ARE COMEGYS, SMITH & SHIELDS IN BED WITH A SCAM ARTIST ON THE "NORTH PRONG" LAND DEAL?


Take a minute and "google" one Bernard Kapiloff, a/k/a "SALKAP, LLC," who wants to sell to the City of Salisbury for $50,000 the same property that he purchased for $10,000 just a few years ago, known to be contaminated from when it was an oil storage facility.

City and state officials say that a North Baltimore doctor and newspaper publisher is responsible for one of the largest illegal tire junkyards in Maryland, and they are asking a District Court judge to force him to clean it up.

Dr. Bernard Kapiloff, a retired plastic surgeon, has failed for seven months to make good on promises to clean up his company's condemned 3-acre lot on a desolate dead end in Park Heights, officials say. The roughly 18,000 tires that fill a building and rusty trailers there make it one of the state's biggest unauthorized tire dumps, according to Maryland environmental officials.

"What stands out here is the size and type of violation," says Michael E. Braverman, chief of code enforcement for the city Department of Housing and Community Development. " This is an enormous snub to municipal government."

City officials say the case, filed Thursday in District Court, is part of a campaign against the heaps of refuse that mar poor sections of the city. They say this case is particularly worrisome because of the large number of tires, which are breeding grounds for mosquitos and rats and can lead to fires.

This is from a court opinion from 1998 that begins as follows:

Bernard and Lynn Kapiloff own six commercial properties in Balti- more City, which are located in high risk areas and have been par tially vacant over the years. Portions of one property were vandalized in December 1994 and again in March 1995, and a fire broke out in another property in February 1995. The Kapiloffs submitted claims totaling $668,421 to United Capitol Insurance Company, their insurer, for those losses. United Capitol denied the claims because of "misrepresentations, omissions, and concealments" about the properties and, alternatively, because the properties violated the "vacancy" and "protective safeguards" conditions in its policy. Thereafter, United Capitol sued the Kapiloffs for a declaratory judgment, and the Kapiloffs filed a counterclaim for breach of contract. They also joined their insurance brokers as parties, alleging negligence.

Ruling that the properties were either vacant or lacked protective safeguards and that the "vacancy" and "protective safeguards" conditions in the insurance policy operated to exclude coverage for the losses, the district court entered summary judgment in favor of United Capitol. It also ruled in favor of the insurance brokers who procured the United Capitol policy on behalf of the Kapiloffs on the grounds that suitable insurance was not available in the market and that one broker was not an agent of the Kapiloffs. For the reasons that follow, we affirm in part, reverse in part, and remand for further proceedings.

Bernard Kapiloff & DAB –Andard Ltd. Partnership Baltimore City were issued a Complaint, Order and two $5,000 Civil Penalties on Dec. 1 for illegal storage and disposal of scrap tires on two Baltimore City properties.

  3. Why would they be in such a rush? There is no urgency here...this property has been the way it is for quite awhile.
    Wait...I know...they're rushing so that cooler heads don't have time to prevail.
    How completely irresponsible of them. This is particularly aggregious, since they've had plenty of opportunity to think it through and do their homework...biggest task would be the report and estimate of clean up costs to the taxpayers.
    AND, if you've ever heard of Kapiloff, you'd know he's giving it up so that HE doesn't have to pay the (probably) huge cleanup expenses.

  6. If they are rushing to "scoop up" this deal before anyone else takes advantage of it in front of them, I'd say they have about 25 years before that's going to happen! It's time to be a cooler head.

  7. I used to work for Kapiloffs at a newspaper. Back then Bernard was a dentist...it says he's a retired plastic surgeon. Interesting.

  8. Add the expence of cleaning this up to the bill of fixing the waste water treatmentplant and it is going to be REAL expensive to live in Salisbury. Has anyone contacted the Dept Of Environment to see what needs to be done?

  9. This deal smells! Come on Mayor, stop this before it bites the city in the a**. And it will. It is NOT a gift. That is a sham. The city needs to get a real lawyer to look at that. They are paying $50,000 for a trojan horse. It smells almost as bad as a Barrie/Dunn deal.

  10. The purchase of this property is similiar to buying the Love Channel in New York. Research this situation and get a preview of the results of buying contaminated property.

    I seem to remember two local properties that were and may still be contaminated that being the old J.I. Wells creosote plant on Pemberton Dr and the Tilghman fetilizer plant on Fitzwater St.

    The old Wells property is a lot of acres which has hunreds of feet of water front on the Wicomico River, prime real estate. This property has been abandoned for YEARS.

    There is a least a possibility the property being bought by the city may well befall the same fate.

    I have a good 1/2 acre 200 yards outside the city limits that you can buy. It has a nice home on it, and has no Hazmat problems with it. I'm only asking $10,000,000.00 for it, and I think it would be a great addition to your City. It's near the mall and other north end shopping. Please call ASAP!

    The deed to "SALKAP, LLC" was done by Wilber's law office. That helps to explain why he sat there last night without advising his client to have the environment study done and told the Daily Times that the mayor may not be able to veto that ridiculous land deal.

    When is Ireton going to fix things in City Hall?

    A Mayor who would use the Bully Pulpit and tell it like it is. A Mayor who would do the right thing for all the right reasons.

    I pray my hopes will be answered by Mayor Ireton.

Bubba and Louweasel are on a "hate" mission against the new mayor; anything he likes they disapprove of no matter what the consequences to the city are; anything he doesn't like they push through with the famous 3-2 vote. I watched the council meeting last night and Bubba was WAYYYY out of line with Terry Cohen and Louweasel just let it happen, Shanie pulls out the race card at every opportunity and every time she opens her mouth she shows her stupidity. She don't even know what she votes on 99% of the time...just goes along with the morons. Barrie still runs this city until the next council election; then we will see some changes I hope.

    And BTW, word is Mr. Ireton will veto that 3-2 vote on that property last night.

  19. 6:42, the paper said Ireton is leaning toward a veto, but the paper claims Wilber is saying he may not be able to veto this.

    Say whaaaaaat???

    Wilber supported vetoes before when it was Baaaaarrie.

    6:32, you're saying Wilber's office handled Kapiloff's deed? Isn't this a major conflict of interest?

  21. I just saw the image on this. What the heck? Wilber's office? Did that firm handle the deed and Wilber smell an opportunity for some more business from the city? Didn't they say something about this going on for 5 years or more?

    I don't recall Wilber saying that his firm handled the previous deed. Isn't he supposed to disclose that?

  27. Aquire the property seek grants for demolition of the structures, remove the impervious surfaces, place storm water swales at the street side of property (within the 2' of capping, grass the site.
    Site cleaned up, Storm water run-off does not go in river. Storm water reduced (no impervious surfaces), sub-soils not disturbed, park like setting, any storm water is cleaned and filtered before leaving the site.
    Accomplishments cleans up blight, reduces storm water in river, storm water that leaves site is clean. Low cost improvements. What did Jim run on?

  29. Dr. Bernard Kapiloff and his wife Lynn Kapiloff should not be doing business in Maryland. If anyone would google them, they are sue happy... anything for a dollar people. The doctor tries to overshow these disgusting business he owns with generous contributions to hospitals, once he donated 1000.00, (insert sarcasm here) He is a MILLIONAIRE and has made his fortune ripping off the good citizens of the state and hoarding eye sores and environmental hazards in this state in order to collect tax write offs. There needs to be a class action suit against him and/or his Estate. Swindling money out of business prospects to add to their millions, disgusting!!!!
