The lawsuit was filed TODAY in Federal Court and while I will be delivering a series of articles on this matter, let me tell you what I do know.
First of all, I have seen ALL of the video footage of this incident. I have also seen the still photos as well as the POLICE REPORT.
Talk about INCREDIBLE inconsistencies from the Police Report vs. the actual video footage. Oh, there's a major storm about to hit the City.
Here's what bothers me the most about all of this. You have a ROOKIE Police Officer who, (as we have learned) has a history of complaints, yet he's still on the streets of Salisbury. We'll get into his history later but know I am aware of his history and we will document it soon enough.
Nevertheless, here are several college students getting arrested for BOGUS charges. The video shows one thing and the Police Report shows something completely different. Unfortunately, NO MATTER WHAT, these students lives are DESTROYED by one rogue Officer.
The upper brass at SU viewed the video and cleared EACH STUDENT. Get this, SPD confiscated the SU footage the very next morning and the students attorney had to subpoena the SPD for the footage because SU no longer had it and SPD was not willing to turn it over.
While the attorney and students tried everything they could do to get the City to respond, the City REFUSED to do so and now this case will go to Federal Court, (as it should).
It is time we EXPOSE local Law Enforcement. Spread the word about this case Ladies & Gentlemen because from what I hear there are MANY more complaints about this Officer and this Law Firm should be made aware of it. Leave it to your Mayor to IGNORE the seriousness of this case and not respond at all.

But I would like to revisit an issue, nay, a person of the highest regards who could possibly assist SPD or any other agency that would like it. The word is that there is an opening for a Captain's position at SPD. I would like to recommend, again Lee Stevens for this position, I believe SPD could benefit from Lee's expertise, intelligence and his uncanny ability to lead from the front. The problem arises from the Cops of today are all Alpha Males who are highly educated and do not always take in to consideration the situation. Example: If one of these Military Dressed Cops stop you for a seatbelt violation along let's say Route 13 and you say something out of line the Alpha Male does not like there is a good chance you will be removed from the car and handcuffed by more than one officer if needed. It started as a seat belt and turned into resisting arrest! All because the officer has thin skin and does not like to be talked down to. They have done this to themselves as they try to be the BIG ENFORCER ! Mouth Off and get Tazed or Pepper Sprayed just for TALK! ReplyDeleteSince the weekend holiday all I have seen on the highway have been cops. City, County and state. I have seen them on the side of the road, in the middle with radar, and hiding around corners. I have been driving the speed limit, not talking on a cellphone, and minding my own business..... I guess that is why I didn't get to meet any of these officers.

It will all come out in the wash. Do not know many of the city cops. They seem to have scraped the bottom of the hiring pool for some time. The fact they are a Nationally Acredited Department concerns me.

How can SU "no longer have the footage"? The video stays on the hard drive of the recorder even if a copy is down loaded or burned to disk until it is over written. Did SU not keep a copy of the footage for themselves being that it involved their students?

ReplyDeleteI don't know what this incident was started about but I think it was about under age drinking.I grew up in montgomery county md and went to high school in the 50's at that time it was legal for anyone 18 years old to drink beer and wine in wash dc.myself and every other teenager headed to the district on fri n sat night there was never any trouble,I feel strongly that if you are old enough to go in the military(either volunteer or drafted)you are damn sure old enough to drink a beer. If the stupid politicans won't change the law at least the cops could lighten up. THE DAMN COPS ARE OUT OF CONTROL!

DeleteI work at SPD so some facts for you readers: crime stats are fudged for many reasons except when they need grant money for something. Duncan is a clone of Dipino but OCPD can chime in on that. Whatever video evidence is found in this case, SPD will cover it up by saying something happened off-camera prior to incident. Aita is an aggressive officer and that suits them when they want it too. He too will be hung out to dry if the Mayor chooses. Why have so many officers left for other agencies? Maybe the answer is not the officer but SPD. As for the comment about Mark Tyler being chief, what a joke. Not only was he lazy but quite the suck-up as are most of the senior staff dying to be promoted. Sorry but Duncan isn't the answer. You have to be around a little more and not stuck up the Mayor ass.

However, I can say that very bad and illegal behavior by a small percentage of SU students has resulted in violence against neighbors and police by belligerent, entitlement mentality drunks who come here To party instead of learn. It is a shame, but it is true. SU police, state police, Fruitland police, and WCSD have all had to join forces with SPD to keep this under control in the city and county.

DeleteI don't know what this situation is all about, or who is in the right or wrong. What I do know and see, I live on Smith Street and watch many groups walking by drunk, peeing in bushes (both boy and girls) drunk so much as they stumble when they walk, attempting to steal stop signs & other disgusting unmentionables. I am sure most of these students are underage since most start college around the age of 18. Maybe if fines were put in place increasing with each violation they do, they would think less about getting drunk and wouldn't want to be broke paying all the fines, or take their scholarships away, stiffer penalties.

Making a false statement to a cop will get you arrested (and prosecuted). Filing a false report of a crime can actually land you in PRISON, depending on the seriousness of the lie.

7:51 is delusional and 8:07 is a short little cop. NO COP comes to "save" you or protect you from a home invasion. They show up to write "reports". And EVERY citizen has an absolute right (under the Constitution) to "talk down to cops". They are SERVANTS. We have no mandate to like them, respect them, be nice to them, or be polite. And considering the FACT that they kill hundreds of citizens a year, many who are unarmed and merely just pissed off a cop, DISrespect is in order, not the reverse.
Police have forgotten their place. Equal justice for all, under the law. Make ALL police wear body camera's (and if it convienently "malfunctions" during a bloody arrest, 6 month suspension without pay). Make police personally responsible for their egregious actions.
And PROSECUTION for cops who witness police crime, but fail to report it or stop it.
Of course, THAT would require the State's Attorney to get off his knees, wipe his mouth clean and do his job FOR THE PEOPLE. And the judges who condone these Gestapo tactics? Public whippings.

Most who work there can't stand her. They would never go out into the community and seek out those who disagree with her and carry out acts of retribution on her behalf. haven't seen the videos or the report. It may be that the strategy is to force the Police department / state to drop charges capitalizing on recent events which have caused confidence in the police to erode. If in fact this case comes to a conclusion that clears the officer I would sue evryone involved in slandering his or her name. That goes for the city as well as the students. Student will claim they have nothing. Well that does not fly any longer in Federal Court. Your wages upon graduation can be garnished. In fact up to 25%of your gross earnings can be garnised. I hope this young officer was smart enough to join the Fraternal Order Of Police they have great lawyers out of Baltimore that could give a rats ass about Jimmy liarton and his liberal self serving agenda. That also goes for any administrator that maliously attacks this officer bet your attorney did not tell you that. The Officer can sue the administrators on a personal level. Forget the city garnish the wages of those that violate your L.E.O.B.R. if in fact violated. Then the drunken little shit college kids that think because they pay tution they can crap down the necks of the people who actually pay taxes and live here year round. What this story, and the preceding one on Mike Lewis overstepping his authority yet again, does is reflect the monumental distrust citizens now have of cops. And, these are just two current incidents in a small rural area of just one state. One can only imagine how this inflates on a national level.

This collective feeling among citizens will only continue and probably escalate until there is change or something more belligerent.
Collateral damage is an expression any military person and many civilians understand as being the damage caused to innocents or neutrals during a campaign. That said, those professing to be or are claimed to be a 'good cop', you are the collateral damage spawned by your criminal brothers in blue. So, don't attempt to hide behind valor or deed for you are of the clique and, as you might say, an accessory to the crime.
Until major changes are made within law enforcement any and all cops are worthy only of distrust and contempt. It is something they themselves have brought upon themselves and proven over and over again.

As for SU handing over the only copy of the incident, that is WRONG! SU makes copies and to give for evidence. What ever footage was captured, is on their extremely large memory and last for a long time before being deleted. I know the officers at SU and trust me, if they can burn a cop, they will. As for SPD, it wouldn't surprise me if they are trying to cover up an incident for someone in their clique.

Jim Ireton has F*ked over a couple of good city employees because is he a spineless twofaced leader. His flip flopping of department heads and jumping in bed with his known enemies has cost him a lot of respect and I am hoping the Lore Chambers suit brings him down. I am sure if the employees that got screwed could they would also go after Jim. Time is also a factor. Hopefully he will be toast before the next upcoming election in the city.
Is Luke Rommel one of "the" Rommels? If so the pockets are deep and the lawyers will be good. Let the facts speak for themselves when presented and let's sit back and enjoy. Thanks Joe for bringing this up.

I too am in the process of filing a lawsuit against salisbury police dept. Protect and serve, what a joke. It's more like harass and arrest.

Keep in mind that the local Media do NOT want to piss off the Chamber or ANY elected officials they have an agenda with.
So if ANY of you wonder why we keep growing leaps and bounds, it's because we deliver ALL of the major news on the Shore and always have since we started.
We get information first because people know they have been burned by WMDT, WBOC and the Daily Times. Now you have Greg Bassett publishing a new FREE newspaper that obviously only shows the LIBERALS on the Shore and pampers them like children. It reminds me of the Metropolitan. You PAY to get recognized and it cracks me up every month because all I can think of is the "Who's Who" BS publication.
While I may not be the most liked guy on the Shore, at least I work harder to tell the truth and expose the things your local media walk away from because of politics and MONEY.
Do cops break the rules, all the time. Do YOU ever become aware of it, hell no. Unless SBYNews gets it. While I'm sure many people are upset that I do not stand behind Mike Lewis or Barbara Duncan, I'm not looking to be their friend. Yeah, I know. If my properties catch on fire the fire department won't put it out. If I have to go to the hospital, I'll die there. If someone breaks into my properties, I'm on my own. I GET IT. That's the price I/We pay for telling the TRUTH. GOOD OL' BOYS

Basically animals. the county council needs to do some legislation to keep them no more than 2 to a household where they rent.
The students run this city. I don't care what the cops do to them.
In any crowd, there will always be idiots. It is unfair that parents and children have to live in the same neighborhoods as college kids, but our options are quite limited. If only two individuals were allowed to live in one house instead of four, parties would still continue, but there would be twice as many college houses.

Don't you think that every cop in the area has run my name and SSN number, my address, my tag, and anything else they could get (answer? yes. MANY times) in order to find SOMETHING they could post to denigrate me?
Believe it -- if I was on welfare, or had a traffic ticket, or did jail time, or didn't pay the taxes on my 4 bedroom home, built for me in 1998 (I'm such a mooch....) or had a smidgeon of a problem ANYWHERE, some cop would have already posted it like he was annoucing the next president. So, you gave it your best shot, which was pretty pathetic, but you were TOTALLY wrong. Including the part about my family, all of whom are full time employed with good jobs.
That part crossed the line, by the way.
But I would expect nothing less from someone with your apparent high standards of class and demeanor.
Finally, I'd really hate to be a black patient under your care.

Please share with us then why you hate cops? You don't just wake up one day and them? Talk about standards, you must really been born without commonsense as well to think it's OK to talk down to an officer, most decent people are raised to respect authority whether that is a teacher, an elder or a cop but apparentry this is not so in your case. I am glad to hear your family is well employed helping the rest of us pay for society's undesirables, so as a tax paying citizen I would think you wold want cops to do their jobs and keep the streets you pay for safe. Hating a cop is certainly not the answer. There a are bad cops just like any profession there are bad and good, bad ones usually overshadow the good. But to just hate them all? Really doesn't make any sense.

Our once-great-nation rebelled against England because of statutory law. That's why statutory law is NOT A PART of our US Constitution.
The Constitution allows for COMMON LAW, CONTRACT LAW, and ADMIRALTY LAW. No Statutory Law.
Kings issued statutes. Not democratic republics.
Under Common Law we are all KINGS. We are sovereigns. All of us. Including non-Americans. We own our bodies and our property.
There can be no crimes (under common law) without a victim. Period.
Statutory Law is the excuse used for CONTROL over the public by an illegitimate government.
You must drive 55 mph. That is a statute. If you drive faster than 55 mph, you are guilty of violating a statute. However, there is no victim. No body was hurt. No property was damaged.
Drunk driving. Did anyone get hurt? Was any property damaged?
If no, then go about your business. You are a sovereign. Maybe you got lucky. So be it. You did not hurt anyone and did not damage any property.

ReplyDeleteI objectively viewed all videos. In the first video it appears that a police officer enters the crowd to affect an arrest. However, it is unknown what is said or what occurred prior to the police officer taking action. The person could have been disorderly or committed another crime. It is unclear from a traffic camera point of view. A disorderly situation can be anyone screaming or yelling loudly or otherwise behaving in a disorderly manner to the contrary of the public peace. Secondly, as we hear from the person filming "are you going to read me my rights?" or something to that effect, is also incorrect. A police officer is not required to read someone their Miranda rights unless it is a custodial interrogation. Only then is it required to avoid suppression of said questioning at a trial. Absent of that, the police have no requirement to read anyone their rights upon arrest. Such is a complete misunderstanding of Miranda and the functioning of our criminal justice system. Such is reserved for Hollywood dramas and action movies.
Moreover, while filming the police may provide someone who is not committing a crime some protections, it is not an excuse to provoke, inflame, or commit a crime. Mind that someone filming the police can still commit a crime while filming, such as yelling and screaming or otherwise being disorderly (again a general statement not specific to this case in particular). Persons in the crowd can be heard yelling profanities loudly.
There is such a thing as freedom of speech but as an American you do not have absolute freedom of speech. For instance you cannot incite a riot or breach the public peace. You do have the right to peaceably assemble with a permit, which is not the case here.
At the point where the police officer was arresting the suspect you see members of the crowd start to walk inward. The police officers orders them to back up. One person does not comply and continues to be close to the police, thus resulting in his arrest. This is also a disorderly statue violation, failure to obey a lawful order of a police officer and obstructing and hindering a police officer. The police, being only one or two officers with a large group, have an absolute right to their safety and security. Those officers do not know if someone in the crowd will assault them or otherwise interfere with an arrest procedure. Yelling loudly, it itself, if witnessed or creating a public disturbance in and of itself is illegal. People seem to forget that especially when recording the police.
Police officers have an absolute right to use the proper amount of force to affect an arrest. At no time did it appear that anyone was beaten, shot, or otherwise abused or mistreated. At this point I did not observe the police acting unlawfully or abusing any authority afforded to them under the law.
On the heels of Ferguson, citizens think that because they record the police, it gives them the right to abuse the police and carry on however they see fit (speaking generally, not specific to this situation). It is the contrary. The tendency to think that police officers taking police actions is abusive is incorrect. In this instance, what we are to believe is that persons, minding their own business, walking down the street were attacked by the Salisbury City Police, is completely incorrect and inane. Allowing persons to yell and scream in the street is the definition of disorderly conduct. Failure of police to take action results in lawlessness. Lawlessness begets anarchy.
As a society we hang on a dangerous precipice of managing civil liberties with complete lawlessness due to societies lack of understanding of laws and abuse of police authority. As a big believer of the constitution I firmly believe in our civil liberties. However, they have limitations.

ReplyDeleteI guess it is a generational thing, but maybe it is a sign of the times. I am 54 years old and have been stopped multiple times over my lifetime. I have always been respectful to the officers who stopped me, and I have never had a problem with them. I do recall having been stopped by one or two who I didn't like their attitude but I knew that if I matched my attitude to theirs things could go a whole different way.
ReplyDeleteI have been issued a few tickets, but mostly warnings, which I thanked the officers for, and I never subscribed to the theory that I could "talk down to them." Sure, I guess I could. They could also find a way to take me to jail. I don't always agree with the laws of the nation and I really get a little angry when the politicians and government officials don't follow the law and yet expect me to follow it, but I do not blame the officer for that. I also recognize that there are some bad apples on the police force but if we go into the situation with the idea that "these are my servants and I can talk down to them if I want to," then I think you reap what you sow. Trouble. No one is my servant. Even from the point of view that I may pay their wages, they are not my "servants" anymore than I am a servant to my employers. If my employers were to start "talking down to me and treating me as a servant," they would soon be looking for a new employee.
But again, maybe it is just a generation thing. I was taught to respect authority, to have respect for my elders, and to obey and respect my parents. I don't think that many of the youth are taught these things.

ReplyDeleteThey have been changing police reports for some time, that's how they fudge the crime stats. If a door gets kicked it, they count it as destruction of property rather than a burglary and since there is no suspect, there is no report and the victim is just given a case number for their insurance. The Feds really need to investigate this corrupt agency.

You sound like a brochure and about as classy. Your whole statement is wrong except the part about the dept. being funded by tax dollars. They do indeed work for us and the city can disband them at any time. Which I think they should. Get another agency to cover Salis. or hire all new.
