Here are some highlights from the article.
The Culpeper town spokesperson says the officer's cruiser did have a video camera, but that it was not working. He also said the officer did not turn on his blue lights. If he had, it would've been a sign that he was detaining the person, says attorney and former Fairfax County Police officer Ted Sibert . If the person is not being detained, she should be free to go, Sibert says.
"What is he investigating? if its just for we call a suspicious person, then he doesn't have jusification to use force to maintain the contact. So if the person wants to roll the window up, they can. He can't be sticking his hand in the window or pulling someone out of the the car or open the door. Those all need justification," Sibert says.
Sibert says that before an officer tries to stop or detain someone, he needs reasonable suspicion that a crime has occurred or is about to occur. Trespassing is not sufficient, especially if the person is trying to get off the property. Furthermore, to charge someone with trespassing, you'd need proof the person knew she was trespassing. Was it clearly marked? Did the property owner tell the person to leave?
Sibert says if the officer did put his arm in the window, he needs to have reasonable suspicion a crime was committed or about to be committed. Virginia State Police have said nothing about why the officer was detaining Cook in the first place,or, in other words, why he was putting his hand in her window, if in fact that's what he did.
And in this video of followup there is another witness who mirrors what the first witness says. I smell cover-up. It mentions second witness around 2:10 in the video.

So how could she SUDDENLY roll up window and trap cops arm?
I smell COVER-UP. Cover-up to MURDER.

Yep, another cover up. Nothing new here. Cops trying to keep a good look in the public eye. I dont care what any of you people get on here and say about how we need to follow the law and blah blah blah the police have now taken over. They feel as if they have the right to force whatever their position is down your throat and also in a literal sense, law or not becaue "they are the law." No video on the Alex stop, a video of a murder that just happened to "not be working", if this werent a cop then they would be getting investigated by the cops for being a suspect because just how many conviences are they allowed before someone checks out the situation? This is too sketchy and I think the public deserves the right to feel safe....even from cops.
ReplyDeleteI followed up on the Marine Sgt. that got killed by a cop in front of his two daughters.
ReplyDeleteWhen the story first came out the cop said he feared for the safety of the two girls and that's why he shot the man.
In one article today, (there were a few), the cop says he was driving fast and in an unsafe manner then crashed through a gate to get inside the school.
He got out of his car and started walking toward the track where they go to walk and do bible study.
One article says the cop told him to stop but he just keep walking.
Then it says the Marine turned around and started walking back to the car, which the cop was near.
Then the cop says he felt threatened by the Marine so he shot him.
It seems to me the cops' story keeps changing and modifying itself.
Everyone spoke highly of the Marine.
Of course all the facts and autopsy are not in yet. But this case smells also.
First he was concerned about the two girls, who was the Marine's daughter, and now the feels threatened by the Marine.
Which is it?
For some strange reason, (sarcasm), I do not believe the cop.
These types of things are happening all too frequently. It seems the cops are out of control.
Time will tell what the true facts are in each case, IF they don't get swept under the carpet.

Yes, you are correct. I hate cops who MURDER people. I hate cops who lie. I hate cops who abuse their power. I hate cops who abuse people. I hate cops who falsify testimony, reports, and anything else they lie about.
I hate cops who break the law, and I hate them when they get away with it.

Understand ONE thing and thats all you ever need to understand. The police are ASSUMED to be right and behave in a lawful manner (the "color of right") in every single local, state, and federal court in the country. Unless there is overwhelming and incontrovertible evidence otherwise, which there RARELY is and even in cases where there is such evidence, they are usually cleared by their own investigative officers (nothing like have the police investigate their "brothers" to determine who was wrong). Although it sounds like this particular cop is being boxed in by the facts and witnesses that show he essentially EXECUTED an unarmed 54 year old woman, the chances are that since his video camera "wasn't working" (coincidence??), its HIS story that will be believed. Welcome to the machine. By the way, when "we, the people" get questioned by the Gestapo and start giving different versions of what happened (especially versions that contradict witness testimony and facts (like the roll up windows pinning his arm), what do the police naturally assume? Answer? "we, the people" are HIDING something, that "something" usually being "guilt". My symapthy for the woman and her family. Thats about the best she's going to get from the whole matter. Protected and served. Again.

People like you never cease to amaze me. This cop and I suspect you also, would rather climb a tree and tell a lie than stand on the ground and tell the truth.

Who exactly are the cop haters? The people commenting on this blog?
The TWO witnesses that contradicted what the state police said happened?
Or maybe the cop that shot and murdered the woman is a cop hater.
Murdering someone while in uniform, with TWO eyewitnesses is guaranteed to draw the public's ire.
Seems to be quite a few 'cop haters' if you ask me.
I wonder why that is. Do you have any idea why so many would hate cops?
