After extensive consultations with the State’s victim and chief witness, the State will dismiss the case against David Nettles (State v. Nettles, K-12-0650) on February 24, 2014. While the victim continues to maintain the truthfulness of his allegations against the Defendant, he has advised the State’s Attorney’s Office that he does not wish to testify against the Defendant in a third trial. The victim/witness has previously testified in two criminal proceedings against the Defendant. These two trials ended in a mistrial due to a hung jury, i.e., the juries could not agree upon any verdict by the required unanimity. The victim/witness has also participated in several administrative proceedings relating to this matter. The State respects the victims’ position and will enter a nolle prosequi (a dismissal of all charges) once the case is called this morning.
As in all criminal matters, the Defendant is presumed innocent unless the State satisfies its burden to prove his guilt beyond a reasonable doubt.

Good for him. The charges were b.s. and should have never been brought to court! What a scam on him for his defense fees and on taxpayers. There are clear cut criminal offenses occurring daily which nobody has the ba**s to touch!

Looks like the local pinheads got what they really wanted which was to remove him from his coaching position. He's really a nice guy and would've left if they just asked him to. They really didn't need to fabricate this whole thing.
