Court Halts California Gay Marriages Pending Appeal

SAN FRANCISCO – A federal appeals court put same-sex weddings in California on hold indefinitely Monday while it considers the constitutionality of the state's gay marriage ban.


The decision, issued by a three-judge panel of the 9th U.S. Circuit Court of Appeals, trumped a lower court judge's order that would have allowed county clerks to begin issuing marriage licenses to same-sex couples on Wednesday.


Lawyers for the two gay couples that challenged the ban said Monday they would not appeal the panel's decision on the stay to the U.S. Supreme Court. They said they were satisfied the appeals court had agreed to expedite its consideration of the Proposition 8 case by scheduling oral arguments for the week of Dec. 6.


"We are very gratified that the 9th Circuit has recognized the importance and the pressing nature of this case by issuing this extremely expedited briefing schedule," said Ted Boutrous, a member of the plaintiffs' legal team. "Proposition 8 harms gay and lesbian citizens every day it remains on the books."

  3. They can have all of the rights....just call it something other than marriage. Marriage has it's roots in religion - religion considers homosexuality an abomination.

    It also says that eating shellfish is an abomination in the very same chapter, also in Leviticus it says that I can sell my daughters in to slavery, and that we can all own slaves so long as they come from a neighboring country. If we are going to hold on to one part of religion shouldn't we hold on to all of it since the bible is the unerring word of God.

  7. Tell me 12:04 how is any of what I said a lie or distortion, I didn't quote exactly the passages but I will if you want me to.

    Going down the list, from the King James Version of the bible, shellfish is from Leviticus 11:9-12

    9 These shall ye eat of all that are in the waters: whatsoever hath fins and scales in the waters, in the seas, and in the rivers, them shall ye eat.

    10 And all that have not fins and scales in the seas, and in the rivers, of all that move in the waters, and of any living thing which is in the waters, they shall be an abomination unto you:

    11 They shall be even an abomination unto you; ye shall not eat of their flesh, but ye shall have their carcases in abomination.

    12 Whatsoever hath no fins nor scales in the waters, that shall be an abomination unto you.

    Next would be selling my daughters as slaves, I will admit I was wrong on that one, it's in Exodus not Leviticus.

    Exodus 21:7
    7 And if a man sell his daughter to be a maidservant, she shall not go out as the menservants do.

    Finally the slaves of other countries comes from Leviticus 25:44-46

    44 " 'Your male and female slaves are to come from the nations around you; from them you may buy slaves. 45 You may also buy some of the temporary residents living among you and members of their clans born in your country, and they will become your property. 46 You can will them to your children as inherited property and can make them slaves for life, but you must not rule over your fellow Israelites ruthlessly.

    Now I don't know how I lied or distorted any of those passages if you could let me know so that I can get it right next time I argue with a bigot that is trying to use a 2000 year old book to justify how they feel about someone that is different from them I would truly appreciate it.

    Also from your statement I kind of gather that you are not very familiar with the book that you seem to cling to so much, so if you are curious I can also let you know all the reasons that you should be killed and burn in hell forever according to the old testament as well. But I guess if I quote all those to you they would be lies and distortions as well.

  8. 1:54pm I could not have put that better myself. It's easy to pick and choose parts of the Bible to support your own bigotry. The same people often forget John 8:7 “Let him who is without sin among you be the first to throw a stone at her.” or Matthew 7:1 "Do not judge so that you will not be judged." It's alright for people to call me a pervert, or label my lifestyle an abomination, because I hold those two passages very close to my heart. These people can quote the parts of the bible that are highly publicized to condemn homosexuality like little bible thumping parrots, but usually are ignorant to the story in its entirety.

  9. Homosexuality is an abomination and for those of you who try and bend scripture to try and legitimize homosexuality are committing heresy . If you actually spent time following the Bible instead of looking for loop holes you might live a more fruitful life !

  10. Okay 10:15, Ill say it again how am I bending scripture, all you are doing is calling me a liar without telling me how I have lied. Have you ever eaten a crab or shrimp, I'm betting you have, the bible clearly states those are an abomination the same exact term used for homosexuality, how can you reasonably say that one part of the bible no longer applies but this other part does. Once again you are using a 2000 year old book that applied to a totally different culture to justify your own personal feelings towards a subject. Either you need to believe everything in your holy scriptures or none of it there is no middle ground, after all it is the unerring word of god.

    I'm so tired of hearing these bigots use the bible as some means to justify their right to push their beliefs on the rest of an un willing society.

    As an Atheist, I find any argument rooted in religion to be utterly pathetic. I also love how some of the loudest, most outspoken opponents of gay marriage are not the LEAST bit in danger of getting married themselves (straight or gay).

    Irony.
