Incredible Accusations Against Berlin Fire Department

Below is just one part of the accusations against the Berlin Fire Department. Read entire court document HERE

24. On or about December 26, 201 2, the Plaintiff was on duty as a Paramedic/EMT when a call was received for multiple ambulances to respond to an automobile collision to attend
to several seriously injured occupants of the vehicles. Mr. Tyndall responded from the Berlin Fire Company. When Mr. Tyndall arrived on the scene he immediately went to assist an injured
occupant. It took him considerable time to assess and stabilize the victim for transportation due  to the seriousness of the injuries. Mr. Tyndall had to continuously "bag breathe" the patient to
maintain respiration. During this time, the victim had to be cut out of the vehicle. Eventually, Mr. Tyndall was able to get the patient on a stretcher. However, when he requested assistance to
get the stretcher to the ambulance, members of the Berlin Fire Company on scene refused to assist him in moving the stretcher to the ambulance. There were a lot of members of the BFC on
the scene including Defendant Trimble.

  2. If that all happened as detailed then BVFC has major issues and is going to loose their arse. With other outside witnesses such as police officers and the volunteer fireman clearly this case will be easy to prove.

  4. Same bunch work or volunteer for both, Ocean City had an EOC lawsuit last year, same two or three involved. A county run ambulance service would go a long way to stop these boys from resisting change to the new laws and expectations. Berlin, hold their money, and stay as far away as possible. Berlin Fire REHIRED the supervisor that witnessed these acts, how dumb (or defiant) is that? HELLO!

  5. 12:30 That's not a fair statement, that's what you get with a volunteer fire department that has backwoods leaders, and resist change. Anyone that knows the current President (Fitgerald) Chief (Brown) and trustee (Holloway and hen) sees through this entire ordeal as the demise of a once great department. The members elected this group, and is every bit as responsible.

  6. I think this has already been completely investigated by the Maryland State EMS if you remember the papers from January--this is old news
    you are right 12:20 careful what you wish for--if the town is going to be a paid fire and ambulance department get ready for a tax increase Berlin residents--we might not personally like the volunteers but they are FREE labor

  8. This is not typical of a VOLUNTEER or combination fire department. There are many fine departments surrounding Berlin. Berlin has long been known to dance to their own song, now it's time to pay the piper. Everyone knew this was coming, now just what they do about it is unknown.

  11. Now Trimble is on stress leave as well as Holloway and donohoe...It is fear that then are feeling NOT Stress. This is a classic case of we can dish it out but we surely can not take it.

    When BFC did a training on ethics (after the town took funding back) during the training B. Trimble was jumping in and out of the radio room. Laughing and not taking the training . Oh and old Trimble was grabbing the speakers butt while he was trying to introduce the trainer. Laughing and saying do you feel harassed.

That's the point, they want $600 from the town, they get $500 from the county and state, then comes the private donations from business and homeowners that believed in them. I would much rather have a professional fire/ems service that I could count on. They spend like drunken sailors, party like rock stars, and harass who they want. NO MORE!

  15. 12:53 Trimble did the same thing in OC, and almost got him fired. I heard he lost a ton of money in the undisclosed settlement in lieu of unemployment.

  17. You can not blame it on the Fire Deptartment. I know these guys personaly and they are a great group. Yes it is a good ol boys club but so is the police dept, vfw, legion, hell any organization. Dont make a few bad apples make the tree bad

Have you never stepped forward when you saw a parent beating the crap out of a child in public or verbally abusive? Have you never defended your Wife when someone in public swears out of control?

    Of course this is one side of the story but should the information prove to be accurate, SHAME on ALL of those Firefighters who stood by and allowed it to happen. And I say ALL because, (it would seem) no one defended this man.

    Finally, interesting how some are still on here attempting to bully him further ANONYMOUSLY. Yes, I've rejected several comments already.

  20. 1:50 I beg to differ, ask any paramedic short of Trimble himself, and any doctor in the area, and any staff at the State level, Barton is respected as one of the best. Clearly this is going to become a smear tactic to get away from the facts. Barton demoted Trimble, see the motive? I worked for Chuck for 28 years, your going to have to do better than that.

  21. 1:50 It appears Zack complained to the OCFD Deputy Chief not about what happened there, but about the affects the harassment had on his health. Little could be done there. Zack took a long leave of absence from OC, and didn't even work with Simpson and Trimble there. With OC's deep pockets, had they acted wrong, surly they would have a lawsuit also, and much larger.

  28. I think if you go and read some older newspapers that the State ambulance folks investigated this and sent the mayor a letter that the case was closed and allegations were unfounded. I am not sure what was the outcome )but don't think the fire company was found at fault. like the other comment I am curious who the people were on the call

    The "state" is not a court of law so the case is not closed. Get a grip you idiot!

  30. Isn't Trimble the same guy who's Father-in-law got arrested and fired from the Town of Fruitland for stealing from public works? Isn't he a member of a volunteer fire company as well?

    Worcester and Wicomico Counties have the same problems. EMS is ran by local good ole boy volunteer fireman. The county should take over EMS in both counties and make everyone held accountable. When are the elected officials going to wake up.

  44. Just finished reading all 13 pages of Tyndall's complaint...looks to me like the Ocean City fire dept better lawyer up & get prepared! I see a storm coming their way in the near future & I am not talking about a Hurricane either!

    You "get a grip." This case is going to be ultimately lost by the plaintiff if it does end up going before a court. The "state" has a lower burden of proof than "a court of law" "you idiot." If the "state" found no fault there no way in hell a "court of law" will.

  49. that is correct about Salisbury--the only reason all this is exaggerated is Mayor Gee Williams is a press guy for the State and has time to release all this information and put his quotes on it while the fire company doesn't talk at the advise of their lawyers. Mr. Williams doesn't want to solve the problem either just keep it stirred up. The Town is not accountable either. As a Berlin taxpayer, where has the money gone they took from the fire company? I sure did not get a refund check!

    I can see, a motion to dismiss for failing to state a claim, filed by the defense, as being successful and there is no doubt this motion's been filed by now.

    Even if the plaintiff were homosexual it would still be a stretch to try and apply this particular law to this suit.
    Possibly a defamation type suit would stick but that's about it with individuals liable only- not fire company.

    I haven't anything to do with Berlin nor any other fire department 12:12.
    I have a question for you though. From where did you receive your law degree and what local/state/federal investigatory bodies (non-LE) have you ever worked with?
    If you knew even slightly what you were talking about you would know people are being sanctioned, licenses suspended and even revocation regularly.
    I hope you aren't inclined to make such ignorant statements in public. Do yourself and your family (to save them from embarrassment)a favor and go away from your Podunk space and see what goes on in the real world because you are so clueless it's funny.

  55. This is not a federal case and is going to end up in the circular file so to speak. Title VII does NOT provide for protection from discrimination based on real or perceived sexual orientation. Sexual orientation isn't addressed period.
    As far as EEOC, they receive tens of thousands of charges every year. Most lawyers and judges realize that EEOC does not have the resources or ability to perform an in depth investigation of every charge, so they have to let most of them go out of their system with a Notice of Right to Sue or Notice of Rights (as it is sometimes called.)
    Basically why this is done is because someone can not be deprived of their right to sue or at least file a suit.
