Gun Bill Overview

What are the provisions of the O’Malley-Brown Gun Bill? The following is a general overview to help you navigate the most significant changes to firearms laws in Maryland following changes made through SB-281 as it passed in the House of Delegates and received concurrence in the Senate.

Firearms/Magazine Changes

  • Exempts all law enforcement officers (active and retired) as well as military personnel from the provisions and restrictions of this act.
  • Designates certain rifles as “Assault Long Guns” on a compiled list which currently contains 45 firearms (including many popular firearms such as the AR-15 and the SKS as well as any of their “Copy Cats”), and bans these delineated firearms for sale in Maryland as of October 1, 2013.
  • Continues the current ban on “Assault Pistols” as delineated on the ban list (has been in effect since 1994).
  • Restricts magazine capacities for all firearms to 10-rounds or less and prohibits the sale of any magazine capable of holding more than 10-rounds.
  • Assault weapons may be transferred through inheritance, and the heir may take possession of the firearm so long as they are not otherwise disqualified from possessing a Regulated Firearm.
  • Assault weapons and magazines may be sold to persons out of state.
  • A person who has purchased or otherwise ordered a banned firearm prior to the October 1, 2013 Effective Date will still be allowed to receive the firearm and possess it even after the Effective Date.

Manufacturers of Firearms

  • Manufacturing facilities are generally exempt from the requirements of this bill.

Licensing Requirements

  • Creates a Handgun Qualification License. In order to purchase a Regulated Firearm (handgun) a person will need to take a Firearm’s Orientation Class consisting of 4-hours of classroom and range training which will cover: state firearm laws, home firearm  safety,handgun mechanisms and operations. The range component of the training includes orientation specific to the firearm involving safe handling. (If someone previously owned a Regulated Firearm, the Firearms Safety and Orientation Class is not required. Also the Maryland Hunter Safety Class/Certification can be taken in lieu of the Firearms Safety/Orientation Class as required.) The person seeking  licensure must also fill out the appropriate application with the Maryland State Police and submit a full set of digital fingerprints. Following a full background check and revue of the applicant and completion of the Safety/Orientation Class, the Secretary of Public Safety shall issue the applicant a Handgun Qualification License which shall be good for 10-years. There are fees associated with this licensure process: $50.00 for the Application Submission coupled with additional fees to be payable to the Central Repository for fingerprint review as well as a separate fee charge for the FBI for their review. There will also be a charge for having the fingerprints received into the system. While some of the fees fluctuate, it is clear the cost for an initial Handgun Qualification License will cost well over $100 payable at the time of the application.

Ammunition Changes

  • Bans a person from possessing any ammunition if they are disqualified from possessing a Regulated Firearm.
  • Bans certain types of bullet compositions (so called “cop killer” bullets)

Mental Health Provisions

  • Restricts a person who is the subject of an Involuntary Commitment from possessing any firearm and requires them to surrender any firearms in their possession to law enforcement for safe keeping. It also provides for a way for an individual to be granted relief from being Disqualified to possess a firearm. This process involves a hearing review and there are fees associated with this process.

  • Applies these restrictions to persons under a Current Ex Parte Order and Orders for Protection.

  3. Martin really needs to be referred to as "Cool Luke". The bill itself is appropriately named O'Malley ('s) Brown bill because it's a genuine piece of ... The many polls made it clear that this bill was NOT what citizens wanted yet "they did it anyway". Sorry but your Governor is no longer working for you, he's working for his Party. Too many people conclude "why vote" yet it is often them that did not. The recent Salisbury voter turnout was PATHETIC.

  7. I'm sorry to say this but my blood is boiling. The local, state, and federal gov't has failed us. We see where they place their priorities. Gun bills, gas tax hike, and theiving hard working tax payers dollars. What ticked me off was "cop" killer bullets. All bullets are made to kill, maim, injure, and harm. These guys have no fricking clue. Dumbasses that think they are "more edumacated" than some of us eastern shore boys and girls. Bad news fella's we know better. Del. McDermott said it right about the fuel tax, make sure that that money paves the roads leading out of the state, cause that is where people are going to go to buy ammo, food, fuel, cigarettes, firearms, etc. Damned retards. O malley can kiss my ass. I'm getting me one them "assault rifles" and guess what. It's my constitutional right. If DHS can get 7000 M-16s I can get what I want. You can't tell me what to do, The constitution and Bible tell me what I can and can't do, which created morals in my life. And if OBAMA and OWEMALLEY don't like it, they can shove that apple up their ass!

  9. I no longer want my registered guns. They are worthless now in this state on the legal market. I can sell them now to the criminals for triple what I paid for them, and just call them "stolen"! I'll keep my unregistered ones, though! This is a sad day for Maryland. I'm leaving. And I'm taking my 3 employee company with me, just like Beretta is doing.

    1. He can brag all he wants. He just better make sure it's registered. How many rounds does his magazine hold? How many rounds of "cop killers" does he have in his possession? Does he have a trigger guard and have it locked in a box? Owe'Malley sure picked a fine one to serve as his liaison to the community. I guess getting fired by the DNC wasn't reason enough to keep him from representing a con artist like Owe'Malley

  13. Good job maryland. Prohibit the law abiding from purchasing/possessing but do nothing to those illegally possessing/using in crimes. Where are stats to support you so called "assault weapons/rifles" or magazines capable of holding more than 10 rounds are routinely utilized in committing crimes. Where is the money and programs to help identify/treat the mentally ill?

I know most of you think of gangs or hardened criminals when you think of people who can't 'legally' own a firearm, but there are plenty of people out there who can't own one for a variety of reasons. And it could have happened when they were teenagers but are disqualified for life. A lot of these people own guns anyway. Many of them are just like any of you so called 'law-abiding' folks, they just broke some law that says they can't own guns. That's how they got their foot in the door to take guns in the first place. And we all know government likes to expand, not give up power.

  22. If you own or purchase an AR-15 or similar rifle prior to Oct. 1, 2013 you are allowed to retain possession. You may not sell the rifle within the state, however you could sell it to anyone out of state. You may transfer the rifle to your heirs through inheritance.

    I was also wondering if I could legally purchase something like an AR 15 in another state and bring it back to Maryland? Will out of state gun shops refuse to sell to us if we live in Maryland? Looking forward to your response.

  26. Still working on getting EMS better organized. So far it looks like we will be bringing small groups of like minded people together. So far just where I work there are 4-5people that have a interest, form all the coments on here I see many more. so it looks like a good time to get the ball rolling.   29. Rudy Jim and norm? They voted no, but that doesn't matter, they are members of the party that did this to you. They didn't stand up once to stop this. They didn't even offer any amendments. The dem party bosses, millef and bush, allowed them to vote no on the bill brcause they had enough western shore dem votes to pass it. Next, all of you Mo-rons with the tough talk, are you willing to work at the next election to get the dems that did this out of office?

    They bought hollow point ammo. They are not designated as 'cop killers'. Cop killer bullets are the one coated with a substance, Teflon I think, to defeat body armor. While hollow points, and any type of ammo, will kill a cop or anyone else, they are just designed to expand upon impact and do more damage than solid core bullets. They are also illegal to use in wars, by international treaties. (U.N.)
