a clear way to tell if its entrapment...

An under age undercover cop comes into a store and tries to buy beer. The person at the cash register ask for ID and the undercover officer says he left his ID at home but he is 21. The person at the register takes his word for it and sells it to him and then gets busted. That is not entrapment.

Now lets say when the under cover officer says he forgot his ID and the person at the cash register says "Sorry I can't sell to you." The officer then starts to argue with the woman insisting he is of age. After arguing and maybe even intimidating the person behind the register that person finally gives in and sells the alcohol. That would be entrapment.

In this case she stuck to her guns and did not want to sell the item until she was either coerced or intimidated into selling the alcohol. As a result she was entrapped by the police into breaking the law.

Bottom line is that if an undercover cop who is under age tries to buy alcohol and is refused the sale they are supposed to just walk away and not argue because it could then be considered as entrapment.

  3. Nice explanation.and it would be true if the cops followed the laws that we do. However, in the real. They don't walk away. They persist. They make up excuses and try again, they try a different entrance, they try to gain entry using the dumb girl tactic. Entrapment.

  4. Not even close to entrapment. You blogging tv lawyers should go back to tv law school.

  5. Entrapment or no, sale or no sale isn't the real issue. The issue is that cops are out-of-control and have been since 2001 when your Congress traitorously gave away your Constitutional rights.
