Last night we produced a Press Release stating a teen was charged with a DUI in an accident locally. Turns out the Hospital found the blood alcohol test came back as non detectable for alcohol.
Even the Police Officer at the scene stated it could take up to two weeks for his results to come back. Yet he claimed to smell alcohol, therefore he charged the teen with such.
After personally speaking to one of the parents I can assure you, there's a whole lot more to this story than what came out of the Press Release. While most parents are in defense mode for their children, there's enough witnesses to this accident that will testify that it is nothing like what actually happened, (charges wise).
Obviously there will be more to come on this story.
Hope parents sue!

ReplyDeleteI think we're seeing so much disrespect for police because THEY DO LIE! I guess we can deny that just as much as we used to deny we had gangs too. Neither will accomplish anything but make things worse. There needs to be an independent group that can defend people and press charges against the police for this kind of thing. Then, they should lose their jobs. If they can't be trusted,they need to be GONE!

ReplyDeleteI hope it is true that she didn't drink and all the people slamming her feel like asses. It's obviously not a bright idea to first off drink underage and then to get behind the wheel. A 16 year old's brain hasn't developed fully in the area that they think of consequences of their actions. If she was drinking that's a terrifying way to realize those consequences. May God have mercy, compassion and comfort to all involved in the accident and their families!

ReplyDeleteCan we get a copy if the accident report? I hear both parties are to blame. The cop probably charges based on the smell of alcohol because if not his bosses would have repremanded him/her.

However since everyone was so quick to bash this 16 year old girl and it appears she was not intoxicated, why would people come on here and be so quick to judge the officer without the full story! Have you not learned your lesson? Why must there always be someone to blame and make the jerk?

On another note...isn't it illegal to publish a minors name? Why was her name published?

ReplyDeleteWitnesses say that the driver came to a complete stop but the truck either didn't have headlights on or the blow was blocking them. It will come out in court I suppose. Not for me (or you) to be jury, judge and hangman.

They don't care about the truth, they just feel good to get on here and bash people because their lives are so pathetic. I wouldn't be too worried about it, the ones that bash on here don't really matter much in the broad scheme of things. They are insignificant, and the loud minority. The silent majority will listen for the facts, then make a judgement.
She was cleared of Alcohol was she cleared of all other intoxicants? (drugs) DUI does not apply to just alcohol you know?
ReplyDeletePolice are human. They make mistakes and so do YOU! The one thing that is different is every day when they get out of bed their life is on the line. They are on duty everyday 24 hours a day. The call comes and they are out the door. Every day I must face the fear that I will get a visit from someone telling me that my loved one has been injured on duty.

I'm not familiar with this case, but what I can ascertain from the post and comments. A police officer came to the dcene of an accident. A 16 y/o was driveing a vehicle. In the course of investigating the accident the officer smelled the odor of something perceived to be alcohol. The 16 y/o was transported to the hospital. Now as to the alcohol odor. Odor does not necessarily indicate consumption, but would be part of the reason for charging a juvenile. Little Billy or Sally's friend could have spilled a drink on their clothes or in the car. He/She may work in a restaurant or a bar or her new perfume is one that has that aroma. Given this possibility and the fact that injury required transport. The officer goes to the hospital. If the victim is unconcuious blood is drawn if alcohol is thought to be present/ If the victim is concious a talk, to try to find more indications of alcohol use. Standard sobriety tests can't be performed as the victim is probably immobilized. Amazingly enough a lot of hammered people will protest they haven't had a drink or the ever so popular "2 beers". After the blood is drawn then it is packaged and mailed to be examined and blood alcohol determined at a certified lab. Two weeks would be a fast turn around. in the case of a juvenile the charges can be immediate as they are not citations like you or I get. It is a referral to Juvenile Justice, as the offense carries possible jail time. Being as they were 16 any indication of alcohol can be deemed possession, which would be a violation of civil law.
ReplyDeleteOh, I was in law enforcement, so don't berate me. I was pretty good at what I did, but today the many don't possess common sense and in many cases the officer's hands are tied as to what can and can't be done due to protocol and administrative rules. I'm defending no one here. I wasn't there, but I agree, posters here are quick to form an opinion and voice it no matter the outcome. I have never been a fan of posting DUI names and of press releases that release everything. There are a lot of circumstances that come into play that are not known from these quips released to the public. In my experience, in the hospital, if there was conclusively no evidence of alcohol, someone would "hint" to the officer this was not the case. One post did hit a good point, if alcohol was indicated to the supervisor at the police station, the choice may have been out of the officer's hands given he was not seasoned and experienced and willing to buck a superiors orders.
i sit next to this girl in my 5th pd. class and i can tell you firsthand she is not the monster she is being made out to be. Trust me. And as for the officer, if there was an alcohol stench in the car AND it was strong enough, it could MAYBE be probable cause. ill have to get with my criminal justice teacher on that

ReplyDeleteI'm not sure why it takes so long for toxicology results. I took my son to the hospital for an issue and they drew blood. The results were back before we left.
ReplyDeleteAlso heresay, so forgive me, but I heard the truck was brand new and were supposed to have automatic lights on which may have malfunctioned. The lights on the plow probably would not have come on if the headlights didn't as you have to wire them that way. Again, hopefully the investigators do their job and find out all the information needed for insurance claims, criminal convictions, etc.
I'd also like to add that if in fact alcohol was NOT a factor, an accident is just that, an accident. The teenage driver is going through enough without people here convicting her already. And headlights or not, the driver of the truck must feel awful as well. The main concern right now is bringing this little girl home.
this is 2:17. i know exactly how he feels. i ran into a girl back in november on the way home from football practice and knocked her in the ditch. the weather was less than stellar and i was having a hard time trying to get the windows defogged because my old car didnt have a/c. i couldnt see her turn signal at all
ReplyDeleteThere does need to be an INDEPENDENT review board and it should have FIRING ability if false charges are made against a citizen whose name is in the papers and defamed. The victim of the false charges should have the right to sue the individual LEO and the LE Agency. This will at least allow an innocent vitim the right to make their name good again and also be compensated for the negligent behavior of a bad cop! We need to protect the innocent victims even from LEO's.

ReplyDeleteYeah, funny how they put out a press release about an incident, but court findings are not made hugely public unless it is a high profile case. All people will remember about this is that a teenager was charged with DUI and was the cause of an accident. It's a shame.
ReplyDeleteI don't agree with names in the paper and the public's "need to know" attitude. Unfortunately, as we progress, the population insists on the "know it now" attitude. Shows, like Jane Valez-Mitchell and Nancy Grace, as well as blogs that can say anything they want under the right of free speech, fuel the fire that is undermining the legal system.We have to break the story and race to conclusions immediately. Insistance on the police making evidence public and the use of "experts" to profile and interpret without all of the details collected during the investigation, the cases and thier victims and suspects has to have an effect on the trials and it is usually detrimental.
ReplyDeleteWe need the sensationalism. Why not report the accident to the media. Names really don't need to be included and charges other than the actual cause of the accident aren't relevant to reporting the story. In this case the fact that the driver was 16 and alcohol may have been present made it really "news-worthy". With out any information, how can you draw the conclusion that the offiser lied, or for that matter, was mistaken as to whether alcohol was present in the vehicle or on the person of the charged driver. There were other passengers, and there is no comment on whether any of them were drinking or in possession of an alcoholic beverage. During an accident an open container becomes a projectile causing everything to smell like its contents.
She may be innocent, or not. The officer may be right or wrong charging the girl with DUI, but he did due to some type of evidence or observation that led him to believe that alcohol was a contributing facor on behalf of the girl. It is just that though, charged, she hasn't been found guilty, only accused.
So here, you the readers of this blog in the remarks, have made an opinion based on no evidence. Earlier you tried and convicted and talked down on a 16 year old. When information to the contrary is revealed, up you jump onto the new bandwagon, the police offider is corrupt, and out of spite or ego charged a 16 year old for no reason with a crime. Let's get real and hold off judgement until all the facts are revealed.

"it's nothing like what actually happened"?! good one! and you say the cops lie! by the way, dwi encompasses more than just alcohol impairment. as for charging him with dwi, the tests are subjective to being with, that is why there is the option for the blood/breath test, to prove or dis prove the officers observations. if a blood test was conducted and the blood sent to the msp lab for analysis, as is protocol, it does take up to two weeks or more to get results back. sounds like joe is stirring the anti police bandwagon again!

You are the same people that complain about the police and them having nothing better to do but feel that it is their sworn duty to prevent your car (one in a city of thousands) from being broken into when your dumb ass leaves it unlocked in the middle of the day with $500 cash, your laptop and ipad sitting on the front seat and then expect a federal investigation. You complain about the rising crime rate but turn a blind eye when they ask for more officers and competitive pay so the good officers don't leave for other agencies that pay more and work less.

If the officer smelled boozes and administered a Breathalyzer and the driver blew anything over a ZERO she is/was DWI period.
If she refused the Breathalyzer or she couldn't take it and they had to use a blood test and the blood test comes back with ANY presents of alcohol at all she is/was DWI period.
How bout everyone give it a rest. It really is none of your buisness anyway. Take all your bashing and turn it into something positive like prayer for the victim. Enough said!!!!!!

Why do you think medical deaths are reviewed by doctors and not a citizen review board. BECAUSE they do not know medicine.
ReplyDeleteFor the 16 year old, he/she will be fine, that is why we have further tests, lawyers, court, judges to make things right and provide all sides.
Anything sent to the Maryland lab takes months to get back, they have always been a slow result place. 3 to 6 months is normal. Another example that MD is not serious about crime.
