On February 4, 2013, James David Nibblett, Jr., age 48, of Berlin, Maryland, was sentenced on one count of Driving Under the Influence of Alcohol as a subsequent offender. A Wicomico County Circuit Court judge sentenced Nibblett to the maximum sentence under state law: 3 years in the Maryland Division of Corrections, with all but 1 year and 1 day suspended. Nibblett will be subject to 3 years of supervised probation upon his release from prison. This sentence was in addition to recent sentences that were previously imposed in two other similar cases.
On October 19, 2012, Nibblett appeared before the Wicomico County Circuit Court for a separate Driving Under the Influence arrest. On that date, he was sentenced to 2 years in the Division of Corrections, with all but 1 year and 1 day suspended. Less than a week later, on October 25, 2012, Nibblett appeared in the Wicomico County District Court and was sentenced to 3 years in the Division of Corrections with one year suspended on yet another Driving Under the Influence case. These three convictions represent Nibblett’s four, fifth and sixth convictions for alcohol related traffic offenses.
Wicomico County State’s Attorney Matthew A. Maciarello commended the Maryland State Police and the Fruitland Police Department for their work in the investigation and prosecution of these three cases. Mr. Maciarello also thanked James L. Britt and Jared Monteiro who prosecuted Nibblett. Mr. Maciarello stated, “The 8 year sentence received by this defendant, which includes 4 years of active time in the Division of Corrections, is a strong message to repeat offenders that driving under the influence and driving impaired will not be tolerated in Wicomico County.”

ReplyDelete"will not be tolerated" UNLESS the defendant have enough $$$$. I know 2 people in particular with 6 and 8 DWI's respectively, and neither has done more than a few weekends in jail.
ReplyDeleteWhile I agree that 6+ offences of this type should land you in jail, it is just another racket. Us lower-middle class and lower class don't stand a chance to defend ourselves, while those with money to throw away get away with murder.
So I read this article as.. "Mr. Niblett could not monetarily afford to reduce his sentence, so he will be going to jail." As opposed to "High profile rich guy,
Mr. Rich, bought his sentence down to a couple weekends in the clink."
What a joke...
So... the statement at the end should read "The 8 year sentence recieved by this defendant, which includes 4 years of active time in the DoC, is a strong message to poor repeat offenders that driving under the influence and driving impaired will not be tolerated in Wicomico County, unless you have the $$ to burn."

That's exactly where he needs to be! He has been heard saying that He would never have to serve time. They should have kept it at 8 years. Just thankful this alcoholic didn't kill someone or some child while he was driving.
ReplyDeleteWe need to be sure that all repeat offenders get tough treatment...and first offenders get the message. Too many are plead out....it is easy to see who gets what on the Maryland Judicial page...no deals please.
ReplyDeleteThe paper trail leading up to this point needs to be published for all of us to read.We would like to see how the justice system handled each of his priors and why he still had legal driving priviledges.We need the names of each judge and any legal parties involved.We don't feel like having to dig for it in the public information realm.

ReplyDeleteWhere is the DRUNK DRIVER REGISTRY ??? We need to get a drunk driver registry as we have with the sex offenders in this state so we know who these drunks are and protect not only our kids, but our whole family from these drunking fools before they kill.

ReplyDeleteOn Monday Novenmer 4th he was seen leaving a bar drunk after many hours of drinking. They let him out and hes at it again......guess there are two sets of rules for this guy. Its not if he will kill someone on the road its when......I hope the family of the victim sues this scumbag drunk as well at the State of MD and the court system that let him back out. FOR THE RECORD FOLKS HE IS STILL DRIVING DRUNK
