My Thoughts on the Claude Holland Case

OK.....here we go.

I have read countless court syllabi. There is one thing I know for sure. When reading court syllabi, we must break them down into smaller parts and decipher each part. Once each piece is digested, we can get a better view of the bigger picture. (we can't forget the footnotes)

According to the first paragraph on the first page, Claude claims that he was wrongfully terminated because he exercised his first amendment right to free speech. In the footnotes I see that there were other claims which were either dismissed or for which the plaintiffs were ordered to replead. That order and related memorandum are not included with this post. It is EXTREMELY important to note that this case only relates to an alleged violation of a first amendment right.

Part one lists the names of the involved parties and their roles. It lists some degree of background and the basic facts of the case. This includes statements made during deposition.

Part two lists the details of the claims made by the plaintiff and how the court must, in it's opinion, view the claims in light of relevant case law, etc.

Part three is the final opinion of the court.

I find it interesting that the Judge never once mentioned that Nelms broke labor law by ordering Claude to go out on comp time until he decided what to do with him.

I quote Findlaw for legal professionals:

Following Heaton v. Moore, 43 F.3d 1176 (8th Cir. 1994), cert. denied, 515 U.S. 1104 (1995), the court concluded that, under Section 207(o), "compensatory time off must be consumable by the worker on the worker’s terms.”

It seems to me that the only legal way to get Claude to stay home in that circumstance would have been to suspend him.....right? Looks like a de facto suspension to me.

I guess the Judge never mentioned it in his opinion because it is irrelavent to the first amendment claim.

The court ruled, in essence, that the first amendment right protects citizens from being punished for speaking out against the govt. when it relates to a matter of public concern, not an employee speaking out against a supervisor.

The court DID NOT say that Claudes termination WAS lawful. It just said that a wrongful termination suit had no merit in this case because, as a matter of law, there was no first amendment violation.
The court DID NOT say that Claude is mentally defective in any way. The Court NEVER addressed whether or not Claude was unfit for duty, and in fact it never came into play in this case. Statements taken during deposition relating to a psychiatrists opinion were submitted to the court, but the judge never mentioned it anywhere in his decision. It's a non-issue.

I don't think you will EVER find a psychiatrist who would be willing to give a guarantee on the future of ANYONES mental health. Regardless of your past. That could be career suicide. My opinion is that Claude was instructed by an attorney to go out on medical leave due to stress and depression. (happens all the time) Hunter set out to make an example of him because Hunter has an ego as big as a house. Hunter justified the termination by stating that it was in the best interest of public safety. A giant stack of horse shit if you ask me. The biggest mistake made by Claude was that he underestimated Hunter.

In the end, though, I don't feel a first amendment violation occurred. I think the court was proper in it's judgement.

I find it interesting that after relieving Claude of his position within the DRILL academy, bad things began to happen which resulted in the dismissal of Bob Van Meter. In my opinion, Hunter would have been smarter to get rid of that ass kissing, no good, backstabbing, lying SOB Van Meter and kept Claude.

  2. Grandad should be running this blog. Not only does he know how to read but also tells it like it is unlike his 'blinders on only' partner Albero. Very fair, honest and not opinionated! Grandad, do us a favor please! Tell Albero to stop running to the next room and submitting all those replies on his spare computer as if he wants readers to believe they are coming from the Hollands. I know he must be near exhaustion and close to an ulcer from no sleep because they havent responded yet!

    I have no idea who you are but my suggestion would be for you to give your opinion on Joe's sight more often. Finally someone who sees the whole story. From someone who knows Claude very well you hit it right on, Claude underestimated Hunter's coniving, backstabbing ways. Unfortunatelly Claude was from the old school where you did your job and did it well, you follow the rules, and you expect to be respected for it. With Hunter Nelms thats not the way it worked, if he knew you knew to much on him or Van Meter then he found a way to get rid of you. Claude was advised to take some time off for stress leave, the same as Davis Ruark is doing. This was never about money, only a great person wanting an apology and a job he did well. He was pushed to go as far as he did. It should tell everyone something that he did not accept the years severance package when offered it. He did not want the money, he wanted his job and his pride. His family has been to hell and back over this and continue to do so because of comments from people like Joe who do not know the story and refuse to dig deep enough to find out what it is. It's obvious that Hunter still had a few of the good old boys in the Sheriff's department that are filling Joe full of lies. From myself, a big thank you for reading and understanding the whole picture.

  5. Finally someone took the time to read into the summary what it was really about. Grand dad must know Claude because he sees the truth behind all the lies that were and continue to be spread about this fine young man. I would challenge Grand dad to talk his friend Albero and have him meet Claude. It would only take one time and he would know the kind of person Claude is. Unfortunately he chose the side of Hunter Nelms who we all know is crooked and got rid of Claude to cover his own butt. I'm also glad someone finally mentioned that once Claude was relieved of his duties the whole drill academy fell apart. That should be a no brainer......tells you who was doing the work and running the place from the beginning. Claude had the upmost respect from everyone, his employees, the kids at the drill academy, other law enforcement officers, and the members of the County Council that were not in Hunter's back pocket. I hope Claude continues to push this thing as far as he can go. His attorney Robin Cockey is one of the most respected lawyers in the business so for him to take the case after reviewing all the facts and papers tells you he knew Claude was telling the truth. It was never about money, lets hope Mike Lewis is the man he said he was and follows through with his promises to Claude.

It is truly a shame that we have some much going on in the world today that you Joe would want to drag a person and family through one of the most painful things in their life.No one has even brought the fact that Claude is also a retired veteran of the United States Coast Guard. Trust me you do not get to stay twenty years in a brach of service like the Coast Guard if you are unbalanced. i myself am a veteran of the Coast Guard and there are situations that a person is put under to react with a calm head and steady hand or the out come is fatal.The Hollands will be at my house for dinner tonight and we will have a wonderful time laughing and enjoying friends and family.I hope and pray that one day you meet Claude and he has the chance to explain IF HE WANTS what happend.

  8. IMO, Robin Cocky is sucking them dry, (unless he's taking it on contingency) financially.

    When emotions run high, people will do almost anything to try to get back at the other party.

    Lawyers know this and that's how they make money.

    As for this Post, it's a great view of what possibly happened and I personally encouraged Granddad to Post it. Ask him, he's an honest man.

    My original Post exposed the situation and quite frankly, you people didn't like me doing so. ALL of you know I am Pro Police but in this case there are two sides to the story and YOU have been given the opportunity to share yours, unlike WMDT & WBOC.

    As for the threats, you people don't scare me. You are grown adults acting like little children, simply because we don't agree. Get over it and grow up!

    Also note, my name is on every comment. I hide from no one. No, not because I'm a bigger man and tougher than any one of you. It simply proves I'm a man, period.

  9. It has always been known who Claude's attorney is, its been posted in the real news, The Daily Times several times and has been on tv. Yod didn't put a story on and expose it, you as slways give your biased opinion when someone attacked a good old boy whos as crooked as they come, your friend, your buddy, The unhonorable Hunter Nelms. Hey Joe, why dont' you call Sheriff Lewis and ask him what kind of man Claude is, he knows Claude's whole family and can attest there is not a finer bunch but more important , not a finer officer on the streets. If I was working a case or my life was in danger Claude would be the person I'd want covering my back.

    You got to be kidding a retired Coast Guard proves he is not crazy. He is retired reserves Coast Guard!! This means he did nothing to get that retirement pay check. He received his retirement by playing on the weekend and not in the real service. He did pass the Coast Guard test being 6 feet tall, since his case the ship sunk he could walk back to shore!!

    Read the report again since he was a very very dangerous man!!

    We all have and make choices in life. Mr. Holland is an intelligent individual who made his Choice to pursue certain actions. To Spin it any other way, is quite disrespectful to him.

  12. Joe...you need to first understand what the word threat means. Here's the definition:

    threat (thrět) Pronunciation Key
    n.
    An expression of an intention to inflict pain, injury, evil, or punishment.
    An indication of impending danger or harm.
    One that is regarded as a possible danger; a menace.

    I've read and re-read the 10 commments thus far and have yet to see one THREAT. It's not that we don't agree. You and I just have a differances as to what are FACTS and what are simply made up statements.

To anonymous who thinks they know so much about Claude Holland and his Coast Guard Record, did you read that off of his personnel files that were lifted along with the incriminating papers he had on Nelms and Van Meter.....or is this you Van Meter? If you did you must have read to fast because Claude was in the Coast Guard , he only went in the reserves after he did his time in the Coast Guard. Again, another of Hunter's cronies telling the version they have made up.

  18. Like I said, I've read tons of these things, the same as many of you. I've also had the esteemed pleasure of having worked with Claude.

    I spoke with Joe last night and he convinced me to publish this as a post rather than a comment to the original display of the court documents as was my original intention. Joe's opinion was a result, IMHO, of reading the syllabus of the court, (which contained language that was basically irrelavant to it's finding) not knowing Claude, and knowing Hunter as a friend rather that having worked for him as many of us have. This combination is bound to result in an opinion which is different than many others. But it's his opinion ust as everyone has their own. We all have that right....it's the American way.

    As for this blog...you all may want to look at this from a different perspective. Many, many people visit this blog every day. I don't know about the numbers but if you look at the number of comments, regardless of their contents, one can deduce that it draws a lot of visitors. A "blog" is a form of interactive communication which provides for a free flow of information. This is a valuable resource these days. Can any of you honestly say that you've never learned anything by coming here? Can any of you honestly say that there has never been a time that your opinion has been ....um..."enlightened" by reading the opinions of others which were posted here. I know that mine has....and so has Joe's. He's told me so.

    The controversial nature of some of Joes posts is one of the things that keep people coming back.

    It really doesn't matter who publishes the posts or makes the comments. The fact that people are communicating is the important thing in my opinion.

    Keep making your comments everyone. Share what you know. You may be surprised at hom much it really matters.

  20. WTF happened to Robin Cockey? He used to be vehemently opposed to SAPOA, the good old boys and Barrie Tilghman. And then he sold out and became one of them.Now he works for his former enemies. Go figure. Guess it coincided with his affair, dumping his wife etc. Such a man!!

  22. Van metrer lie? This is so funny. i grew up with the Van meters, they all lie. the whole family, so why should Robert be any differant. Apparently he is like his mother and father. They make crap up and spread it like wild fire. I may add with not an ounce of truth or fact to it. That whole family is assholes. Robert should be behind bars. They have made some lives hell with absolutely no basis behind it, so he gets what he deserves. I wish i were there to see him booted out. I have no comment on anyone else in the article because i dont know them however i do know Van meter and i always wondered as to how he got his job to start with. its all in who you know and blow. What goes around goes around.

  24. Grand Dad gave a good analysis of the situation from the legal view. But, the one thing I still want to know, as a tax payer who no doubt contributed to the cost of the buildings at the defunked "Boot Camp" for troubled young men, is what is the status of these buildings? Have they been sold and if not why not? Nelms bit off far more than he could chew, trying to set up this correctional facility and get it to work!

  25. You people think you know it all. Holland was still in reserves since he took off to perform his weekend duties to earn this points toward being in the service in order to retire. Come on and smell the roses. How can you state such bullshXX. This guy is a dangerous man and anyone that can look him in his eyes can tell the difference. Granddad does not know what he is talking about. Look at this DD 214 and this will tell the truth. Anyone that has served will know the truth. You are all so full of Shxx.

  26. I don't know Claude Holland but I do know the USCG. Anyone discharged or retired from the USCG has a period of inactive reserve time left on their enlistment. He may have chosen to do his time as an active reserve, I don't know and it doesn't matter. There is no shame in serving your country whether it be full time active duty or part time reservist. Those bitching about his time in service should announce when and where they served their country. Don't go bad mouthing reservists either, who do you think they activated and shipped over to Afghanistan and Iraq? In case you don't know it was military reservists.

  27. The old drill academy stayed in the County family & is being utilized by the Wicomico Detention Center. I do not think any "hard crime" individuals are housed there.

I did not know Mr Cockey until I needed a lawyer in a very simple case.We met with him,talked over the problem(he seemed to care about the problem)said we had a case.Told us he would write a letter that should stop the people in their tracks and make the police stop making false statements. We paid the $300.00 to have the letters sent. He never wrote the letter and don't return the phone calls but took my money.
    You can only judge a man by how he treats his family and friends and how well he keeps his word on promises. I think that statement speaks for it's self concerning this man I would rather be an illiterate peasant then a man who let his family down and never keeps his word. Just my opinion from an encounter with a person that does not keep his word and takes your money for doing nothing to help you.
    I am sure this is standard ethics for people like this. Thank God I foumd out the type of man he is before it cost me more.
    No respect.Looks like a lot of his cases are in question.

  30. I found Mr Cockey to be a VERY honest man,I can depend on what he says(may take some time). Will use him for an attorney any day and know he will do his best.
    Things have changed since my last comment,I have got to know him much better and realize he is a man to be trusted. HE IS A GOOD MAN.
