They may be held beyond their terms if considered dangerous
WASHINGTON - The Supreme Court ruled Monday that federal officials can indefinitely hold inmates considered "sexually dangerous" after their prison terms are complete.
The high court reversed a lower court decision that said Congress overstepped its authority in allowing indefinite detentions of inmates considered "sexually dangerous."
"The statute is a 'necessary and proper' means of exercising the federal authority that permits Congress to create federal criminal laws, to punish their violation, to imprison violators, to provide appropriately for those imprisoned and to maintain the security of those who are not imprisoned by who may be affected by the federal imprisonment of others," said Justice Stephen Breyer, writing the majority opinion.

ReplyDeleteAvoid the controversy, force judges to impose maximum sentences for sex offenders. Remove all early release, good behavior, and reduced sentences. Start making criminals actually pay for what they have done. I am so sick of hearing the prisoners don't get this or that or they are treated unfairly. These monsters have harmed some one in some way and the only thing they deserve is to suffer and be held accountable for what they have imposed on others.
ReplyDeleteI agree with 5:49. I cannot stand a child molester. I believe they should, upon conviction, be taken out into the court yard and hung forthwith. But to give someone the authority to hold someone after their sentence has been served is just wrong. They're opening a Pandora's Box here. Who will be the next enemy of the state? Those who disagree with the government? No No NO!!! This is very bad. Very bad.

ReplyDeleteSex offenders, like all criminals, need to stay for their sentence, but to be able to hold them past that, indefinitely, is beyond our rule of law and opens the door for others to be persecuted as well.
When are we going to realize that we can't legislate morality, and we shouldn't legislate from the bench.
Big government keeps getting bigger and freedoms keep getting smaller.

ReplyDeleteNote: only 2 justice dissented, Justice Clarence Thomas and Justice Antonin Scalia. This means that even though a "liberal" wrote the opinion, other conservatives on the court agreed- including Chief Justice Roberts.
