Proposed Plea Agreement For Thomas Leggs

The following is the proposed plea agreement between the State of Maryland vs. Thomas Leggs for the murder of 11 year old Sarah Foxwell.

1. Life with no chance for parole for the murder of Sarah Foxwell.


2. Life with no chance for parole for the rape of a minor.


3. 30 years for the kidnapping of Sarah Foxwell.


4. 20 years for burglary.

Each part requires Leggs serve each sentence consecutively. It should be noted, ANYTHING can change between now and the time the Judge bangs his gavel. We will provide more details immediately following the hearing. I will not say anything further until we return. There is an expected press conference right after this hearing is complete.

We will explain WHY tomorrow. As much as I'd like to do so now, it makes more sense to wait.

  2. I guess, as long as the sentences are consecutive and not concurrent, I can live with that. Death penalty would have been more appropriate, but they wouldn't do it anyway...looking forward to the why...

  3. The biggest reason for this other than the DNA evidence is Maryland's liberal agenda. Our death penalty is a thing of the past. From now on we'll just coddle these criminals and give them a big hug and tell them everything will be ok. After all, isn't someone's vote more important than any moral or ethical value? Isn't a vote more important than the Constitution? Isn't a vote more important than prosecuting ILLEGAL immigrants?

    We need to keep the Bible our of our lives unless its in our living rooms, and we wonder why we are witnessing the things we are.

  4. Its been proven time and time again that the death penalty is more expensive than a life sentence.. The cost argument is moot..

    But justice being served? That's a different argument..

    Public hangings still have a place. For cases such as this. This isn't a mistake, not someone who will be found innocent someday on appeal, the death penalty should be immediate and swift. Too bad it isn't.

  5. Being an optomist and believing things happen for a reason, I think we all need to step back and look at the big picture here and that is Sarah. She unfortunately died at the hand of this sick individual and many of us became deeply involved in this case both emotionally and physically. If you take a step back there is no one to blame for the absence of the death penalty, it's like many people on this blog have stated it's a very hard punishment to get not only here in MD but other states as well. That being said if he gets the 2 life sentences on top of the 50 yrs total for the other two crimes listed and it all runs consecutively it becomes a situation that our God will handle and determine Leggs fate, either he will die of natural causes, pain inflicted by others or even possibly himself but in the end he will be held responsible for his actions. With that being said I personally do not feel Davis Ruark or any of the attorneys are to blame, for the many thousands of people that assisted with the search efforts for Sarah they all saw first hand how hard and tirelessly Ruark, and his staff combined with the hundreds of law enforcement officers worked on this case, there wasnt a leaf or stone that went untouched hince the reason Sarah was found. We all gave it 1,000% and we all felt the pain so lets let this case play out the way it plays out, the man upstairs will guide the hands in the right direction if you allow him to, opposition only creates tension for all. There is obviously enough evidence in this case to prove beyond a reasonable doubt that he is guilty of the charges mentioned or he would not be recieving the sentences stated for each crime.   9. This is far better than waiting for endless appeals and retrials all the while losing a little bit more of a chance of obtaining a conviction. This is the right decision...if the judge even accepts the plea. people need to understand how virtually impossible it is to actually obtain a death sentence. While the eastern shore is conservative, the almost entirely liberal western shore had made the death penalty impossible to accomplish. Let this disgusting sob rot in jail, with all of the the other folks waiting to get their hands on him.

    Everyone is acting as if Mr. Leggs is getting to go home to a keg party tomorrow. That is not the case. He is facing justice, and will serve out the rest of his life behind bars.

    Death penalty or not, his life is over.

  12. While I think what happen it awful, the law is the law. Whether it protects the guilty or not, it is what it is.

    Since the deal has been made, instead of btching and whining, about something that was not in our control, lets start being proactive about protecting our children, our future.
    Educate yourselves about sex offenders. And God forbid you see an offender dating a women with children in her care, speak up, call the police, call the courts. Let them know. Don't turn a blind eye, because you don't have time, make the time.
    We all failed Sarah Foxwell, her birthparents, her caregivers, the courts,the communtiy,and every person who knew her aunt was dating a sex offender.
    Get over the finger pointing and take a look in the mirror folks!

  15. I for one want to know why this is happening today. If there's been a plea agreement it means he will agree to all that Joe listed. If all of them are consecutively, he'll never see the outside world again. He deserves to be in the general public part of the prison. Any idea where he'll be housed?

    Thank you to all of those who worked on this case from the moment they discovered Sarah was missing. This includes everyone who showed up on Christmas morning. This beautiful child brought all of us together. We will have her in our hearts and minds today as we wait for the news. Sarah will never be forgotten.

From the moment he was charged and Ruark stated he would seek the death penalty, Leggs has cost this state a small fortune in public defender fees alone, not to mention transportation costs hauling him around the state for various appearances. IF the death penalty was sought and handed down, the costs would skyrocket with at least 12 years of appeals and the fact he would have to be isolated on death row. The death penalty is soon to be abolished in the nanny state of Maryland so why waste the taxpayers dollars any further. If this is correct and the terms are to be served consecutively on top of the 10 years he is currently serving for his perverted acts and burglary in Ocean City, he will die in prison. He will die of old age or at the hands of an inmate trying to make his bones. He won't kill himself, he is to much of a coward for that. His family can then make the decision to either return to Maryland for his body or let the state bury him in Potters field.

    I wanted to see him get the death penalty as much as anyone else, in light of our pansy assed general assembly and worthless governor's push to abolish I am now of the opinion that this is the right thing to do. Cut our losses and let the countdown to his death begin.

    One request I have for our SA, please stipulate that Leggs have no computer or Facebook access as so many other prisoners do in our criminal warehouses.

To spend every day for the rest of his life--and he is young--in prison and endure all that he must there will be much more difficult for him than to have a shot that will put him to death in just a few minutes. All those years of prison will give him lots of time to think--and to suffer.

  25. I agree with 9:58, it's all about votes. Ruark and his supporters used this case in a disgracefull manner when he ran for reelection. The voters were smart enought not to vote for him and he should have been removed from this case at that time. It was all politics from day one.

  26. I hear all the time about how other inmates hate the sex offenders, and they will get them. How many have we really heard of this happening to? Maybe Jeffery Dahmer, but locally I know to plenty of people who have been locked up only to come out unharmed and do it again (maybe even Leggs, not sure if he got time for his first go round). I hope that justice in any form will find Thomas Leggs. He is a defective sub-human, and should be put down.

  37. Agreed 5:26am. It's a shame Maryland is too liberal to execute such a monster on a rock solid case. I am very proud that the SA and Mike Lewis stated that they both think Leggs deserves to be executed.

    I agree with this plea, only for the fact that Maryland is looking into repealing the death penalty.

    Matt did a great job explaining the plea, addressing concerns, and addressing Leggs' appeal options.

    I hope this monster is murdered in prison. The day this happens should be made a county holiday.

    How can anyone say that keeping Leggs for the rest of his natural life would be less costly than putting him to death? Thomas Jefferson stated that after you find someone guilty of a crime punishable by the death sentence, you carry-out that sentence the next morning! Our Founders were No Bleeding Heart Liberals! Agree with many that his fellow-prisoners may just carry-out a swifter justice than the courts did...

  39. being the mother of a young girl, there is no justice for this man and the death penalty would be too lenient. after initial disappointment of hearing the news it seems that this may be the best course to go. a plea of guilty means no appeals and additional trials for years to come. it also will allow many innocent people to avoid being victimized by the details of the case. it will save the innocent sister from having to testify in the case along with numerous jurors who would have to relive the events. and working with inmates in the past there is no worse criminal than a child molester. even people who have killed their own mother look down on child molesters as sick individuals. i am sure there will be a felon who would love the infamy of killing the one man most people in the state would love to get their hands on. it may not be today or tomorrow but it will happen someday, and this monster will suffer a far worse fate than the symbolic "death penalty" in the state of maryland, may he rot!

Just another poor us moment, if they had been better people in the first place that poor little girl would still be alive. Also, why hasnt the aunt been charged for bringing that child molester into the home where the children were? I think that family is just as much to blame.

  45. I'm curious how execution costs more than a life sentence. Let's say 50 years at 70,000 per year.. which is the national prison system cost accounting.. comes to aroung $3.5 million dollars.

    I'm faitly positive that money could be used more effectively than giving this lowlife three squares and cable TV for the rest of his life. I can only hope he will be brutally murdered in prison. It's time to draw a line in the sane with these animals. Save your compassion and your bible passages as religion is a poor refuge for the weak and frightened anyway. But sarah is a beatiful child that always will be remembered and may God hold her tight and sometime meet her family again. I prayed the day she was missing and was ready to help..to the funeral day,it was all sooo sad! I wish and hope her family is at peace and happy with their desion and we should support that!

  56. ok... first of all, I am very disappointed in the outcome of this case and the grandmother. as a parent and a grandparent I can understand the hatred,anger and wanting someone to blame. but please. lets stop and think... We were the community that pulled together and searched for this innocent child on christmas day. I felt for the 1st time, content, knowing that we were all doing this together as one.. we were all on the same page and after one outcome. although we did succeed in finding Sarah, it wasnt the outcome that we had all hoped for. If for one minute I was to put myself in her parents or grandparents shoes, I would not have been able to wait 15 months and 6 days to attack someone that I thought was doing wrong by me or my family and especially a innocent child that meant so much to me. I dont always agree with Joe, but I am the one who chooses to type in sbynews.com. I do not know Joe personally. But I cannot believe that someone , that is a grandparent and parent himself, would ever be so deceitful to sink to this so called level to prosper off of Sarah, someone that is so dear to many of our hearts. furthermore to claim Joe as the same as Thomas Leggs, are you kidding me. This guy will be living on our dime until his life is done. May God be with him. He is going to need and want all the help he can get.

FACE the fact people it is a SAD matter and the DOOR was in fact opened for him with welcome arms out reached and we as PARENTS can't expect the government to protect our KIDS when they can't even balance a budget without fighting and as for the S.O.Registry we all know it is a joke and a very costly joke that is only costing more every year and not one crime that we know of have been stopped by having the list and if it is stopping Sex Crimes then maybe we need drunk driver / spousal abuse / drug dealer / gun offender registries and all crime would stop.

Ive been tossing this news around in my head ever since i heard it today.....I think we all wanted nothing more than for Leggs to get the death penalty, but you have to look at it from the family's perspective also they unanimously decided not to go for that because of the life long process they would have to endure. They were able to get CLOSURE today, they got answers to questions that Im sure have been haunting them since her death. However is it really so bad in our prison system, I mean full access to the weightroom, 3 hot meals a day....doesnt sound so bad to me. Ive read the comments about him being locked up for the rest of his life and having to think about what he did being "punishment enough" really???? Please people he will have it made!!!! My hope is like alot of yours that someone will befriend him and show him just what it feels like to be violated against his will. Sara rest in peace dear precious child, we as a society have alot of work to do to continue to keep monsters like Leggs off of our streets and out of our neighborhoods!!!

  66. The ghost of Ellwood Leuschner returns. This isn't the first time this has happened. There was no death penalty when 2 little boys were raped and murdered here in Salisbury in 1977. Now in 2011 and still no justice for our children. Perhaps Leggs will be murdered in prison as Leuschner was. However, Leuschner got to live over 21 years in Maryland's prison system.

  67. Joe I am really sorry that the grandmother decided that she needed to bash you of all people.This is the first time that she has ever spoke up that I have seen. But you have been with this from the beginning and for that I THANK YOU. I hate to say this but maybe the family should look at themselves before they bash you or the other's that tried with all there heart and soul to be helpful when it came to Sarah.

    As for the DIRT BAG Thomas Leggs my hope and prayer are that he will suffer a slow painful death and it's said to say that I will not feel sorry for his family. They knew what a monster he was and yet his father allowed him to go into home's just to profit his own business. They didn't care about our children either. Nor there own grandchildren that lived with them while they had this monster living there as well. Hopefully someone thought to check on the children that were handed to him right in his own house. I can only hope and pray he didn't harm them.

Maryland's Governor, and our elected officials don't believe in the death penalty anyway. So put him in prison, general population, and let someone else take care of him. He is a waste of breath.

  71. 5:59, you're not implying that access to a weight room and three hot meals a day equate to freedom, I hope. I wouldn't say that "our prison system isn't really so bad. Mr. Leggs is young and may live for another 60 years. For those almost-22,000 days, he will think about Sarah Foxell. I would sooner have my freedom to come and go as I please and still get my three meals and, if I want, go to a gym.

  73. What you people don't understand is this-When the defense goes to the prosecution with a plea offer the prosecution must present this offer to the family. Because the family chose to accept this offer the prosecution must accept it as well. You can blame Matt all you want but the bottom line is the family is happy with this outcome and the prosecution must respect that.
    I know nothing about Sarah's family accept for what I have read which as we all know can be 99% false in most cases however as bad as her home life may have been by saying that it was her families fault for what happened is essentially saying that any child that is kidnapped, molested or murdered is the parents fault. Not everyone is perfect and they will have to live the rest of there lives without their beloved little Sarah so lets try and not throw stones when we all live in glass houses.

    Proper English allows for "it makes no sense" as well as "doesn't make any sense". Both are correct as neither uses a double negative.

  77. ***EVERYONE REMEMBER*** As Annon 5:07 said, due to his crime he will NOT be in general population!!! He will remain in segregation where he will have no fear of violence from other inmates. He will have to live "alone" for the rest of his life, but he will still be able to have property (including a tv), access to reading materials, exercise time, and 3 hots with a cot. It will not be the Hilton Hotel, but the important thing (at least I think) is that he WILL NOT have to fear others!!! Just time! I don't think it is an even "DEAL" for taking the life of an 11 year old girl AFTER RAPING HER!!! Just my opinion.

  78. I wish I had known about this site back in november of 2009 when levi willey sr sexually assaulted my daughter and only received an 18 month sentence for his malicious crime. Our legal system is based around protecting these individuals that committ these horrific crimes, so general population is out of the question for that worthless piece of .... thomas leggs. Levi willey has money and im sure that was taken into account when he was sentenced. I could go on and on about this man and his family but it just angers me and brings back memories that I wish would go away

  79. Shame on the Grandmother for grandstanding today - by the way, where was she when Sarah needed her the very most? As far as that goes, where were all the adults in Sarah's life when she needed them? Rest in peace Sarah. As for you Joe, job well done in keeping everyone informed every step of the way on this horrible murder.

  80. anonymous 8:49, trust me, we're no where near done with this case. The Grandmother freaked out today in the hopes of shutting me up. All of you will soon learn, NO ONE scares me. We'll have plenty more to share over the next two or three days. It's been a very long day. Lots of notes to go over and lots of meetings over the next few days to gather more information. It takes a lot of time to put things like this together. Remember, we don't want to say a whole lot yet as far more information will be forthcoming in a book.

  81. 8:49 and now that woman's granddaughter (Jennifer's daughter) is starting to bring home the illegitimate babies! Joe was right in stating in his interview that the truth hurts. That's the reason the woman's so freaked because it is all the truth.

  82. Of course everyone is upset about the outcome of this trial. When you surrender your rights to the government, you lose the ability to tell the government how to legistlate. Sarah Foxwell's murder is truly tragic and sad. My heart goes out to those that are left behind to remember her.

    But I am confused as to how tougher laws will keep children safer? We continue to ask the government to pass tougher laws but it doesn't make the community any safer. We submit our responsibilities to our government, in turn for what? A false sense that we are safer from these predators? It is my responsibility to protect my family, but the government handcuffs my abilities to do so.

  83. I don't believe in God, in fact, any organized religion. Please don't judge me, I respect anyone else's right to practice any religion or lifestyle they choose, in short, live and let live BUT.....I have to ask... I'm reading a lot of "thank God this and God bless that in reference to this case. What kind of " loving God" would allow this to happen to a child. Where was God when this poor child was being raped, beaten half to death and set fire to.. The amount of suffering this little girl went through is incomprehensible.

    While I don't agree with the plea and would have loved to see this animal put to death, we have to be cognizant of the number of cases over the years that have resulted in an aquittal or mistrial on some obscure technicality.

    I participated in the searches for little Sarah and I come into contact with members of the Sherrif's department almost daily and I'd like to praise them for the relentless manner in which they tried to find Sarah in time. I saw officers (respectfully) refuse orders to go home and rest, to be with their families for Christmas because they'd worked double, triple shifts without a break.

    This tragedy united this community, let's not dishonor Sarahs memory by tearing it apart over how we believe justice should have been served. He's off the street..permanently, he'll never violate another poor child and though a small consolation, he'll spend every living minute of that sentence looking over his shoulder, for there's little doubt of what his future holds.

  84. It is not the laws that wil keep our children safe...It is the job of the PARENT to o that. We as parents should always be protective of our children. How these 2 women could EVER bring a man like Leggs into the lives of those children is beyond me. Is that due to their up bringing..I do not think so..It seems more like it was more due to their need for lust...Who dates someone your sister dated also, and we all know SLEPT WITH...To me that just shows no MORAL were ever introduced in either girl...and sorry granny, that was your job to instill morals in your kigs. I am truly sorry for the loss of Sarah, and I am sorry the family had to suffer through this. I hope a lesson has been learned at this poor child cost. All need to PROTECT our children, know who you bring in their life and HAVE FREAKIN MORALS and COMMON SENSE to know that someone like Leggs is SICK!! They will never change. And as far as Granny bashing Joe, well he is definitely not my favorite person, but I respect his freedom of speech and he is entitled to report things as they truly are. We may all not agree with it but it is opinion. But Granny should have NEVER been ALLOWED to go off like that. That was in POOR TASTE for the TV station to ever allow that whether she was right or not. Blogging is on thing BUT TV is another..I listen to that and thought I was reading one of those stupid GOSSIP MAGAZINE.

  85. 12:45 You ask how God could allow something like this to happen and where was he when this was happening. First question- God gives us free will. We get to choose our behavior. Leggs chose to hurt that little girl. Second question- God was with that little girl while this was happening and as you aren't a believer you can't know this but if God is with you in a horrible or painful situation the horror and pain can actually disappear. God simply tucks you under his wing and you are safe. Leggs may have been doing things to her "body" but God had her "soul". I believe this with all my heart but then I am a believer. When you are under God's wing no one can touch you. They may touch your "body" but they cannot touch your "soul".

  86. Whatever idiot said it cost more to execute someone is well, and idiot....and prob a liberal. I would execute him for free. How's that for cheap? Prison may be bad but hell is far worse...society needs to wipe people like leggs of the earth swiftly and send them on to hell. Not to mention every breath leggs draws is torture to the victims family. Leggs family gets to visit him in prison...can the foxwells visit Sarah? I hate that we all have to pay for leggs to live. Oh and spell checking on a blog is fn annoying.
