they had to make something up to charge him with just to force him to identify himself. he has to keep specifically asking "am I being charged with anything" and "am I free to go" in order to be able to walk away without being charged with not complying. the fact that he smelled like alcohol is meaningless, he could have just finished a beverage, does not mean he was intoxicated. disorderly is so subjective and was simply conjured up so that they could control him for what ever reason. You do not have to identify yourself unless you are being charged, nor specify where you have been or where you are going. but none of that matters here in wico county, they do as they please and violate your rights when ever possible. Looks like the dude may have a nice lawsuit opportunity if he follows thru with it.
I'm a big fan of the "flex your rights" videos. I definitely think that "I don't consent to any searches" and "Officer, am I free to go or am I being detained?" are two of the most important sentences to remember. To detain an individual they must have probable cause that a crime has been committed or a law broken.
