Judge: Donald Duck groping lawsuit can go forward

A Pennsylvania woman who claims Donald Duck groped her at Disney's Epcot theme park can have her day in court, a federal judge has ruled.

Disney must defend itself against April Magolon's claims that the character grabbed her breast as she held her child at the Walt Disney World park and then joked about it.

Magolon, 27, of Upper Darby, claims the May 2008 encounter left her with post-traumatic stress in the form of nightmares, digestive problems and other permanent injuries.

Her lawsuit also charges that Disney parks have a history of fondling complaints involving workers, and that Disney has "condoned" their actions, putting profits over public safety.

In court papers, the defense argued that Magolon sued the wrong Disney corporate entity and asked the judge to dismiss the suit or move it to Florida, where the encounter took place.

  1. I am not saying this didn't happen but she suffered to this extreme. Girls from Upper Darby are tough and so are the men. Surprised the Fiance didn't take out the duck if he saw it. I am also sure it is hard to move in the costumes. Sounds like someone looking for money.

  4. No wonder Aristotle(?) said "First, kill all the lawyers". Some one grabbed her boob and now she has digestive disorders, nightmares, and post-traumatic stress? Fire the worker, then turn right around and SLAP the hell out of her and her lawyer. These kind of claims ruin the cases of REAL injured people. How many milions will it take to make her nightmares go away and allow her to poop on a regular basis again? the judge should stand up, read the complaint, bust out in uncontrolled laughter, and throw the stupid wench out of the courtroom.

    According to Magolon's lawsuit, authorities in Florida received 24 related complaints in the week after a Walt Disney World employee dressed as "Tigger" was charged with molesting a 13-year-old girl and her mother in 2004. At least some were deemed credible and investigated by police, the suit said.

    The man playing "Tigger" was later acquitted of criminal wrongdoing, after his lawyer donned the Tigger costume in court and argued that his client couldn't see much.

    On the flip side, a 60-year-old Pennsylvania man was convicted last year of groping a woman in a Minnie Mouse costume at Walt Disney World.

    The victim said she had to do everything possible to keep Moyer's hands off her breasts.

    How long would YOU allow them to get away with groping people?

I said "fire the worker"...Arrest him if the facts dictate. But PLEEEASE, don't act like you just did 2 tours in 'Nam after someone grabs your boob....I wonder what she does when a drunk guy slaps her ass in a bar? Go into a catatonic trance and convulsions?? She sounds too fragile to be out in public. And trust me -- if I saw that happening to my girlfriend, I would have beat ole Donald into the hospital. She's looking for a payoff. Tell the chick to play Mega-Millions.

    We know what you were doing. Obviously you don't know what the bigger issues are.

    If she gets a payday, she gets a payday.

    That's what happens when people CONTINUALLY do bad things. They get hurt in the wallet since that is all they are concerned with.

    I think you are that 'frog' from another thread on here. That would explain your thinking, or lack thereof.

  11. 9:49...No, sorry, I'm not the frog....I post my name, unlike others who wish to post (bravely) under 'anonymous' (you know what I'm sayin'?).... the incidents described in the article documented some unfortunate incidents (criminal, actually) that occurred in a theme park that has had MILLIONS of visitors and the incidents were years apart. How many characters does Disney employ and how many visitors have been hugged by them? Answer? Over 100 million. "Continually" do bad things? Disney doesn't do that, but, rather, makes great efforts to employ the best people they can. I know because one of my son's friend was offered a position with them. Further, don't insult me because I think (as MANY people do) that getting your boobs touched DOES NOT cause "nightmares" or "digestive disorders " or (WTF?) "POST TRAUMATIC STRESS" LOL!! She's looking to get paid. For something that happens to women (sometimes good, sometimes bad) every day. Heck, I've had MY ass pinched and patted by flirtatious women. I don't remember any nightmares....
