Same-Sex Marriage Judge Finds That A Child Has Neither A Need Nor A Right To A Mother

U.S. District Judge Vaughn R. Walker, who ruled last week that a voter-approved amendment to California’s constitution that limited marriage to the union of one man and one woman violated the Fourteenth Amendment of the U.S. Constitution, based that ruling in part on his finding that a child does not need and has no right to a mother.

Nor, he found, does a child have a need or a right to a father.

“Children do not need to be raised by a male parent and a female parent to be well-adjusted, and having both a male and a female parent does not increase the likelihood that a child will be well-adjusted,” the judge wrote in finding of fact No. 71 in his opinion.

“The gender of a child’s parent is not a factor in a child’s adjustment,” the judge, who is reportedly homosexual stated in finding of fact No. 70. “The sexual orientation of an individual does not determine whether that individual can be a good parent. Children raised by gay or lesbian parents are as likely as children raised by heterosexual parents to be healthy, successful and well-adjusted. The research supporting this conclusion is accepted beyond serious debate in the field of developmental psychology.”

Despite Walker’s claim that this “fact” is “beyond serious debate,” one of the sources he cited for it was a brochure published by the American Psychological Association (APA) that was entered into evidence in the case, which specifically stated twice: “Few studies are available regarding children of gay fathers.” Walker did not quote this part of the brochure in his opinion.

However, Walker did quote this same brochure as saying: “[S]ocial science has shown that the concerns often raised about children of lesbian and gay parents--concerns that are generally grounded in prejudice against and stereotypes about gay people--are unfounded.”

  1. I have know several kids of gay couples, in this case female couples. They were perfectly fine.

    In my experience the relative educational and economic status of the parents seems to make far more of a difference in how your kids turn out vs sexual orientation.

  3. Most kids are not raised by a mother and a father anymore. I bet most of the readers here were raised by a sinlge parent. That is just the reality of it.

  4. it is when people like this are allowed to "rule" over the people of this nation and make descisions based on theories like this we truly are on the edge of the end of this great nation. how was this so called judge raised??

  5. It is amazing to me that one non-elected official could ignore and overturn the will of the American voters without fear of repercussion. This is a prime example why our current system needs to be changed NOW. God bless the Tea Party Reformists.

  6. The general crux of it is that children don't have to be raised in a traditional 2-parent household (mother and father) in order to be well-adjusted or successful. And that's true. I've known kids from single parent homes that were high achievers, very successful, etc. I've known kids from two parent households who are screw ups. If you take the same-sex part out of this equation/story, then you get what a lot of kids grow up with now- a single mom or dad.

  7. I don't think that there is an issue with same sex marriage. I don't think there is an issue with homosexual partners raising children. I do think there is an issue with the government not honoring the vote of the public.

  8. In the 1960's California voters voted for a state constitutional amendment that allowed you to dicriminate, based on race, when you sold your house. The courts had to step in and stop that too.

  9. No the general "crux" of the story is a homosexual voted and ruled pro homosexual. This liberalism and croanism has destroyed this country. Maybe Ohbama will win out and the end and we will become a musilm nation. Then let any homosexual speak out. They have a way of ending that gene pool.

    I am sorry there is no marriege between a same sex couple. I dont care what you say there are added stressors to a child raised by a gay couple. We all want to be nice and not offend homosexuals. Well to freakin bad. A complete idiot can see the issues arising from this type of parenting.

  10. 1:33 This liberal judge was nominated by Reagan defeated by a democratic congress then nominated again by Bush(1).
    He is considered an extremely conservate judge. The defense did not ask him to leave the trial because he is gay and do not plan to use it on appeal. It is not considered a factor in his ruling.

  11. duh. they are just figuring this out? what makes homosexuals less able to raise a child than anyone else? lets see, alcoholics, drug dealers, welfare mongers...no one bats an eye when they have 10 kids running around. as soon as a gay couple considers having a kid there is a giant uproar. you people really need to get a life. i get so tired of reading what you backwoods retards write about gay marriage, gay people, blah blah blah. i'm sorry that as you sit in your off brand recliner, drinking a beer and spewing hate all over a blog that you have a problem with your station in life. worry about your own lives and not so much about what everyone else is doing.

  12. Casey, you hit the nail on the head! There's such a double standard out there, and as long as it's a heterosexual situation, no matter how f*cked up, it seems to be okay. Take a loving gay couple raising kids, then there's judgment. Hey, at least you won't see gay couples using the welfare system, will you? So let the haters sit on their K Mart furniture and drink their Natural Light from a can, and spew their venom. Hope their trailers hold up if we have tornado!
