Resume’ On the above date at approximately 4:15 p.m., Fruitland officers responded to the N. Division Street area reference a reported burglary. A description of the subject responcible was provided and while enroute officers observed a subject matching the description walking in the area of the traffic circle. Inquiry of the subject revealed him to be the accused and that he was wanted on an outstanding warrant from another agency and taken into custody. He was placed on the patrol car and officers proceeded the short distance to the burglary scene. Investigation of the burglary incident revealed the accused threw a lawn ornimate against a house breaking it and entered the residence uninvited through the front door. When confronted by the occupant of the residence, the accused stated “I am here for you” among other things. The occupant then pushed the accused to the floor and dragged him out of the house. The accused began walking away until he was apprehended by officers. While in the patrol car, the accused became agitated and stated “I am your worse nightmare”, you will see”, you don’t know who I am”, and began kicking the console of the partol unit doing damage to some electronic equipment. The accused was transferred to another unit which was equipped with a prisoner separation cage and transported to WCDC. A subsequent search of the accused revealed him to be in possession of CDS. He was remanded to the custody of Central Booking and due to his disorderly behavior, was immediately placed in a cell.
