Joe, I have know about this post since it went up and I didn't make a comment because I just felt there is absolutely no way this could be true. Well now I need to share with you and everyone what I have come to learn. I work with a friend of a relative of Sarah Foxwell, now please keep in mind I am repeating what I have heard but based on the fact that several people in my office have asked off for Tuesday 29th I am beginning to believe it is true. Here it is - A plea has been done and Tuesday will be the day to be in Elkton because it is over. I don't know the details of this deal but I do want to tell you how i feel about it.
I am sick and disgusted with Davis Ruark,this man said over and over "I will settle for no less then the Death Penalty in this case". I believe that he told the family he would never plea out this case.
Anyway the reason I am sharing this information is that I feel anyone who had consider going to this trail may seriously consider going to Elkton on Tuesday.

I believe this to be absolutely correct. Salisbury News has been on top of this case more than anyone else. If you have ANY interest whatsoever in this case, my strong suggestion is that every one show up Tuesday in Elkton. Out of respect for Law Enforcement and the States Attorneys Office we will refrain from publishing any details until Tuesday. However, let me assure you, (if you cannot be there) we will provide anything and everything Tuesday morning referencing this case. You will NOT want to miss it, trust me.
GOOD! A plea will keep him in jail. And save us taxpayers Millions. It will also save the family dozens of court cases and brings then a close to this! It is cheaper to house him thankill him. And this way he will suffer.

ReplyDeleteThe plea is to kidnapping, he will only get a 20 year sentence! The murder and sex charges will be placed on the stet docket. I have an inside source and this is definitely true! Unbelievable!!
ReplyDeleteWow, Matt has just sealed his fate for re-election. I heard him say that he did not want to make a career out of this job. Well good choice because the voters wont want you back.

ReplyDeleteI heard the same thing. No evidence to tie him to the murder, only the sexual assault. And the kidnapping charge was the more severe out of the two. What a shame :(
this sounds twisted, but when will we ever find out what he did with/to her...? if the shades of what i heard were true, what he has done is reprehensible, and not worthy of a deal. he needs to face what he did in court.

ReplyDeleteI was thinking. Joe supported Matt for states attorney and has always spoken very highly of Matt. In yesterdays article it seemed clear to me that if Matt asked Joe not to say anything about this case yet he has allowed comments and even implied his questions to actually be true, Joe must have some pretty good information to do the opposite. Heck, he must be pretty mad too. Come on Joe, the cat seems to be out of the bag. Can't you just tell us what's really going on.

ReplyDeleteThe lawyers can only work with the evidence gathered by the police. If they evidence wasn't strong enough or not collected properly the lawyer could end up losing the case, and Leggs would be free or be handed a mistrial.
I have no problem with a plea as long as it's "Life w/o Parole," and I can't imagine it being anything other.
ReplyDelete37 months would suit me if it wasn't for the principle of it. After 3 yrs he'll be in General Population and won't last 30 days.
His death then wouldn't merely be painlessly going to sleep but it'd be a painful one that he knew was going to happen but never know when, how, or by who.
Yeah, there are alot of things worst than death and he'd experience alot of them during his affair with Bubba and when that ended he'd be tortured and haunted while not knowing when the end would come - only that it would be soon.

ReplyDeleteThis is unbelieveable to me. That good for nothing needs the death penalty as he robbed that poor child of a life. If they plea this case, the State's Attorney office is as worthless as I have always thought it was. I thought Matt Macerilli would make a difference, if he pleas he is just like Davis Ruark. God Help Us!! The murders go on, why not? A plea is down the road. This makes me sick...I can't stand to look at a pictue of that mad man, Thomas Leggs.

ReplyDeleteseriously though, i have thought about this since she went missing and was found. It would be hard to prove in this lawyer bound society that he did the final deed. No witness, and if the evidence is damaged or not collected properly, i just thought there was a glimmer of him getting off free. i know that just is wrong on the compass, but....
after saying that, would you rather it go to trial and he get off FREE or rather him take the plea and stay in jail.
Sounds like he had better lawyers than the state did.

ReplyDeleteHow the hell do you put murder and rape on a stet docket? I'd like to know how Sarah's mother and father feel about this. I'd also like to know how the custodial aunt, Amy Fothergill feels about this.
This better not be true. If it is we need to form a citizens group to figure out a way to NEVER let this happen again, to anyone, EVER!!!
It probably all goes back to that whole cell phone thing but I am confident that he will pay for his crimes one way or another.

ReplyDeleteLooks like the State is trying to hide records from the public. Up until this morning the case file showed all of the cancelled motions hearings with only one date left for motions March 29th. Now they are gone. What are they trying to hide? Is this not public record? What are they covering up?

I am 1:18 and I am not stupid, i was posing a rhetorical question. Just to ignite the flames further, we are paying for his trial and his lawyers. aint that something?
ReplyDeleteI am totally disgusted with Law Enforcement. The top people are nothing but LIARS! Not one of them can be trusted. Rudeark and Marshmellow should both resign if this ends with a plea! Joe, put up some of the comments from a year ago with Ruark blowing hot air!!
ReplyDeleteHis attorneys are public defenders assigned to the Captial offenses unit. They only handle captial crimes and they are very good at what they do Don't confuse them with any of the public defenders that you see handling minor cases in District Court. If he had to pay for the type of defense that he is getting at the taxpayers expense it would be well into the six figure range.

ReplyDeletePleas are done all the time.. and its a fact of life. He will rot in prison for a fraction of the cost of trying to execute him. Maryland won't do it anyways, His time in prison will be horrible... anyone ever watch those prison shows.. it's not picnic

ReplyDeleteJoe, i have some questions about this matter... i wonder if Matt or Davis would feel a kidnapping charge was suffice if this monster murdered one of their children? Also, wouldnt they rather go in and give it their best shot and fight to win this case then throw in the towel and cop a plea with this guilty S.O.B.? Poor little Sarah, she has been wronged all the way around. I feel its a sad day when you can go into a bank and rob it and not kill anyone, and get more time than a murderer... stealing money is worse than taking a life. Getting into a fight and almost killing them would get you more time than if you actually go do heinous things to a child and kill them... i have seen them fight less serious crimes with so much more determination than they are treating this little girl's heinous death. They need to take this on as if it is their child this happened to. She is basically all of our child. I just cant stand the thought of him getting a kidnapping charge and this child was raped, tortured and killed... where in the hell is the justice in this???? My questions are for Matt Macierello and Davis Ruark, anyone else is welcome to respond as well.

ReplyDeleteMatt M is not, by his own admission a criminal attorney. Someone said in another comment that we voted him in for a reason. Well yes, we did. The reason was we were all sick of Ruark and Seth Mitchell was not electable so that left Matt M. He flip flopped from the beginning then after talking with Davis and assuring the public he would keep Davis onboard for this trial, he won the hearts and votes of the people.

I'm sad to say that as much as I want the death penalty for him for murder, I reluctantly agree that DNA can't prove that. The missing link is HOW she died. I can't believe that somehow, even without a confession or God forbid, a video, there HAS to be a 100% connection to him out there somewhere.

The prerequisites for the death penalty in this state NEED TO BE REVISITED!

How can you think it's cheaper to house him ad infinitum, provide him all life's amenities that we all struggle to pay for, with no expectation of return from him and hope(just hope)someone "offs" him? Jeffry Dahmer was imprisoned for a long time(15 years, I think)before he was "taken care of". They still don't know how many young boys he murdered...some he ate. Maybe a hundred, and at least 70 thet they know of.
Imprisonment is too good for the perp in this case, imo!
Dahmer was convicted in 1992 and killed in 1994.
